The purpose of the article is to analyze the existing memoirs and memories of the life and activities of the Chairman of the Directory and the Chief Ataman of the troops of the Ukrainian People's Republic Simon Vasilyevich Petliura and determine their role and place in the study of his personality. Convinced that the time had come to objectively and impartially evaluate this outstanding figure of the Ukrainian revolution of 1917-1921. The author set himself the goal of refuting scientific and ideological stereotypes and traditional postulates accumulated over the century around Petliura, realizing that this can only be done by studying diverse, previously unknown sources, including memoirs and memories, and then bringing truthful contemporaries to future generations testimony about his life and work. Methodology. The research methodology is to use a combination of methods: dialectical, analytical, historical, biographical, comparative. This methodological approach allowed us to analyze memoirs and memories retrospectively and, through them, trace the life and career of S. Petliura and draw the appropriate scientific conclusions. The scientific novelty of the results obtained consists in the comprehensive coverage of memoirs and memories of Simon Petliura to refute the established myths, establish the truth and provide the most objective and time-tested assessments of his personality. Scientific findings on the nature, characteristics, and objectivity of the studied memoirs and memories, and the rationale for the need and feasibility of their further study. Conclusions. Memoirs and reminiscences of the life and activities of S. Petilura significantly expand the source-study base as a whole about the national liberation struggle of the Ukrainian people since the Ukrainian revolution of 1917-1921 and its figures, and about S.Petlyure, in particular. The author's subjective vision of memoirs and memories of historical reality and historical personalities, his compliance with the own political views, ambitions, and preferences requires a critical attitude to what is written. A crucial objective analysis of memoirs and memories as historical sources, clarification, and verification of the facts contained in them, using primarily archival sources, documents, and modern research, will successfully overcome these shortcomings. ; Цель статьи заключается в анализе имеющихся мемуаров и воспоминаний о жизни и деятельности Председателя Директории и Главного Атамана войск Украинской народной республики Симона Васильевича Петлюры и определении их роли и места в исследовании его личности. Будучи убежденным в том, что уже пришло время объективно и беспристрастно оценить эту выдающуюся фигуру украинской революции 1917 - 1921 гг., автор задался целью опровергнуть научные и идеологические стереотипы и традиционные постулаты, накопленные в течение века вокруг Петлюры, осознавая, что это можно осуществить только с помощью изучения разноплановых, ранее неизвестных источников, в том числе, мемуаров и воспоминаний, а затем донести современникам и будущим поколениям правдивые показания о его жизни и деятельности. Методология исследования заключается в использовании совокупности методов: диалектического, аналитического, исторического, биографического, сравнительного. Указанный методологический подход позволил ретроспективно проанализировать мемуары и воспоминания и через них проследить жизненный и творческий путь С. Петлюры и сделать соответствующие научные выводы. Научная новизна полученных результатов заключается в комплексном освещении мемуаров и воспоминаний о Симоне Петлюре с целью опровержения устоявшихся мифов, установления истины и предоставления максимально объективных и подтвержденных временем оценок его личности. Сделанные научные выводы относительно характера, особенностей и объективности исследуемых мемуаров и воспоминаний и обоснование необходимости и целесообразности их дальнейшего изучения. Выводы. Мемуары и воспоминания о жизни и деятельности С. Петлюры значительно расширяют источниковедческую базу как в целом о национально-освободительной борьбе украинского народа времен Украинской революции 1917 - 1921 гг. и о ее деятелях, так и о С.Петлюре, в частности. Субъективное видение автором мемуаров и воспоминаний исторической реальности и исторических персоналий, соблюдения им собственных политических взглядов, амбиций и предпочтений требует критического отношения к написанному. Успешно преодолеть указанные недостатки позволит объективный критический анализ мемуаров и воспоминаний как исторических источников, уточнение и проверка изложенных в них фактов с использованием в первую очередь архивных источников, документов и современных исследований. ; Мета статті полягає в аналізі наявних мемуарів та спогадів про життя і діяльність Голови Директорії і Головного Отамана військ Української народної республіки Симона Васильовича Петлюри та визначенні їх ролі і місця у дослідженні його постаті. Будучи переконаним у тому, що уже надійшов час об'єктивно і неупереджено оцінити цю визначну постать української революції 1917 – 1921 рр., автор поставив собі за мету спростувати наукові й ідеологічні стереотипи і традиційні постулати нагромаджені впродовж століття навколо Петлюри, усвідомлюючи, що це можна здійснити лише за допомогою вивчення різнопланових, раніше не відомих джерел, у тому числі, мемуарів та спогадів, а відтак, донести сучасникам і майбутнім поколінням правдиві свідчення про його життя і діяльність. Методологія дослідження полягає у використанні сукупності методів: діалектичного, аналітичного, історичного, біографічного, порівняльного. Зазначений методологічний підхід дав змогу ретроспективно проаналізувати мемуари і спомини та через них простежити життєвий і творчий шлях С. Петлюри й зробити відповідні наукові висновки. Наукова новизна отриманих результатів полягає у комплексному висвітленні мемуарів та спогадів про Симона Петлюру з метою спростування усталених міфів, встановлення істини і надання максимально об'єктивних і підтверджених часом оцінок його особистості. Зроблені наукові висновки щодо характеру, особливостей і об'єктивності досліджуваних мемуарів й спогадів та обґрунтування необхідності і доцільності їх подальшого вивчення. Висновки. Мемуари та спомини про життя і діяльність С. Петлюри значно розширюють джерелознавчу базу як загалом про національно-визвольну боротьбу українського народу доби Української революції 1917 – 1921 рр. та про її діячів, так і про С. Петлюру, зокрема. Суб'єктивне бачення автором мемуарів і спогадів історичної реальності та історичних персоналій, дотримання ним власних політичних поглядів, амбіцій і уподобань вимагає критичного ставлення до написаного. Успішно подолати зазначені недоліки дозволить об'єктивний критичний аналіз мемуарів і спогадів як історичних джерел, уточнення та перевірка викладених у них фактів з використанням, у першу чергу, архівних джерел, документів та сучасних досліджень.

