The article deals with the definition and delineation of categories of "restrictions" and "encumbrances" of property rights in law and legislation. Legislative consolidation of restrictions and encumbrances of the property right as a subjective right is investigated. It is established that the ownership right is limited through the introduction of adequate mechanisms for its regulation. In the legislation and legal science concerning the right of ownership, it is about limits, restrictions and encumbrances. ; В статье рассматриваются вопросы определения и разграничения категорий «ограничений» и «обременении» права собственности в праве и законодательстве. Исследуется законодательное закрепление ограничений и обременении права собственности как субъективного права. Установлено, что право собственности ограничивается через введение адекватных механизмов его регулирования. В законодательстве и правовой науке относительно права собственности речь идет о пределах, ограничениях и обременениях. ; У статті розглядаються питання визначення та розмежування категорій «обмеження» та «обтяження» права власності у праві та законодавстві. Досліджується законодавче закріплення обмежень та обтяжень права власності як суб'єктивного права. Встановлено, що право власності обмежується шляхом запровадження адекватних правових механізмів його регулювання. У законодавстві і правовій науці відносно права власності йдеться про його межі, обмеження та обтяження.
