Inhaltsangabe: Die Mehrzahl der verlässlichen Vergleichsuntersuchungen zur internationalen Unternehmensteuerbelastung kommt zu dem Ergebnis, dass Deutschland im internationalen Vergleich bei Kapitalgesellschaften eine der höchsten nominellen und effektiven Steuerbelastungen aufweist.' Seit geraumer Zeit ist ein internationaler Steuersatzsenkungswettbewerb zu beobachten, der dazu geführt hat, dass die durchschnittliche Steuerbelastung von Kapitalgesellschaften innerhalb der EU von 1993 bis heute von 38% auf 24,2% gesunken ist. Auch Deutschland hat in diesem Zeitraum die Steuerbelastung von Kapitalgesellschaften von 59,7% auf 38,65% gesenkt, weist aber dennoch die höchste nominelle Steuerbelastung auf, die dazu führt, dass Deutschland international nicht wettbewerbsfähig ist. Der Gesetzgeber verfolgt mit der Unternehmensteuerreform 2008 zwei Hauptziele. Zum einen soll der Wirtschaftsstandort Deutschland gestärkt und international wettbewerbsfähig gemacht werden. Zum anderen soll das nationale Steueraufkommen gesichert werden, so dass der Staat die nötigen Zukunftsinvestitionen tätigen kann, um die wirtschaftlichen und sozialen Rahmenbedingungen aufrechtzuerhalten und zu verbessern. Beim weiterhin herrschenden Steuersatzsenkungswettbewerb muss immer berücksichtigt werden, dass Steuern bei Standort- und Investitionsentscheidungen nur ein Faktor unter mehreren sind. Staaten mit guten Standortbedingungen müssen weiterhin in der Lage sein, höhere Steuern zu erheben als Staaten mit schlechteren Standortbedingungen. Die Kritik am deutschen Steuersystem beschränkt sich allerdings nicht nur auf die Höhe der Steuerbelastung. Der Vorwurf lautet, dass das deutsche Steuersystem reformbedürftig sei, da es Wachstum und Beschäftigung hemme, zu kompliziert sei sowie das Leistungsfähigkeitsprinzip vielfältig und unsystematisch durchbreche. Der Bundesrat hat am 06.07.2007 der vom Bundestag am 25.05.2007 verabschiedeten Unternehmensteuerreform zugestimmt. Neben den ab 2008 geltenden Änderungen wurde auch die Einführung der Abgeltungssteuer zum 01.01.2009 beschlossen. Der Gesetzgeber erwartet, dass der Investitionsstandort Deutschland attraktiver wird für alle, die hier investieren wollen, für alle, die hier in Deutschland Arbeitsplätze schaffen wollen und für alle, die ihre Wertschöpfung in Deutschland versteuern und nicht ins Ausland verschiebe wollen. Das Ziel dieser Studie soll sein, die Gesetzesänderungen zu erläutern, kritisch zu analysieren und Verbesserungsvorschläge abzuleiten.

Together with a number of other fields of law, consumer law often appears to be a laboratory of private international law. Various policy interests, both at national (substantive) and international level, are at stake and have prompted a creative, policy-oriented approach from the conflicts legislator. A compromise has been sought between the protection of the consumer, substantive policy goal which is to be secured also in international transactions, and traditional conflicts values such as international harmony and legal certainty in cross-border relationships, which both are much easier realized with a neutral and abstract approach. Well-known achievements with regard to international consumer contracts are Article5 of the 1980 Rome Convention on the law applicable to contractual obligations and the provisions in EC directives on consumer protection which shield the consumer from the application of restrictive third country law. Much has already been written on this topic. Still, the book of Stefan Klauer on European conflicts of law regarding consumer protection constitutes a very valuable contribution to the academic debate.