У статті досліджено диригентську діяльність М. Лисенка у контексті проблем ідентичності. Акцентуючи увагу на деяких історичних фактах з біографії митця, окреслено риси, характерні для класика української музики, чий вплив на мистецтво є масштабним та незаперечним. Охарактеризовано національно-культурну ідентичність М. Лисенка, що підкреслено нерозривністю його композиторської, виконавської та диригентської діяльності з національним фольклором і поезією. У контексті проблем ідентичності проаналізовано творчу діяльність М. Лисенка та визначено основні характерні ознаки культурної і національної ідентичності, а також самоідентичності, які він проявляв упродовж творчого життя. Зроблено висновок, що постать М. Лисенка є синтезом різних компонентів ідентичності і не може бути зведена до котроїсь із них через масштабність та інтегративний тип таланту митця. ; Starting from the second half of the twentieth century the concept of identity has become a universal explanatory paradigm, a universal tool for research. Linguistic and cultural divisions, "split" society, which is unfortunately Ukraine today, need realization of the national identity policy, which should be implemented in all areas of civil, social and cultural life.The aim of the research is to study the figure of Mykola Lysenko in the context of identity issues. To achieve this, the following objectives have to be addressed: discover and process the necessary reference database; to identify manifestations of various identity types in the life and creative activity of Mykola Lysenko and their influence on the further development of the Ukrainian choral art.Mykola Lysenko spent his childhood in the Hrynky village, Kremenchug district in Poltava region. And then in his childhood, when he was living close to the people and perceiving their traditions, the seed of his national consciousness was planted. Over the time the seed was shaped into a national vocation, as it is well known, that self, i.e. self-identity, cannot be formed without the influence of an external factor. Since 1860 M. Drahomanov, T. Rylsky, V. Antonovich and many others pro-Ukrainian students of St. Volodymyr Kyiv University played a key role in the formation of M. Lysenko.The national and cultural identity of M. Lysenko is emphasized by the inseparability of his composing, performing and conducting activities from the national folklore and poetry.In the nineteenth century there was a form of class identity, thus aristocracy and common people were separated from each other. Classes gave rise to limitations as the folk culture could only partially penetrate into the higher circles due to its "commonality". At the same time by limiting its "high culture" the aristocracy was defending their own interests. The fact that M. Lysenko came from a "higher" class gave him the opportunity to present the folk art in a professional way which "suited" aristocratic taste. That was one of the key elements of Lysenko's influence on the development of the Ukrainian music as by his creative work he began to unite different class groups demonstrating their affiliation to the same culture.Despite the existence of the Ukrainian people, from the point of view of the official Russian Empire policy of the nineteenth century, Ukraine as such did not exist. Ukrainian language and national culture were outlawed. Persistent and long-term work of M. Lysenko on folklore and its presentation at the concert venue brings the master in the limelight of national identity. Practical significance of Lysenko's folklore works is unification of Ukrainians around the national idea, and his conductor-choral activity became a tool of this union.His creativity, which demonstrated his clear national identity, M. Lysenko spread throughout Ukraine. His trips with choruses to Ukrainian cities not only initiated concert tours as such, but put the Ukrainian song in his adaptation on the unprecedented pedestal. M. Lysenko's merit as a conductor is that he was rather demanding and strict and that way he taught and showed how to perform a Ukrainian song, always treating seriously the performance of musical works.It is difficult to imagine the Ukrainian music culture of the second half of the nineteenth and early twentieth centuries without M. Lysenko as a musician and luminary. Almost every family that had a piano at that time also had his "collections". And the songs from his "forties" and "dozens" were performed by many amateur choirs.We cannot fully understand a historical figure of M. Lysenko in the context of identity issues without considering the political tension of that period. Therefore the author tries to outline the features of the master, whose impact on the art is huge and undeniable, by emphasizing some historical facts in his biography. While analyzing Lysenko's activity, the article defines and outlines features of cultural and national identity and self-identity displayed by the master through his creative life. The conclusion has been drawn that the figure of Mykola Lysenko is a synthesis of various components of identity and cannot be reduced to one of them due to the scale and integrative type of master's talent. The significance of this study lies in the fact that it takes a new look at M. Lysenko who is intertwiningly connected with the formation of Ukrainian identity as a whole. This modern factor is decisive in the development of country's own socio-cultural and civilizational autonomy Studies of the national, cultural and self-identity of Ukrainian conductors create the basis for shaping the policy of the Ukrainian nation in the field of culture. The further development of this study is intended to consolidate the society around the acute ideas and principles of national self-affirmation on the basis of common national interests. In this way, reliable foundations are laid for awareness of the common national identity.

