AbstractWeb-based financial intermediation on a peer-to-peer (P2P) basis will eventually prevail as an economically superior form of organisation compared to the traditional banking business model. P2P lending is the most popular type of crowdfunding, whereby an internet platform collects small amounts of funds from individuals in a crowd to finance collectively a larger loan to individuals or businesses. Unlike a commercial bank, the platform does not take risks through its own contractual positions. Whereas banks accumulate risks by taking positions on their balance sheet, platforms decentralise the risks by spreading them to their users. The emergence of financial platform businesses challenges legislators and regulators in several respects: the "easy way" of modifying existing finance and banking laws is inadequate; the internal organisation and knowledge of staff is not well suited to regulating crowdfunding; and capital mediation by crowdfunding platforms requires a different regulatory approach than banking. Finally, there is no doubt that P2P lending platforms will in the long run need a dedicated, single European regulatory framework.
William Murray fue un jurista singular. Con el nombre literario de Lord Mansfield, creó para su época y para la posteridad una expresión inolvidable: "Una persona puede usar una copia tocándola, pero no tiene ningún derecho a robarle al autor los beneficios multiplicando las copias y disponiendo de ellas para su propio uso". En esa opinión se apoyó para decidir el memorable caso de Millar vs. Taylor, donde por primera vez se sostuvo que el copyright hallaba su protección bajo el common law anglosajón. Según esta decisión, las facultades que tenían los autores sobre sus obras se entendían perpetuas en virtud de la tradición del derecho común. La disputa involucraba a Andrew Millar, un vendedor de libros que en 1729 adquirió los derechos de edición sobre The Seasons, un poema del autor James Thomson. Cuando la protección a los derechos del librero expiró, Robert Taylor comenzó a publicar sus propias copias y a competir con Millar. La King's Bench, precedida por los jueces Mansfield, Aston, Willes y Yates falló a favor del librero, pues en su concepción el copyright no expiraba con el simple paso del tiempo en la legislación vigente el Estatuto de la Reina Ana de 1709. El derecho que tenía Millar para editar la obra debía entenderse perpetuo, y Taylor no podía copiar ni distribuir el poema a su arbitrio. Actualmente, los derechos de autor no son perpetuos y la opinión del juez Mansfield parece no tener repercusión permanente en la cultura popular. La difusión de copias ilegales es una realidad que afecta no sólo a la propiedad intelectual, sino también a los autores y titulares del derecho de autor.

El 3 de desembre de 2009, els Estudis de Dret i Ciència Política de la Universitat Oberta de Catalunya (UOC), juntament amb l'Internet Interdisciplinary Institute (IN3), van organitzar la jornada "Usos i abusos del peer-to-peer", que va tenir lloc a la seu central de la UOC a Barcelona. La jornada la van coordinar els professors d'aquests Estudis integrants del grup de recerca Interdret de l'IN3. ; On 3 December 2009, UOC's Law and Political Science Department, in collaboration with the Internet Interdisciplinary Institute (IN3), organised the workshop 'Use and abuse of peer-to-peer filesharing', at the main offices of the UOC in Barcelona. ABSTRACTThe development of digital technology, especially in the field of financial technology (fintech), always presents new innovations that invite the millennial generation's curiosity. Peer to peer lending is one form of fintech innovation in terms of investment which is becoming a trend in Indonesia. The purpose of this study was to determine the interest of the millennial generation of investing to be lenders in peer to peer lending. The writing method in this study is qualitative by conducting interviews (in-depth interviews) with millennial generation informants with birth ages from 1980 to 1990, or at the beginning of 2000. The results of this study are to measure the investment interest of millennial generations with understanding of the benefits and risks of peer to peer lending. From this research, it can be concluded that most millennials are hesitant and are not interested in becoming lenders in peer to peer lending. Millennials prefer to invest in other forms such as stocks, gold, deposits, savings, and property. Socialization and in-depth information about the benefits of investments in peer to peer lending is one of the things that needs to be done by the peer to peer lending platform providers. In addition, the role of government is also needed in regulating regulations to provide security and minimize the risk of default and fraud. The results of this study are expected to contribute to the provider of peer to peer lending platforms and can be a picture for millennial generations in making investment decisions in the digital era.