That democracies, though just as belligerent as non‐democracies, are unlikely to fight one another is practically law in the study of international relations. Yet prevailing liberal explanations for this democratic peace, which focus primarily on democratic political institutions and culture, remain incomplete. Most importantly, these explanations emphasize a rights‐based ethic, which has significantly limited our comprehension of the link between domestic politics and international relations to empirical generalizations. International relationships, however, are intrinsically interdependent and therefore thoroughly knowable only in the context in which they occur and are experienced. In this article I interpret the "democratic peace" as a single thread, albeit a highly visible and important one, in the dense fabric of international relations. More specifically, I enlarge the context in which domestic politics is connected to international relations to include the politics of care—itself a practice that is usually understood to be private, i.e., particular, often emotional, and contextually moral. The result is a more refined understanding of the conditions for peace among all nations—democratic or not.

AbstractThis article examines the interrelationship between and the relative importance of individual leadership and structural power in promoting (or impeding) regime implementation. The theoretical debates on structural power and individual leadership are related to a particular case of regime implementation: the efforts of the Preparatory Commission on the International Seabed Authority and the International Tribunal for the Law of the Sea to make the international seabed regime operational. The article concludes that hegemonic stability theory highlights a variable—structural power—which in this case is the key determinant of the ability to exert influence. On the other hand, hegemonic stability theory fails to establish causal links and it ignores other important variables, such as the constraints imposed by changes in the domestic environments of leading states as well as in the international environment. In the pulling and hauling of international negotiations aimed at regime implementation, individuals can and do play significant roles as structural, intellectual and, most particularly, entrepreneurial leaders.

Abstract. Are nationalism and international economic integration irreconcilable? This paper explores the theoretical connections between these two phenomena and develops a framework to assess the implications of international economic integration for nationalist movements in the developed West. We focus upon the structural context of nationalism in democratic societies, emphasising the impact of changes in the international political economy and the influence of domestic institutions. Although the demand for secession may not stem from economic calculations, the expected costs and benefits of independence are constraints to nationalist mobilisation and are conditioned by the structure of the international political economy. We identify three ideal types of international structures and discuss how the strategies and prospects of nationalist movements are shaped within each of them. We find that a structure of 'institutionalised interdependence' is most conducive to nationalist mobilisation in a liberal democratic context, but the impact of economic integration depends largely upon conditions defined by domestic institutional structures.

Mit dem Seerechtsübereinkommen der Vereinten Nationen vom 10. Dezember 1982 haben die Staaten die seit dem Jahre 1948 zu verzeichnende ständige Ausweitung küstenstaatlicher Nutzungsrechte in Seegebieten, die vormals der hohen See zugerechnet wurden, rechtlich sanktioniert. Der damit einhergehende verstärkte Zugriff auf die lebenden und nichtlebenden Ressourcen des Meeres birgt die Gefahr zwischenstaatlicher bewaffneter Auseinandersetzungen in sich. Dies verdeutlichen die zahlreichen Streitigkeiten, die sich beispielsweise im Zusammenhang mit der Proklamation ausschließlicher Wirtschaftszonen oder der Geltendmachung von exzessiven Festlandsockelansprüchen ergeben. Die daraus resultierenden Gefahren für die von freien Schiffahrtswegen in besonderem Maße abhängigen Industriestaaten liegen auf der Hand. Dem Völkerrecht stellt sich die Aufgabe, auf diese Gefahren für die internationale Sicherheit zu reagieren und Mechanismen sowie verbindliche Verhaltensmuster zur Verhinderung und Begrenzung zwischenstaatlicher Konflikte bereitzustellen. Das System kollektiver Sicherheit und das Friedenssicherungsrecht werden dieser Aufgabe auch in Zukunft nur in eingeschränktem Maße gerecht werden können. Nicht zuletzt aus diesem Grunde hält das Völkerrecht in Form des Rechts des internationalen bewaffneten Konflikts ein weiteres Instrumentarium vor, das der Anwendung zwischenstaatlicher militärischer Gewalt rechtliche Schranken setzen soll. Dieses ius in bello hat, soweit internationale bewaffnete Konflikte an Land betroffen sind, einen beachtlichen Kodifikationsstand erreicht. Anders verhält es sich demgegenüber in bezug auf den internationalen bewaffneten Konflikt zur See. Zwar sind das Seekriegsrecht und das im Seekrieg anwendbare Neutralitätsrecht in völkerrechtlichen Verträgen fixiert, diese Kodifikationen datieren aber mehrheitlich aus dem Jahre 1907 und sind bereits angesichts der technischen Veränderungen als wirksame rechtliche Schranken der modernen Seekriegführung allenfalls bedingt geeignet. Da auch in naher Zukunft nicht mit einer Kodifizierung des Seekriegsrechts zu rechnen ist, widmet sich die vorliegende Arbeit der Untersuchung der gewohnheitsrechtlichen und sonstigen völkerrechtlichen Normen, die im internationalen bewaffneten Konflikt zur See die Rechte und Pflichten sowohl der Kriegführenden als auch der nicht am Konflikt Beteiligten zum Gegenstand haben.