ABSTRACT The present investigation investigated the violation of the right to the truth that all victims of crimes against humanity have on the part of violent and inhuman acts committed by States or by individuals, that is, the violation of the right to the truth as a rule international imperative for crimes against humanity, which constitute the preservation and respect of humanity itself, as well as peace and international security, by the State or by individuals. In this sense, it is clear that the investigation was carried out with the purpose that the right to the truth be incorporated into the Peruvian Political Constitution through its article 3 but with the precision as an international mandatory norm and that the States will be criminal and civil responsibility for not carrying out an adequate investigation to determine the true perpetrators and the acts carried out in the affectation of human rights in crimes against humanity. In the present investigative work, information was gathered consisting of knowing the opinion provided by the legal operators conformed by Judges, Prosecutors and Jurists of the Judicial District of San Martín through the application of an innominated survey on the affectation of the right to truth of the victims of crimes against humanity committed by the State or by individuals, as well as information was collected from the specialized libraries of different universities and personal library of the author, especially on the cases of Barrios Altos and Cantuta that constitute the emblematic cases in which the right to truth was affected by the Peruvian State. The results of the investigation showed that the dominant position of the surveyed population considers that the States have the maximum obligation to deepen investigations based on the right to the truth to discover and punish those guilty of crimes against humanity and that for such non-compliance they must assume their responsibility, which must be regulated in the national order, being necessary that in consideration of the IUS COGENS that protects interests that surpass the individual interests of the States, it regulates the Right to the truth of the victims of crimes of lesa humanity as a fundamental right through Article 3 of the Constitution. Finally, it is concluded that the right to the truth be incorporated as a fundamental right in the National Political Charter for the violent and inhuman acts produced by the Peruvian State as well as recognition as an international mandatory norm and determination of the degree of responsibility of the State for inhuman acts against the victims of the crimes of. ; RESUMEN La presente investigación investigó la vulneración del derecho a la verdad que tienen todas las personas víctimas de los delitos de lesa humanidad por parte de los actos violentos e inhumanos cometidos por los Estados o por particulares, es decir la afectación del derecho a la verdad como norma imperativa de carácter internacional por delitos de lesa humanidad, los mismos que constituyen la preservación y respeto de la humanidad misma, así como la paz y la seguridad internacional, por parte del Estado o por particulares. En ese sentido, se desprende que la investigación se realizó con el propósito de que el derecho a la verdad sea incorporado a la Constitución Política peruana a través de su artículo 3° pero con la precisión como norma imperativa de carácter internacional y que los Estados serán responsables penal y civilmente por no efectuar una investigación adecuada que permita determinar los verdaderos responsables y los actos llevados a cabo en la afectación de derechos humanos en los delitos de lesa humanidad. En el presente trabajo investigativo se recopiló información consistente en conocer la opinión proporcionada por parte de los operadores del derecho conformados por Jueces, Fiscales y Juristas del Distrito Judicial de San Martín a través de la aplicación de una encuesta innominada sobre la afectación del derecho a la verdad de las víctimas de los delitos de lesa humanidad cometido por el Estado o por particulares, así también se recopiló información de las bibliotecas especializadas de distintas universidades y biblioteca personal de la autora, especialmente sobre los casos de Barrios Altos y la Cantuta que constituyen los casos emblemáticos en las que se afectó el derecho a la verdad por parte del Estado Peruano. Los resultados de la investigación mostraron que la posición dominante de la población encuestada considera que los Estados tienen la máxima obligación de profundizar las investigaciones en base al derecho a la verdad para descubrir y sancionar a los culpables de delitos de lesa humanidad y que por dicho incumplimiento deben asumir su responsabilidad, las cuales deben estar reguladas en el ordenamiento nacional, siendo necesario que en consideración del IUS COGENS que protege intereses que superan a los intereses individuales de los Estados, se regule el Derecho a la verdad de las víctimas de delitos de lesa humanidad como derecho fundamental a través del artículo 3º de la Carta Magna. Finalmente, se concluye porque se incorpore el derecho a la verdad como un derecho fundamental en la Carta Política nacional por los actos violentos e inhumanos producidos por el Estado Peruano así como también un reconocimiento como norma imperativa de carácter internacional y la determinación del grado de responsabilidad del Estado por los actos inhumanos contra las víctimas de los delitos de lesa humanidad cometidos por un Estado o por actos de terceros. ; Tesis

Autonomous vehicles (AVs), also called driverless vehicles, according to SAE International (2016) levels 4 and 5 definitions, are the next revolution in transport. This thesis provides an overview of the technology and the effects of AVs on the future transport system. It results in recommendations on how to maximize the benefits of AVs while minimizing their negative effects. It consolidates work by the author and collaborators done over the past years and therefore approaches the topic from different angles. This work thus not only provides a solid background on the topic for interested readers, but also recommendations relevant for future political discussions and practice. The first part of this thesis (Chapter 2) provides a general and qualitative overview of AVs. It investigates their effects on and potential benefits for the future transport system. This summary covers most aspects that have been topic of discussions on AVs in recent time. It presents the potential benefits of AVs, which are, for example, improved safety, fewer externalities, increased road capacity, productive drive time, and the potential for empty rides, which allow for new services and usage-patterns. But it also shows the remaining challenges for a successful release of the technology, which are, for example, technological problems, safety and security issues, data and privacy questions, as well as ethical and legal discussions. The second part (Chapter 3) approaches the topic from an economic point of view. It focuses on the future cost structure of a transport system with AVs. In a rigorous bottom-up approach, the cost and price of private, shared, and public modes are calculated. The resulting picture indicates that the reign of the private car might not yet end with the automation of transport. Shared AVs (SAVs) will likely be cheaper per passenger kilometer (PKM) and more comfortable to use. But the price difference (urban setting: private car 0.47 Swiss francs (CHF) per PKM versus SAV 0.43 CHF/PKM) might not be enough to offset the luxury of having a private mobility robot at one's service at all times, the emotional connection to the private car, and its use as an extended part of home. The presented work also indicates that automation represents a challenge for mass transit. In dense urban cores, the limited road capacity will likely prevent alternative solutions to mass transit. Outside, where road capacity is less of an issue, however, SAVs will be a competitive alternative form of public transport. At lower prices (regional setting: SAV 0.34 CHF/PKM versus autonomous bus 0.42 CHF/PKM), SAVs enable direct on-demand door-to-door service without transfers and without strangers in the same vehicle. The third part (Chapter 4 to Chapter 7) combines the qualitative overview with the economic analysis in a simulation study of the future transport system. With a scenario-based approach using a MATSim (Horni et al., 2016) simulation of Zug, Switzerland, it approaches the topic from a policy-oriented angle. By analyzing different possible policy strategies in different scenarios and combined with the results of the previous chapters, it concludes in four policy suggestions to maximize the potential benefits of AVs and minimize their negative effects. These recommendations are, first, to promote slow modes and public transport. At least in urban areas, harvesting automation for improving mass transit and thus a strengthening of these low-externality modes is a way to benefit sustainably from AVs. Second, an introduction of mobility pricing should be considered to control growth of traffic and to replace traffic control instruments lost to automation (like parking). Induced demand and empty rides of private and shared AVs have the potential to lead to another explosion of traffic, which should be controlled for the benefit of everyone. The third recommendation is the controlled support of automation of private transport. AVs are safer and produce less externalities than conventional vehicles, and they allow the users to be productive while on the road. These are substantial benefits for society, which should be harvested as soon as technologically possible. The fourth suggestion is, for SAVs, to actively favor dynamic ride-sharing (automated ride-sharing, aRS) over exclusive-access taxi services (automated taxis, aTaxis). Both the users and the suppliers have strong incentives for aTaxis, which might be only slightly more expensive to operate than aRS services (urban setting: aRS 0.29 CHF/PKM versus aTaxi 0.41 CHF/PKM). From a society and transport system perspective, however, aTaxis produce substantial additional traffic on each passenger trip compared to private vehicles (estimated +8% (Fagnant et al., 2015) to +15% (Bösch et al., 2016a) for passenger pick-ups alone, without redistribution, for example), represent challenges for the infrastructure (pick-up solutions at mobility hubs, such as city centers, train stations, or airports), and draw substantial modal shares from slow modes (here -7.5%) and mass-transit public transport (here -6.7%). Effects which can be minimized or even turned into savings by using SAV as aRS services. Ride-sharing (or - in its high-volume form - mass transit) is one of the very few ways how an increasing travel demand can be served with decreasing vehicle kilometers. These recommendations might be general and have to be analyzed in more detail for a particular city or area, but they represent an indication of the upcoming challenge for society to integrate AVs and negotiate the future transport system.

