Les regles nationales et internationales en matiere d'arrestation et de detention n'ont pas ete respectees. ... De telles pratiques constituent une grave menace pour le respect des droits de l'homme. Amnesty International estime qu'elles pourraient remettre en cause les nombreuses sauvegardes garanties par la Constitution et visant a la protection des droits de l'homme. If cultural practices shape experience and expectations, they need to be identified and made accountable based on empirical research. Drawing on international relations (IR) theory, international law and normative democratic theory this article develops a framework approach to studying the contested meaning of norms in international politics under conditions of constitutionalisation beyond the nation-state. The goal is to formulate observations and identify a design for empirical research, which is suitable to examining the "invisible constitution" of politics, that is, the individually held associative connotations which inform contested interpretation of normative meaning. To do so, the article is organised in two parts. Part I derives research assumptions and hypotheses from the literature. It turns to the distinction of types of norms and conditions of norm contestation in section 1, identifies research assumptions and hypotheses in section 2, argues to bring culture back into constitutionalism in section 3, and summarises the guiding question of convergence, divergence, or diffusion of normative meanings in section 4. Part II then focuses on research operationalisation. Section 5 elaborates on the rationale of the research framework and type of enquiry. Section 6 highlights the method of interview evaluation. Section 7 identifies the research indicators including type of social group to be interviewed, fundamental norms that are likely to be contested, domestic political arenas in which the social groups operate, and issue areas linked with core constitutional norms. Section 8 summarises the case study's design and procedure. ; Wenn es zutrifft, dass kulturelle Praxen Erfahrung und Erwartungen prägen, dann müssen sie eindeutig bestimmt und für die empirische Forschung als aussagekräftig gewertet werden. Mit Bezug auf die Theorie der Internationalen Beziehungen (IB-Theorie), Internationales Öffentliches Recht und normative Demokratietheorie entwickelt dieser Artikel einen Ansatz, um die umstrittenen Bedeutungen von Normen in der internationalen Politik unter der Bedingung von Konstitutionalisierung jenseits des Staates zu erforschen. Ziel ist es, ein Forschungsdesign zur Untersuchung der unsichtbaren Konstitution von Politik, das heißt, zur Erforschung von individuell gehaltenen assoziativen Konnotationen, die zur umstrittenen Interpretation normativer Bedeutung führen, zu entwickeln. Umweltsysteme wie die Atmosphäre, Flüsse, Seen und Meere machen vor nationalen Grenzen nicht halt. Das wird in Europa besonders deutlich. Daher treten eine Vielzahl grenzüberschreitender Umweltallokationsprobleme auf. Aufgrund der nationalen Souveränitätsrechte lassen sich diese Probleme nur durch eine internationale Zusammenarbeit befriedigend lösen. Das damit verbundene Verhandlungsproblem wird in dieser Abhandlung untersucht. Mit Hilfe spieltheoretischer Ansätze wird im Rahmen von 2-Länder-Modellen analysiert, wie sich alternative Ausgangs- und Randbedingungen auf institutioneller Ebene wie auch in den jeweiligen Umweltsystemen auf mögliche Verhandlungsergebnisse auswirken. Dabei stehen allokations- und verteilungstheoretische Fragestellungen im Vordergrund.
Das Buch befasst sich mit den International Framework Agreements (IFA) – ein neueres Rechtsinstitut, mit dem sich transnationale Unternehmen gegenüber internationalen Gewerkschaften zur Einhaltung arbeitsrechtlicher Rahmenbedingungen verpflichten. Vor dem Hintergrund, dass ein internationales Arbeitsrecht fehlt, Unternehmen jedoch zunehmend global agieren, kommen Soft Law und nichtstaatlichen Vereinbarungen eine immer wichtigere Funktion zu. Die Autorin untersucht die derzeit gut 120 IFA hinsichtlich Rechtsnatur, international-privatrechtlicher Behandlung und Rechtswirkungen, insbesondere im Arbeits-, Kauf- und Lauterkeitsrecht. Neben der Bestandsaufnahme des jungen Instituts findet sich auch ein Ausblick auf die mutmaßliche weitere Entwicklung der IFA und ihrer Bedeutung im sozialen Dialog

This paper provides a broad empirical examination of the major currencies' roles in international capital markets, with a special emphasis on the first year of the euro. A contribution is made as to how to measure these roles, both for international financing as well as for international investment. The times series collected for these measures allow for the identification of changes in the role of the euro during 1999 compared to the aggregate of euro predecessor currencies, net of intra -euro area assets/liabilities, before stage 3 of EMU. A number of key factors determining the currency distribution of international portfolio investments, such as relative market liquidity and relative risk characteristics of assets, are also examined empirically. It turns out that for almost all important market segments for which data are available, the euro immediately became the second most widely used currency for international financing and investment. For the flow of international bond and note issuance it experienced significant growth in 1999 even slightly overtaking the US dollar in the second half of the year. The euro's international investment role appears more static though, since most of the early external asset supply in euro is actually absorbed by euro area residents.

How have individual countries fared? Do research quantity and quality indicators tell us the same story? We concentrate on trends taking place since the beginning of the 1990s and rely on a very comprehensive database of scientific journals, to provide a cross-country comparison of the evolution of research in economics. Our findings indicate that Europe is catching-up with the US but, in terms of influential research, the US maintains a dominant position. The main continental European countries, Germany, France, Italy and Spain, experienced some of the largest growth rates in economic scientific output. Other European countries, namely the UK, Norway, the Netherlands, Denmark, and Sweden, have shown remarkable progress in per capita output.