Zambia. ; This report was commissioned by the Provincial Planning Unit (PPU) of the Northern Province, Government of the Republic of Zambia and the Norwegian Agency for International Development (NORAD). The major objective of the study was to investigate the long term environmental effects of expanding agricultural production and other use of natural resources in the Northern Province (NP) of Zambia, and in particular to identify potential problems related to current agricultural development policies and practices. The study was undertaken by the Norwegian Centre for International Agricultural Development (NORAGRIC) in conjunction with the International Union for the Conservation of Nature and Natural Resources (IUCN) during a three month period from September to November 1989.

Scientific thinking on the Third World's place in international space has suffered considerably from ideological fashions and the closure of analytical networks, whether geopolitical (East/West against North/South) or scientific (" internal " versus international scope). Trying to clarify the intersections of the East/West and North/South dimensions, the problématique of cardinal relations aims to free itself of such closures. By exploring the varions polarities of the international System and the space which they mark, it attempts to reflect on the articulation of international power relations partially determined by the Interstate System, and the endogenous dynamics of peripheral societies. From this point of view, it analyzes the various sites of this articulation and measures the erosion to which the central norms (North-East/North-West) are subject at the periphery. Understanding how the international order imposes its constraints on the Thirld World while feeding deconstructions and recompositions - that is the problematique of cardinal relations.

Initialement, l'Union Soviétique a refusé à la fois le système de commerce multilatéral et ses institutions (1947-1955). Cependant, sa position a évolué depuis le milieu des années cinquante. Tout en souscrivant à la règle de la non-discrimination et du multilatéralisme dans le commerce international, l'U.R.S.S. a cependant continué à refuser d'adhérer aux institutions de coopération commerciale internationale telles le GATT et son pendant monétaire, le FMI. Il semble désormais qu'une étape a été franchie et qu'on puisse reconsidérer la participation soviétique au partage des responsabilités pour la gestion de la coopération économique internationale.
L'article clarifie la nature des forces internes et internationales qui ont poussé le gouvernement soviétique à changer d'approche envers les règles fondamentales de la coopération commerciale internationale. Il énumère également les principaux domaines où des différences risquent de subsister et propose quelques solutions à ces problèmes.
L'auteur suggère que l'Union Soviétique aussi bien que les grandes nations commerçantes de l'Ouest bénéficieraient d'une telle conciliation sur les objectifs et les moyens.