WOS: 000452318400028 ; A measurement of off-shell Higgs boson production in the ZZ -> 4l and ZZ -> 2l2v decay channels, where stands for either an electron or a muon, is performed using data from proton-proton collisions at a centre-of-mass energy of root s = 13 TeV. The data were collected by the ATLAS experiment in 2015 and 2016 at the Large Hadron Collider, and they correspond to an integrated luminosity of 36.1 fb(-1). An observed (expected) upper limit on the off-shell Higgs signal strength, defined as the event yield normalised to the Standard Model prediction, of 3.8 (3.4) is obtained at 95% confidence level (CL). Assuming the ratio of the Higgs boson couplings to the Standard Model predictions is independent of the momentum transfer of the Higgs production mechanism considered in the analysis, a combination with the on-shell signal-strength measurements yields an observed (expected) 95% CL upper limit on the Higgs boson total width of 14.4 (15.2) MeV. WOS: 000432187800078 ; The production of a top quark in association with a Z boson is investigated. The proton-proton collision data collected by the ATLAS experiment at the LHC in 2015 and 2016 at a centre-of-mass energy of root s = 13 TeV are used, corresponding to an integrated luminosity of 36.1 fb(-1). Events containing three identified leptons (electrons and/or muons) and two jets, one of which is identified as a b-quark jet are selected. The major backgrounds are diboson, tt($)over-bar and Z + jets production. A neural network is used to improve the background rejection and extract the signal. The resulting significance is 4.2 sigma in the data and the expected significance is 5.4 sigma. The measured cross-section for tZq production is 600 +/- 170(stat.)+/- 140(syst.)fb. Purpose. Analyzed different approaches to the defi nition of hypertext, and highlights the main stages in the development of hypertext technology. In order for the task to be performed, it is necessary to use electronic data processing, standardization of logistics, organization of work should be based on multifunctional analysis and structuring. In addition, it is necessary to use new technologies that facilitate automation of operations. The urgency of the problems associated with the formation of the global information economy plays an important role, as modern organizations need a qualitatively new economic resource that will contribute to sustainable growth. Information economy differs from all previous types of economy by the fact that the most important productive resource here is not physical good, but something elusive - information. The most important importance in the information economy becomes the task of managing information resources at different levels of the hierarchy. Solving this problem allows information logistics to systematize a set of measures aimed at managing the production of information, its movement and marketing with minimal cost. In the article the main concepts of information logistics, peculiarities of construction and functioning of the information system that provide the functioning of processes are considered. Since the information logistics system is a complex integrated system that organizes the accounting, control, planning, procurement, supply, distribution of material and technical resources, then the article considers the main features of logistics systems. Achieving logistics goals requires continuous monitoring and management of information flows. It is emphasized on the need to take into account the space-time relationships between logistic data. To account for all these conditions, integrated integrated information systems must be applied. The author provides practically gained experience in an international company – an effective approach in the use of risk assessment methods.One of the most problematic places is the choice of the method of assessing the organization's risks. The method is in primarily in the compatibility of the mission and the objectives of the organization, and a number of tasks with the selected methods of risk assessment. For a quantitative method of risk assessment, it is the availability of correctly calculated norms, according to which a risk analysis will be carried out. For a qualitative method of risk assessment, it is the availability of qualified experts with sufficient experience in the field of risk assessment. For a mixed method of risk assessment, it is compliance with the balance and appropriateness of use between a quantitative and qualitative method of risk assessment.In accordance with the selected types of economic activity, organizations that require strict compliance with production standards, legislation, licensing, etc., it is advisable to use quantitative methods of risk assessment. As an example, the risks associated with violation of the norms: the rates of environmental tax for emissions of pollutants into the air, stationary sources of pollution; disposal of hazardous waste; control over water use and discharges of enterprises.A mandatory creation of a risk map for each organization is proposed. Як приклад, ризики пов'язані з порушенням норм: ставки екологічного податку за викидів в атмосферне повітря забруднюючих речовин, стаціонарними джерелами забруднення; утилізації небезпечних відходів; контролю за використанням води та скидами підприємств.Запропоновано обов'язкове створення мапи ризиків для кожної організації. Це пов'язано з тим, що всі ризики повинні бути структуровані та досліджені, а також по кожному з ризиків має бути обрано метод реагування на ризик. Мапа ризиків має ряд особливостей та важливе призначення в структурі корпоративного управління, зокрема це:матриця ризиків, або візуалізація для топ керівництва організації;таблиця ризиків, або робочий інструмент для управління ризиками.Оцінка ризиків у будь-якій сфері є дуже важливою. Завдяки цьому компанія, яка інвестує в удосконалення системи внутрішнього контролю (СВК), в підтримку СВК на заданому рівні у подальшому отримує ефекти у вигляді заощаджених коштів, відсутності штрафів, захист від корупції. Як приклад, захист від корупції забезпечує своєчасне виявлення ризиків – червоних прапорців, які вказують на можливі маніпуляції.

