Kata Kunci: Ijmak, Legislasi, Hukum Islam ABSTRACT Among the terms of ushul fiqh the most significant term to lear and criticized is ijmak. The ijmak theory starts from the crystallization of the basic tenets of Islam on the consent and unity of the peoplere, also recognizing the infallibility of the ulama consensus. There are a number of issues related to the classical ijmak theory and associated with legal drafting in Indonesia. After going through the process of discussion and analysis the validity of ijmak it is known that the ultimate opinion of the ulama is not required and its authority is relative. The main pillar of ijma' Theory is a democratic and independent shura spirit, and recognizes the infallibility of the ulama consensus. When the theory and procedure of ijmak compiled with the Indonesian Islamic law regulating in terms of institutions, procedures, and mechanisms, it appears the side of similarities and differences. The democracy, codification, and legal unification princip are embedded in the theory of ijmak and legislation. The difference found in the mechanism. Ijmak runs naturally, while the Islamic law regulating in Indonesia has its own rule. Therefore, the Islamic law regulating in Indonesia is included as a part of ijma. Keywords: Ijmak, Legislation, Islamic Law

It appears that religion tends to violence. Current political conflicts and Jan Assmann's theory about the link between monotheism and violence seem to confirm this thesis. Against this background, my contribution is looking for the exact relationship between religion and violence. Utilizing Luhmann's theory of power, I show how religious beliefs can change the distribution of power in real conflicts. These beliefs are themselves able to promote and to legitimate violence. Furthermore, I discuss the theological preconditions of a religious willingness to accept the use of violence. These are: (1) the conviction to know God's will precisely; (2) the belief that God implements his will by violence; (3) the idea that believers are allowed and obliged to use violence in the name of God. But there are contradictingconcepts of God within all the monotheistic religions. Here, mercy is the most important attribute of God, which is why God renounces his power and might. To overcome the violent forms of religion, we need to change the concept of a violent God. Finally, in the last chapter, I look for strategiesfor implementing the concept of a non‐violent God given that religious institutions themselves foster religious violence.

Linda Zagzebski's book on epistemic authority is an impressive and stimulating treatment of an important topic. 1 I admire the way she manages to combine imagination, originality and argumentative control. Her work has the further considerable merit of bringing analytic thinking and abstract theory to bear upon areas of concrete human concern, such as the attitudes one should have towards moral and religious authority. The book is stimulating in a way good philosophy should be – provoking both disagreement and emulation. I agree with much of what she says, and have been instructed by it, but it will be of more interest and relevance here if I concentrate upon areas of disagreement. Perhaps they are better seen as areas, at least some of them, where her emphases suggest a position that seems to me untenable, but that she may not really intend. In that event, I will be happy to have provoked a clarification or the dispelling of my misunderstanding. My focus will be upon problems in her account of communal authority and autonomy, especially with respect to religious and political authority. Here my worry is that she places too much trust in trust and not enough in what I call selective mistrust.