Im Rahmen der seit zwei Jahren mit großer Vehemenz geführten internationalen Diskussion um die Schaffung einer neuen Weltwirtschaftsordnung, spielt die Regulierung des Rohstoffhandels eine zentrale Rolle: Die Entwicklungsländer, die überwiegend noch auf Rohstoffproduktion und -export spezialisiert sind, pochen auf international sanktionierte Regelungen, die nicht nur die Rohstoffpreise stabilisieren helfen, sondern dies auf einem, wie es heißt, angemessenen und gerechten Niveau tun. Die Industrieländer, die nur in Einzelfällen über eine eigene ausreichende Rohstoffbasis verfügen, sind an völkerrechtlich abgesicherten Vereinbarungen interessiert, die den freien Zugang zu den Rohstoffquellen gewährleisten, und zwar zu Preisen, die nicht monopolistisch überhöht sind. Das Problem ist nicht neu, wie der anstand erhellt, daß schon vor 100 Jahren ein erstes internationales Rohstoffabkommen (für Zucker) mit dem Ziel der Preisstabilisierung und Versorgungssicherung abgeschlossen wurde, dem dann in der Zwischenkriegszeit sowie in den fünfziger und sechziger Jahren weitere folgten. Neu ist aber der weltwirtschaftliche Hintergrund, vor dem es virulent wird: Die bislang nach Dauer und Intensität beispiellose Preishausse, in deren Zeichen die internationalen Rohstoffmarkte von 1972 bis 1974 standen, und der Erfolg des OPEC-Kartells, den Preis für Rohöl 1973/74 vervierfachen zu können, haben in Entwicklungsländern die Vorstellung genährt, auch bei anderen Rohstoffen über größere Anbietermacht zu verfügen, als sie bis vor kurzem selber vermutet hatten. Konsequenterweise wollen sie nicht mehr nur eine Stabilisierung der Rohstoffpreise schlechthin, sondern auch den Preistrend losgelöst von den langfristigen Grenzkosten und der allgemeinen Marktlage nach oben richten, so daß sich zugleich ihre Terms of Trade gegenüber den Industrieländern verbessern. Die Rohstoffpolitik soll letztlich zum Hebel für einen verstärkten - und automatisierten - Ressourcentransfer von Nord nach Süd werden. Das in zahlreichen Deklarationen propagierte Mittel zum Zweck soll, neben der Bildung von Rohstoffkartellen zwischen den Produzentenländern, eine zwischen Erzeuger- und Verbraucherländern zu treffende Vereinbarung über ein allgemeines, alle Rohstoffe umfassendes Programm sein, also die Hinwendung zu weitgehendem Dirigismus im internationalen Rohstoffhandel.

Contemporary society has witnessed major growth in global governance, yet the legitimacy of global governance remains deeply in question. This book offers the first full comparative investigation of citizen and elite legitimacy beliefs toward global governance. Empirically, it provides a comprehensive analysis of public and elite opinion toward global governance, building on two uniquely coordinated surveys covering multiple countries and international organizations. Theoretically, it develops an individual-level approach, exploring how a person's characteristics in respect of socioeconomic status, political values, geographical identification, and domestic institutional trust shape legitimacy beliefs toward global governance. The book's central findings are threefold. First, there is a notable and general elite–citizen gap in legitimacy beliefs toward global governance. While elites on average hold moderately high levels of legitimacy toward international organizations, the general public is decidedly more skeptical. Second, individual-level differences in interests, values, identities, and trust dispositions provide significant drivers of citizen and elite legitimacy beliefs toward global governance, as well as the gap between the two groups. Most important on the whole are differences in the extent to which citizens and elites trust domestic political institutions, which shape how these groups assess the legitimacy of international organizations. Third, both patterns and sources of citizen and elite legitimacy beliefs vary across organizations and countries. These variations suggest that institutional and societal contexts condition attitudes toward global governance. The book's findings shed light on future opportunities and constraints in international cooperation, suggesting that current levels of legitimacy point neither to a general crisis of global governance nor to a general readiness for its expansion.

This article explores Angela Merkel's decision to open Germany's borders to refugees in September 2015 and her support for the EU-Turkey statement in March 2016. While the first policy offered relief to refugees, the second was designed to significantly reduce the number of refugees coming to Europe. Besides the seemingly contradictory rationale behind these two foreign policy decisions, the role that domestic media played in Merkel's decision to open the borders was remarkable. The connection between media reports and public opinion has long been established, whereas the connection between foreign policy and the media is more recent. However, the link between all three and how they operate together is yet to be studied. By exploring these connections, we show how foreign policy decisions can be accepted by locals within a language context that fosters identification with outsiders. Similarly, a shift in the discourse, which contributed to the perception of a divergence of interests between the local population and the refugees, helps to understand the subsequent change in foreign policy. In short, we show how this shift provides an insight into the parallels between domestic media discourses, public opinion and foreign policy decisions. We apply deductive qualitative content analysis to demonstrate this connection.