Стаття присвячена аналізу "конкурентної політики держави" та правових засобів і форм її реалізації. Проаналізовано статті та дисертаційні дослідження вчених економістів і правників з приводу конкурентної політики держави, та наголошено на необхідності перегляду законодавчого забезпечення питань реалізації конкурентної політики.Основною метою і спрямуванням економічної політики держави є реалізація та оптимальне узгодження інтересів суб'єктів господарювання і споживачів, на основі поєднання приватних і публічних інтересів завдяки методам стимулювання конкуренції. Не менш важливою метою є зростання ефективної соціально-орієнтованої економіки ринкового типу на основі подолання монополізму та олігархізму.З цього приводу автор наголошує на необхідності перегляду діючого законодавства та впровадженню дієвих норм, першочерговими завданнями яких буде розроблення як програмних документів так і стратегії розвитку конкуренції на ринку. Важливим моментом є подолання монополізованих та олігопольних ринків в багатьох галузях, забезпечення рівних можливостей вступу на ринок всіх суб'єктів господарювання та зняття бар'єрів вступу на ринок, в тому числі і адміністративних.Конкурентна політика держави має інструментальний характер та її ефективність пропорційно залежить від виконуваних функцій, направлених на досягнення практичних результатів – підтримання умов конкурентності в господарській діяльності, підтримання стану конкуренції в певних галузях економіки, попередження антиконкурентних дій тощо. Механізми конкурентної політики держави реалізуються правовим засобам через діяльності антимонопольних органів, основним завданням яких є попередження і припинення порушень антимонопольного регулювання, стимулювання конкуренціїї та захист економічної конкуренції від різного роду проявів недобросовісних методів конкурентної боротьби. Все це може бути реалізоване лише завдяки застосуванню дієвих методів впливу, застосуванню відповідальності за ці правопорушення з боку антимонопольних органів поряд із запровадженням стимулюючих методів розвитку конкуренції.Особливої уваги потребує і перегляд системи санкцій та механізму застосування відповідальності за конкурентні правопорушення. Методика визначення штрафів не завжди є адекватною, порівняно із шкодою, завданою правопорушеннями. Первоочередным заданием в этом смысле является также анализ состава правонарушений и ввод процессуальных норм конкурентного законодавтсва ; The article is devoted to the "competitive policy of the state" and legal means and forms of its realization. There were analyzed articles and dissertation studies of scientists-economists and lawyers as to the competitive policy of the state and noted a necessity to revise the legislative support of questions of competitive policy realization.The main aim and direction of the competitive policy of the state is realization and optimal coordination of interests of economy and consumers, based on combining private and public interests due to methods of stimulating competition. The no less important aim is the growth of the effective socially-oriented economy of the market type, based on overcoming monopolism and oligarchism.On the occasion the author notes a necessity to revise the existent legislation and introduce effective norms, which first-turn aims will be elaboration of both program documents and development strategy at the market. The important moment is overcoming monopolized and oligopolistic markets in many fields, provision of equal possibilities of entrance to the market for all economic subjects and elimination of barriers, including administrative ones.The competitive policy of the state has the instrumental character and its efficiency proportionally depends on realized functions, directed on attaining practical results – maintaining competitive conditions of economic activity, in certain branches of economy, prevention of anti-competitive actions and so on. Mechanisms of the competitive policy of the state are realized by legal means through the activity of antimonopoly bodies, which main task is prevention and stop of violations of antimonopoly regulation, stimulation of competition and protection of economic competition from different kinds of dishonest methods of competitive fight. This all can be realized only by applying effective methods, amenability for these violations from antimonopoly organs together with introducing stimulating methods of competition development. The special attention is needed also by the revision of the system of sanctions and mechanism of applying amenability for competitive offences. The method of determining fines is not always adequate, comparing with the harm, caused by offences. The first-turn task in this sense is also the compositional analysis of offences and introduction of procedural norms of the competitive legislation

У статті досліджено диригентську діяльність М. Лисенка у контексті проблем ідентичності. Акцентуючи увагу на деяких історичних фактах з біографії митця, окреслено риси, характерні для класика української музики, чий вплив на мистецтво є масштабним та незаперечним. Охарактеризовано національно-культурну ідентичність М. Лисенка, що підкреслено нерозривністю його композиторської, виконавської та диригентської діяльності з національним фольклором і поезією. У контексті проблем ідентичності проаналізовано творчу діяльність М. Лисенка та визначено основні характерні ознаки культурної і національної ідентичності, а також самоідентичності, які він проявляв упродовж творчого життя. Зроблено висновок, що постать М. Лисенка є синтезом різних компонентів ідентичності і не може бути зведена до котроїсь із них через масштабність та інтегративний тип таланту митця. ; Starting from the second half of the twentieth century the concept of identity has become a universal explanatory paradigm, a universal tool for research. Linguistic and cultural divisions, "split" society, which is unfortunately Ukraine today, need realization of the national identity policy, which should be implemented in all areas of civil, social and cultural life.The aim of the research is to study the figure of Mykola Lysenko in the context of identity issues. To achieve this, the following objectives have to be addressed: discover and process the necessary reference database; to identify manifestations of various identity types in the life and creative activity of Mykola Lysenko and their influence on the further development of the Ukrainian choral art.Mykola Lysenko spent his childhood in the Hrynky village, Kremenchug district in Poltava region. And then in his childhood, when he was living close to the people and perceiving their traditions, the seed of his national consciousness was planted. Over the time the seed was shaped into a national vocation, as it is well known, that self, i.e. self-identity, cannot be formed without the influence of an external factor. Since 1860 M. Drahomanov, T. Rylsky, V. Antonovich and many others pro-Ukrainian students of St. Volodymyr Kyiv University played a key role in the formation of M. Lysenko.The national and cultural identity of M. Lysenko is emphasized by the inseparability of his composing, performing and conducting activities from the national folklore and poetry.In the nineteenth century there was a form of class identity, thus aristocracy and common people were separated from each other. Classes gave rise to limitations as the folk culture could only partially penetrate into the higher circles due to its "commonality". At the same time by limiting its "high culture" the aristocracy was defending their own interests. The fact that M. Lysenko came from a "higher" class gave him the opportunity to present the folk art in a professional way which "suited" aristocratic taste. That was one of the key elements of Lysenko's influence on the development of the Ukrainian music as by his creative work he began to unite different class groups demonstrating their affiliation to the same culture.Despite the existence of the Ukrainian people, from the point of view of the official Russian Empire policy of the