Concluido el análisis de la primera parte especial de los derechos reales, referente a la teoría general de la posesión y la propiedad como derechos reales centrales, corresponde en esta oportunidad dar inicio al estudio de las desmembraciones del derecho de propiedad, los denominados derechos reales sobre la cosa ajena o derechos reales de disfrute (goce); entre ellos, los más importantes son el usufructo y la servidumbre. Partimos con el análisis histórico y sociológico del usufructo para luego entrar al desarrollo de sus derivaciones: el uso y la habitación, además de un análisis del cuasiusufructo. En la misma línea, tratamos el tema de la servidumbre. Identificada su base social, procederemos al estudio de estas instituciones jurídicas desde un análisis legislativo, que implica confrontarlas con la doctrina nacional y extranjera contemporánea, así como con los más recientes planteamientos jurisprudenciales emitidos por el Poder Judicial. Seguimos la misma línea de trabajo utilizada en la investigación referida a la parte general (tomo I) y a la posesión y propiedad (tomo II). Con esta investigación, pondremos a disposición de la comunidad operativa y académica una obra metodológica y técnicamente desarrollada, que analiza de forma pormenorizada el derecho real de usufructo y sus derivaciones desde la óptica del derecho civil, tomando como base la praxis que se viene aplicando. Esta investigación es la continuación de otras auspiciadas por el instituto de Investigación Científica de la Universidad de Lima, entre los años 2009 y 2016, dirigidas a la elaboración del Tratado de derecho civil peruano (20 tomos), obra que implica un razonamiento orgánico, uniforme y contemporáneo sobre las diversas instituciones del derecho civil.
ABSTRACTThis article describes an innovation called the Integrative Business Experience (IBE) that links a set of required core business courses to an entrepreneurial practicum course in which two things occur. One is that students are concurrently enrolled in the required core business courses and a practicum course while they create a start‐up business (based on an actual bank loan) and use the profits to finance a hands‐on community service project. The other is that the core courses are taught using the Team‐Based Learning (TBL) to shift the focus of class work from content delivery to content application, and promote the development of interpersonal and team skills.The wide acceptance of the value of active learning over the past 30 years has supported the foundation of Kolb's Experiential Learning Theory, i.e., learning is transformed through experience. IBE provides students with a transformative experience that can engage them in every learning style in Kolb's model. IBE combined with TBL fosters development of the teamwork, interpersonal, and communication skills necessary for effective problem‐solving.This article uses Kolb's cycle of learning to describe how and why the real experience provided by IBE enables students to develop the ability to engage in analytical thinking through practical reasoning, reflective exploration of meaning, and multiple framing. Further, because students' experiences in IBE are real, they are able to reflect on their personal identities and values as they make decisions in both their business and service activities, and experience the consequences of their choices.
Abstract Real-time response (RTR) measurement is an important technique to assess human processing of information. Ever since Maier et al. verified the reliability and validity of physical RTR devices in this journal a decade ago, there has been a growing trend toward virtual measurement platforms to overcome the limitations of conventional, laboratory-based methods. We introduce the Debat-O-Meter, a novel online RTR platform for mobile devices, which allows researchers to measure how viewers perceive political debates in the setting of their private homes. We draw on a large study (N = 5,660) conducted during the 2017 German general election campaign and show that virtualized measurement indeed facilitates diverse and large N field studies while simultaneously conforming to established standards of reliability and validity.
We are witnessing a return of the real which philosophy seems illequipped to handle. I argue (1) that this return of the real must be read as a rejection of those philosophical tendencies which were prevalent in the past decades and which I call philosophies of mediation: They supplanted all references to something real by the sole reference to those processes in which reality was supposed to be given or shaped (in interpretations, linguistic structures, historical or social conditions, media…). The current urgency of the question of the real indicates that those philosophies have lost credibility. On the other hand (2), the contemporary attempts to resuscitate philosophical realism cannot be considered satisfactory either. It is curiously the real itself they fail to fully appreciate. All in all (3), the return of the real has to be interpreted as the effect of an event that has little to do with philosophy, namely the return of politics.
A "real utopia" isn't an oxymoron or a figment of the imagination. Erik Olin Wright writes, instead, that real world examples of functioning social alternatives can help us find ways to improve the human condition. When history provides an opportunity to effect such changes, a familiarity with real utopias will provide a roadmap.
An alternative foreign policy perspective, called Real Democratik, is presented that will permit the US to preserve its international authority & core values. Analysis of the international order revealed that unipolarity is an integral component of maintaining global relations. Moreover, it is stressed that certain factors -- the legitimacy of the global superpower, the creation of multilateral alliances between the superpower & key states, the formation of requisite international institutions, & the commitment to combating terrorism on a global level -- can substantially extend the life of a unipolar world. It is claimed that sundry foreign policy decisions made within the George W. Bush administration have seriously undermined the US's prospects for remaining the sole global superpower. Therefore, Real Democratik is offered as a viable alternative to Democratic leaders for resurrecting the US's fallen position within the international order. The central characteristics of the proposed foreign policy approach are stipulated with specific attention to their operation with regard to the war against terrorism, the non-proliferation of weapons of mass destruction, & the energy supply. In addition, areas in which Real Democratik is a significant improvement over the Bush administration's current perspective are illuminated. J. W. Parker
