La figura de la Empresa Militar y de Seguridad Privada es vista como una evolución del mercenario clásico, pero, realmente, es un tipo diferente de actor en los conflictos armados. La tesis mayoritaria, sobre todo entre los grupos de Derechos Humanos, es que estas compañías son los mercenarios del siglo XXI, constituyendo una consecuencia más de la globalización y el pensamiento neoliberal. El Derecho Internacional Humanitario debe regular específicamente esta figura, adaptándose a un mundo en constante evolución. Las clasificaciones de los combatientes concebidas hace más de un siglo pueden ser inadecuadas para regular el fenómeno emergente de empresas que participan en el uso de la fuerza armada consentidas, si no directamente contratadas, por los Estados. Se trata de un tema necesitado de evidentes cambios para la mejora de su regulación y, por tanto, predispuesto a la innovación, sobre el que cabe efectuar propuestas de lege ferenda con las que tratar de dar respuesta a los problemas e insuficiencias que su tratamiento actual plantea. ABSTRACT: The figure of the Private Military and Security Company is seen as an evolution of the classic mercenary, but, really, it is a different type of actor in armed conflicts. The majority position, especially among human rights groups, is that these companies are the 21st Century mercenaries, being a consequence of globalization and neo-liberal thinking. The International Humanitarian Law must regulate specifically this figure, adapting itself to an evolving world. The types of combatants designed over a century ago, may be inadequate to regulate the emerging phenomenon of companies involved in the use of armed force agreed, if not directly employed, by the States. This is an issue that needs obvious changes to improve the regulation and, therefore, predisposed to innovation, and some proposals of lege ferenda can be made in order to try to respond to the problems and shortcomings that its current treatment poses.