nineteenth century, Ukraine as such did not exist. Ukrainian language and national culture were outlawed. Persistent and long-term work of M. Lysenko on folklore and its presentation at the concert venue brings the master in the limelight of national identity. Practical significance of Lysenko's folklore works is unification of Ukrainians around the national idea, and his conductor-choral activity became a tool of this union.His creativity, which demonstrated his clear national identity, M. Lysenko spread throughout Ukraine. His trips with choruses to Ukrainian cities not only initiated concert tours as such, but put the Ukrainian song in his adaptation on the unprecedented pedestal. M. Lysenko's merit as a conductor is that he was rather demanding and strict and that way he taught and showed how to perform a Ukrainian song, always treating seriously the performance of musical works.It is difficult to imagine the Ukrainian music culture of the second half of the nineteenth and early twentieth centuries without M. Lysenko as a musician and luminary. Almost every family that had a piano at that time also had his "collections". And the songs from his "forties" and "dozens" were performed by many amateur choirs.We cannot fully understand a historical figure of M. Lysenko in the context of identity issues without considering the political tension of that period. Therefore the author tries to outline the features of the master, whose impact on the art is huge and undeniable, by emphasizing some historical facts in his biography. While analyzing Lysenko's activity, the article defines and outlines features of cultural and national identity and self-identity displayed by the master through his creative life. The conclusion has been drawn that the figure of Mykola Lysenko is a synthesis of various components of identity and cannot be reduced to one of them due to the scale and integrative type of master's talent. The significance of this study lies in the fact that it takes a new look at M. Lysenko who is intertwiningly connected with the formation of Ukrainian identity as a whole. This modern factor is decisive in the development of country's own socio-cultural and civilizational autonomy Studies of the national, cultural and self-identity of Ukrainian conductors create the basis for shaping the policy of the Ukrainian nation in the field of culture. The further development of this study is intended to consolidate the society around the acute ideas and principles of national self-affirmation on the basis of common national interests. In this way, reliable foundations are laid for awareness of the common national identity.

In conditions of the development of a postmodern state and the formation of a new type of economy, the formation of a state employment policy aimed at ensuring the creation of conditions for rational employment of the population plays a strategic role. This is directly because the social policy of the state, which is employment of the population in the center of, has a refrain to ensure stable livelihoods of society, the adoption of dynamic indicators of minimizing unemployment and achieving a balanced welfare. In view of this, the expediency of a comprehensive solution of problems of employment of the population is articulated.An analysis of recent research and publications where the solution of this problem was initiated and which the author relies on. In the context of the analysis of the methodology for the formation of public policy in the field of employment, destabilization of the main research approaches deserves special attention.Recent research and publications analysis. In today's conditions of social development, the state should retain coordinating and regulating functions in order to ensure the proper functioning of the sphere of employment of the population and overcoming unemployment. Such context prompts the state to abandon centralized management in order to form a new modern system of employment regulation, which main technological units would be the development of relevant laws, programs for stimulating employment, the conclusion of appropriate agreements between the parties of the social partnership concerning the formation of social and labor relations at national and regional levels. Namely the subjects of social and labor relations that must determine the structure and basic directions of employment of the population, the methodology of training of labor potential and increase its competitiveness in the domestic and global labor markets. In such a system of relations, the state acquires a strategic and technological status - ensuring coordination of social and labor relations between the relevant actors in the sphere of employment and creating the appropriate framework conditions for the effectiveness of the establishment and stability of the functioning of such relations.Highlighting previously unsettled parts of the general problems. The paper objective is to carry out a theoretical and methodological analysis of the formation of public policy in the field of employment of the population.Paper main body. The main object of the state policy in the field of employment is the regulation of relations, which foresees the formation of social partnership between its subjects functions structurally are divided according to the principle: 1) states (the highest authority); 2) enterprises (employers); 3) trade unions. Each of these subjects has its own functional toolkit.Measures for ensuring employment: investment and tax measures aimed at the efficient allocation of productive forces, increased labor mobility, entrepreneurship promotion, the creation of new technologies, new small enterprises, the application of flexible labor regimes (reduction of working hours, work at home, etc.) which contribute to the preservation and development of the system of workplaces; ensuring the rights and interests of employees through the improvement of legislation concerning employment of the population and labor, creation of favorable conditions at work; conducting analytical and scientific researches of the economic structure and forecasting changes in the quality and distribution of labor force; regulation of foreign economic activity in terms of attracting and using foreign labor force on the basis of quotation and licensing, as well as providing their citizens with the right to work abroad; assistance (on behalf of enterprises, institutions and organizations of all forms of ownership) if necessary, creation of additional workplaces, as well as improvement of working conditions in social production.Conclusions of the research and prospects for further studies. Thus, our analysis of the state policy in the field of employment made it possible to clearly identify the structural and functional role of the state in the field of formation and implementation of social and labor relations, on their basis the main objectives, elements, structural levels and a set of measures of state policy in the field of employment are classified, the main functions of social partnership parties are systematized, which ensure implementation of appropriate measures to ensure employment policy, the main technologies of implementation of such kind of policies are presented, taking into account national peculiarities and corresponding indicators of economic development of the state, its infrastructure is defined which provides a stable dynamic balance in the labor market, which directly influences the effectiveness of the state policy in the relevant sphere. On this basis, the toolkit for regulation and forecasting of the labor market was elaborated, which foresees the introduction of forms and methods for managing the employment of the population system and regulating labor relations, which serves to reduce unemployment rates and increase the rates of active employment among different demographic groups. This aspect lays the prospects for further development of this issue in the context of modern research approaches within the field of knowledge of public administration.

