В первой части статьи предлагается обзор международно-правовых теорий демократии, вторая часть посвящена взглядам на роль международного гражданского общества в решении проблемы демократического дефицита на международном уровне, в третьей части освещены исследования международного правления. = Present article analyzes the issues of democracy in contemporary Western international law doctrine. Firstly the theories of democracy in international law are discussed, than presented are views on the role of international civil society in the elimination of the democratic deficit at the international level and finally international governance studies are briefed.

Zwar wurde Indonesien 1991 Mitglied in der UN-Menschenrechtskommission, doch hatte dies kaum Auswirkungen auf die Situation in diesem Land, das seit dem Militärputsch und der Machtübernahme durch General Suharto im Jahre 1965 eine Epoche der Massaker, politischer Verfolgung, Folter und Unterdrückung erlebt. Die internationale Empörung über diese Zustände einschließlich der widerrechtlichen Annexion Osttimors (1976) - was im Falle Kuweits immerhin den Golfkrieg provozierte - fiel dank der wirtschaftlichen Bedeutung Indonesiens und seines strammen Antikommunismus' sehr verhalten aus. Auch heute noch gibt es keine breite Öffentlichkeit hierfür, so daß die wie immer fundierte ai-Dokumentation sehr zu begrüßen ist und selbstverständlich in jede Bibliothek gehört. Die Frage nach dem Umgang mit »treuhänderisch« verwahrtem Kulturgut bzw. Raubgut betrifft Bibliotheken, Archive und Museen sowie jüdische Institutionen. Während die gängigen Erwerbungsarten in Kultureinrichtungen wie Kauf, Geschenk, Pflicht und Tausch übliche Geschäftsvorgänge darstellen und im Rahmen der NS-Provenienzforschung kritisch untersucht werden, sind mit Auflagen versehene Übernahmen und Verwahrungen wie Treuhand, Leihgaben oder Legate, aber auch staatliche Zuweisungen im Kontext von NS-Kulturgutraub und staatlichen Transformationsprozessen bislang wenig beachtet worden. Neben der Darstellung der bisherigen Handhabung »treuhänderisch« übernommener Kulturgüter werden hier strukturierte Vorgehensweisen sowie die Anforderungen, Chancen und Grenzen eines adäquaten Umgangs interdisziplinär erörtert. The question of how to deal with cultural property or looted property held "in trust" concerns libraries, archives, museums, and Jewish institutions. While ordinary kinds of acquisition in cultural institutions, i.e. purchases, donations, deposit copies or exchanges, have been examined within the scope of NS provenance research, another type of transaction has been mostly overlooked so far. It concerns the transfer of objects with conditions attached, with institutions accepting items "in trust", as loans or as legacies, or objects being allocated to institutions by the state, which occurred as part of NS book and art looting as well as in the course of later political developments. On the basis of how libraries, archives and museums have so far dealt with cultural objects held "in trust", national and international librarians, historians, curators and legal experts are invited to discuss structured procedures and lead an interdisciplinary debate on the requirements, chances and limits of appropriate measures concerning objects which have been illegally acquired and have been received "in trust"
