Die Rezeption des römischen Rechts in süddeutschen Gebieten
AbstractDie vorliegende Arbeit behandelt, in rechtsgeschichtlichem Aspekt, den Einfluss des römischen Rechts auf die südlichen Gebiete Deutschlands und dessen Ausbreitung und Übernahme in ganz Europa. Von den Anfängen und ersten Aufzeichnungen des römischen Rechts, bis hin zu dessen Untergang und Wiederbeleben soll diese Arbeit den Weg des römischen Rechts in die neuen deutschen Rechtsordnungen aufzeigen. Diese Arbeit verschafft darüber hinaus einen detaillierten Einblick in die römische Rechtsgeschichte und dessen Wurzeln, die Zwölftafelgesetzgebung, die Zeit der Unterwerfung unter die Arbeiten der römischen Gelehrten, den Untergang der römischen Rechtskultur und das Wiederauffassen und Assimilieren an die Rechtsprechung und das neue Rechtsempfinden nachkommender Juristen in Italien. Sie gibt einen Einblick in das Entstehen eines neuen Universitätswesens in Europa, sowie, sowohl auch über dessen handelsrechtliche und wirtschaftlichen Aspekte im Zuge der Neugründungen in ganz Europa und der Rezeption des römischen Rechts in Deutschland. Mit meiner Arbeit möchte ich aufzeigen, dass das neu rezipierte römische Recht in ganz Europa auf verschiedene Weise Einfluss nahm und in sämtlichen Staaten mehr oder minder stark in deren Rechtsordnungen Einzug fand. Vor allem am Beispiel Deutschlands zeigt sich in ein interessantes Bild, da, je nach Territorium, entweder dem heimischen, oder dem gemeinen Recht der Vorrang eingeräumt wurde. Die Wiedergeburt des römischen Rechts hat einen langen Weg hinter sich, den ich mit dieser Arbeit und am Beispiel des Südens Deutschland, verdeutlichen möchte. Die Übernahme in darauffolgenden Rechtsordnungen waren ein interessantes Beispiel an einem gemeinschaftlichen, europäischen Recht und haben so mein Interesse daran, diesen Umstand näher aufzuarbeiten, geweckt. Meine Arbeit reicht geschichtlich bis hin ins 19. Jhdt. und beschäftigt sich überdies noch genauer mit den jeweiligen Kodifikationsbestrebungen süddeutscher Gebiete, dem neu errichteten Reichskammergericht in Deutschland und der Entstehung eines neuen Juristenstands in Deutschland. In meiner Arbeit unterzog ich die Rezeption überdies einer Darstellung des stofflichen Umfangs der Rezeption und einer Bilanz der Rezeption in Deutschland, mittels Abwägung der positiven und negativen Aspekte, die diese Erscheinung für Deutschland und ganz Europa mit sich gebracht hat. ; AbstractThe present work treats, in legal-historical aspect, the influence of the Roman right on the southern areas of Germany and his propagation and takeover in whole Europe.From the beginnings and the first recordings oft he Roman right, up to setting and reviving, this work should indicate the way oft he Roman right in the new German legal systems.In addition, this work gets a detailed insight into the Roman legal history and his roots, the 12 board legislation, the time oft he submission under the works oft he Roman scholars, the setting oft he Roman legal culture and reunderstanding and assimilating with the administration of justice and the new legal feeling of following lawyers in Italy.This work gives an insight into the forming of a new university being in Europa, as well as, also about his relating to commercial law and economic aspects in the course oft he new establishments in whole Europe and the adoption oft he Roman right in Germany. With this work I would like to indicate that the new absorbed Roman right had in whole Europe in different ways his influences und is found in all states more or less strongly in their legal systems move. Above all the example of Germany appears in an interesting picture, there, according to territory, either to the home, or the common right the priority was put away. The rebirth oft he Roman right has a long way behind itself which I would like to make clear with this work and esspacially the example of the south of Germany. The takeover in the next legal systems were an interesting example in a common, European right and have woken up thus my interest to work off closer this fact. This work reaches historically to there in 19. Century and deals even more exactly with the respective aspirations of codification of South German areas, the new established imperial chamber court in Germany and the origin of new lawyers trinkets in Germany.