PubMed: 30608764 ; 2-s2.0-85059112614 ; Measurements of fragmentation functions for jets associated with an isolated photon are presented for the first time in pp and Pb-Pb collisions. The analysis uses data collected with the CMS detector at the CERN LHC at a nucleon-nucleon center-of-mass energy of 5.02 TeV. Fragmentation functions are obtained for jets with pTjet>30 GeV/c in events containing an isolated photon with pT?>60 GeV/c, using charged tracks with transverse momentum pTtrk>1 GeV/c in a cone around the jet axis. The association with an isolated photon constrains the initial pT and azimuthal angle of the parton whose shower produced the jet. For central Pb-Pb collisions, modifications of the jet fragmentation functions are observed when compared to those measured in pp collisions, while no significant differences are found in the 50% most peripheral collisions. Jets in central Pb-Pb events show an excess (depletion) of low (high) pT particles, with a transition around 3 GeV/c. This measurement shows for the first time the in-medium shower modifications of partons (quark dominated) with well-defined initial kinematics. It constitutes a new well-controlled reference for testing theoretical models of the parton passage through the quark-gluon plasma. © 2018 CERN, for the CMS Collaboration. 2-s2.0-85047658971 ; A search is presented for the decays of heavy exotic long-lived particles (LLPs) that are produced in proton-proton collisions at a center-of-mass energy of 13 TeV at the CERN LHC and come to rest in the CMS detector. Their decays would be visible during periods of time well separated from proton-proton collisions. Two decay scenarios of stopped LLPs are explored: a hadronic decay detected in the calorimeter and a decay into muons detected in the muon system. The calorimeter (muon) search covers a period of sensitivity totaling 721 (744) hours in 38.6 (39.0) fb?1 of data collected by the CMS detector in 2015 and 2016. The results are interpreted in several scenarios that predict LLPs. Production cross section limits are set as a function of the mean proper lifetime and the mass of the LLPs, for lifetimes between 100 ns and 10 days. У статті висвітлено питання виникнення та розвитку телефонного сполучення в українських губерніях Російської імперії в модерний період. Звертається увага на чинники, які посприяли появі наприкінці ХІХ ст. перших телефонних мереж у таких великих містах як Одеса, Київ, Харків тощо. Підкреслено, що до початку ХХ ст. телефонні станції вже запрацювали в 23 губернських та повітових містах українських земель. В наведеному матеріалі охарактеризовано особливості функціонування як урядових, так і приватних телефонних мереж. При цьому звернуто увагу, що кількість телефонних апаратів, особливо в урядових установах, постійно зростала. Автор також зупиняється на питаннях доступності телефону для городян модерної доби, в тому числі з'ясовує вартість користування його послугами, зручність зв'язку тощо. Наголошується, що перш за все телефоном тоді користувалися підприємці, великі торговці, фінансисти, юристи, лікарі, представники правоохоронних структур, діячі органів місцевого самоврядування. Крім того, в статті проаналізовано особливості праці службовців телефонних станцій, зокрема телефоністок. Зазначено, що їх робота була доволі складною, а платня, яку вони отримували, становила в цілому невеликі суми. Звернуто увагу й на певні проблеми в діяльності телефонних мереж в українських землях імперії Романових – технічні недоліки у царині зв'язку, мала місткість телефонних станцій, висока вартість платні за телефонні послуги тощо. Відповідно, на кожні 100 мешканців царської Росії (станом на 1909 р.) припадало лише 0,1 абонента телефонної мережі. Тоді як, наприклад, у Сполучених Штатах Америки на кожні 100 мешканців припадало 7,6 власників телефонів. Утім підкреслено, що телефон тоді все ж став важливою ознакою становлення в Україні зародків нового, індустріального суспільства. Адже в українському місті кінця ХІХ – початку ХХ ст. можна було спостерігати стрімкий розвиток техніки зв'язку та його проникнення в усі сфери життя тогочасного соціуму. Під впливом телефонного сполучення радикально трансформувалося повсякдення людей, їх побут. ; The article covers the emergence and development of telecommunication in the Ukrainian provinces of the Russian Empire in the modern period. Attention is drawn to the factors that contributed to the emergence in the late nineteenth century. the first telephone networks in such large cities as Odessa, Kiev, Kharkov, etc. It was emphasized that by the beginning of the twentieth century. telephone exchanges have already started working in 23 provincial and county cities of Ukrainian lands. This article describes the features of functioning of both government and private telephone networks. At the same time, attention was paid to the fact that the number of telephone sets, especially in government institutions, was constantly increasing. The author also dwells on questions of the availability of the phone for the modern city dwellers, including finding out the cost of using his services, the convenience of communication, etc. It is noted that first of all the phone was used by entrepreneurs, large traders, financiers, lawyers, doctors, law enforcement officials, and officials of local self-government bodies. In addition, the article analyzes the peculiarities of the work of the employees of telephone stations, in particular telephone operators. It was noted that their work was rather difficult, and the salary they received was generally small amounts. The attention was also paid to certain problems in the activity of telephone networks in the Ukrainian lands of the Romanov empire - technical deficiencies in the area of communication, small capacity of telephone stations, high cost of payment for telephone services, etc. Accordingly, for every 100 inhabitants of tsarist Russia (as of 1909) there were only 0.1 subscribers of the telephone network. For example, in the United States, for every 100 inhabitants, 7.6 phone holders accounted for. However, it was emphasized that the phone, however, became an important sign of the emergence in Ukraine of the new, industrialized society. After all, in the Ukrainian city of the late nineteenth and early twentieth centuries. it was possible to observe the rapid development of communication technology and its penetration into all spheres of life of the contemporary society. Under the influence of telephone communication, the everyday life of people, their way of life was radically transformed. ; В статье освещены вопросы возникновения и развития телефонного сообщение в украинских губерниях Российской империи в модернный период. Обращается внимание на факторы, которые способствовали появлению в конце XIX в. первых телефонных сетей в таких крупных городах как Одесса, Киев, Харьков и др. Подчеркнуто, что к началу ХХ в. телефонные станции уже заработали в 23 губернских и уездных городах украинских земель. В приведенном материале охарактеризованы особенности функционирования как правительственных, так и частных телефонных сетей. При этом обращено внимание, что количество телефонных аппаратов, особенно в правительственных учреждениях, постоянно росло. Автор также останавливается на вопросах доступности телефона для горожан современной эпохи, в том числе выясняет стоимость пользования его услугами, удобство связи и тому подобное. Отмечается, что прежде всего телефоном тогда пользовались предприниматели, крупные торговцы, финансисты, юристы, врачи, представители правоохранительных структур, деятели органов местного самоуправления. Кроме того, в статье анализируются особенности труда служащих телефонных станций, в частности телефонисток. Отмечено, что их работа была довольно сложной, а плата, которую они получали, составляла в целом небольшие суммы. Обращено внимание и на определенные проблемы в деятельности телефонных сетей в украинских землях империи Романовых - технические недостатки в области связи, малая емкость телефонных станций, высокая стоимость платы за телефонные услуги и тому подобное. Соответственно, на каждые 100 жителей царской России (по состоянию на 1909) приходилось лишь 0,1 абонента телефонной сети. Тогда как, например, в Соединенных Штатах Америки на каждые 100 жителей приходилось 7,6 владельцев телефонов. Впрочем подчеркнуто, что телефон тогда все же стал важным признаком становления в Украине зародышей нового, индустриального общества. Ведь в украинском городе конца XIX - начала ХХ в. можно было наблюдать стремительное развитие техники связи и его проникновение во все сферы жизни тогдашнего социума. Под влиянием телефонного сообщения радикально трансформировалось повседневности людей, их быт.

Alex De Waal's new book, Mass Starvation: The History and Future of Famine, cannot be assessed as an enjoyable read; instead it is a book that will (and should) leave the reader unsettled, concerned and angry.". we have come full circle, back to where we were before the invention of "Famine", in which we understand famines as desperate societal crises, including hunger and other forms of distress, that threaten a way of life, created by the powerful, resisted and mediated by human skills and societal structures." (De Waal 2018 p52)The author presents a well-researched account of famines, over the last two centuries and uses his research and experience, to reflect on the future of famines. His presentation of famines begins with "the year without a summer" (De Waal pg. 54), the 1816 famine caused by crop failure, due to the eruption of a volcano, in Indonesia. This was the last famine, De Waal reflects, that was caused by an act of nature. He then moves onto act one of a 'tragedy in five acts", which refers to the Imperial Holocausts from 1870 until 1914. These are famines caused by colonial settlers, using hunger to subjugate indigenous populations. Although he begins his reflections in 1870, he notes correctly that such famines have occurred down through the ages. However reliable data does not exist in relation to numbers affected prior to this time. Act two brings the merging of the two world wars into one extended world war from 1915 – 1950. He presents this period as the worst for famine deaths in modern history, where forced starvation was used a means of extermination or tolerated for military gains. Act three, 1950-1985, reveals one of the worst famines in history, when Mao Zedong's 'Great Leap Forward' resulted in 25-30 million famine deaths between 1958 and 62. The smaller famines related to wars from 1960s onwards is set out in act four, occurring largely in war torn countries of Sub Saharan Africa.The book catalogues all recorded calamitous and great famines since 1870, estimating that over 103 million people have lost their lives through famines in this time span. Of these deaths, 77 million occurred during war or periods of political repression. He demonstrates that between 1870 and 1970 an average of about 1 million lives were lost every year due to famine. However, fewer deaths are being lost since then due to increasingly professional humanitarian responses and improvements in health care and prevention strategies, such as routine immunisation programmes—a fact that many aid agencies and donors would like global media to take more notice of. One may begin to feel relief at such progress being presented, only to have such hope dispelled by De Waal's increasing concern on the recent increased use of hunger as a political tool. De Waal (pg. 172) summarises the basic thesis of his book as ".better politics have led to fewer famines" and better general health services have reduced the deaths caused as a result of continuing famines. Over half of all famine deaths since 1870 were actually Chinese citizens. Setting out famines in this way challenges common lay perceptions of famine deaths occurring only in Sub Saharan Africa due to a simple, ongoing lack of food. De Waal's evidenced-based approach towards Malthusian population principles is refreshing, in a world where such perceptions continue to be cited by many academic scholars and political parties as a reason to justify limiting population size and curbing migration flows. De Waal presents evidence to show that rising population levels have not resulted World Nutrition 2018;9(1)71in more famine and deaths. However, he does not seek to paint a happy ending, he challenges the global complacency which allows hunger to co-exist in a world with enough food for all. De Waal waits until chapter ten to discuss act five, "the new atrocity famines". He seeks to answer the question: are we seeing "the resurgence of great famines?" (pg. 179). Chapter ten begins with the fact that in 2017 there was 70 million people in acute need of aid, an increase from 45 million in 2015. He goes on to state that there were twenty million people, in four countries (Nigeria, Somalia, Sudan and Yemen), facing the risk of famine. The people in these countries are suffering from hunger due to political decisions and conflict, not a shortage of food--a failure of political leaders to implement international laws. In act four De Waal presents the good news that famines and the deaths they led to had dramatically reduced, being localised to SSA. However, the most dramatic food shortages, due to conflict, in this decade, have occurred in the Middle East. With countries like Syria denying food and aid to its citizens as a weapon of war, while 51% of the citizens in Yemen are in urgent need of assistance that is not reaching them. Due to the role of politics in present day famines, De Waal calls for forced starvation to be classed asan atrocity, in a similar way to genocide. His book presents compelling arguments, which will fuel many a midnight debate, between scholars and students alike. However, as an academic practitioner, I find his analysis to be a welcome trumpet call, in the present wilderness of false news. This book will be of interest to aid workers, nutritionists and activists who believe that social justice approaches to development need to take precedence over neo-liberal economic growth models. De Waal's book will become a new core reader on my list of essential books for students, as I strive to fuel the debate to support the right to food and health for all amongst the future leaders in the field of Global Public Health Nutrition.
