Il saggio analizza la produzione di libri per la scuola e l'istruzione nel Regno di Sardegna tra il Decennio francese e la Restaurazione. All'analisi quantitativa sui testi reperiti si aggiunge l'analisi lessicale e testuale effettuata con l'applicativo TalTac, che ha permesso di mettere in luce la tardiva comparsa del termine "manuale" per definire il libro pensato espressamente per la scuola. Principale artefice dell'utilizzo e della diffusione di tale parola nel vocabolario scolastico piemontese fu il maestro e giornalista Michele Ponza, autore di fortunati manuali nell'Italia del primo Ottocento.
The study proposes early considerations on the horse trade between the Kingdom of Sardinia and the territories of the Crown of Aragon in the second half of the 15th century. The analysis is based on 51 export licenses and allows us to reconstruct the dynamics of a traffic regulated by the public authority, highlighting the officers involved in controlling and issuing of the related authorizations. The profiles of the subjects involved are those of professional merchants, in addition to members of urban high society, with roles in the administration of the city or kingdom, and those who transport horses on an occasional basis. Finally, there are some exponents of the feudal world, often in business with overseas merchants, who can claim franchises, tax exemptions and advantageous links with the officials of the kingdom. Among the places of destination are the great Iberian markets (Barcelona, Mallorca and Valencia) and some Italian cities (Naples, Piombino and Rome), where horses could be bought by high-ranking men (such as the major sacristan Alonso Cortés) and also be used for military reasons or for state service. This shows a risky trade but with large profit margins, carried out by specialized subjects who use vessels with particular technical characteristics. The continuation of the research will make it possible to clarify the knowledge on the tax treatment reserved for horses and raises new questions on the breeding practices, which had to respond to the continuous and regular demand for animals from the Iberian and Italian world. ; Lo studio propone prime considerazioni sul commercio dei cavalli tra il Regno di Sardegna e i territori della Corona d'Aragona nella seconda metà del XV secolo. Il saggio illustra i prodromi e la genesi del Consiglio di Stato istituito da Carlo Alberto nel 1831, dal quale è derivato - seppure subendo successive evoluzioni - l'organo che ancor oggi è in piena attività . Partendo dal Consiglio di Stato napoleonico, lo studio analizza i variegati progetti, conservati in diversi fondi archivistici italiani, che furono elaborati nel Regno di Sardegna nel periodo della Restaurazione, inquadrandoli all'interno del sistema politico-istituzionale allora vigente.
Il saggio si propone di ricostruire, partendo dalla storiografia sul tema e attraverso l'esame dei Parlamenti del Regno di Sardegna convocati da Alfonso V nel 1421 e da Ferdinando II fra il 1481 e il 1504, il ruolo delle città all'interno dell'assemblea parlamentare, i rapporti tra le diverse realtà urbane e il potere regio, l'onere economico che le stesse città si assumevano con l'approvazione del donativo. La documentazione parlamentare offre uno spaccato della Sardegna reale, con i conflitti e con i suoi molteplici problemi, soprattutto di natura economica, ai quali danno voce le città e più in generale le componenti stamentarie che siedono in Parlamento. ; The aim of this essay is that of retracing the role of cities within the parliamentary assembly, the relationship between the diverse urban centers and royal power –represented in the island by the viceroy and by the hierarchy of royal administration– and the economic burden, which the cities themselves used to take by approving the donative. In order to do so the essay will start from the analysis of the historiographical material on the theme and will progress through the assessment of the proceedings of the parliament of the Kingdom of Sardinia summoned by Alfonso V in 1421 and Ferdinand II between 1481 and 1504. Such parliamentary documents provide a detailed account of royal Sardinia, with its conflicts, its most diverse issues, mainly of economic nature, raised by the cities and more broadly by the representatives of the highest social classes sitting in parliament.
"Fino alla metà del XX secolo il tema del giuramento 'civile' degli ecclesiastici era ancora di stretta attualità: l'istituto aveva – però – radici molto profonde, soprattutto nella tradizione storico-giuridica degli Stati sabaudi in epoca moderna, per passare poi alle vicende preunitarie ed alla sua formale abolizione da parte del Regno d'Italia nel 1871 con le Leggi delle guarentigie. [.] Attorno a tali vicende storico-politiche emergono nel breve volgere di alcuni mesi (dal novembre 1821 al settembre 1822) rilevanti problematiche giuridiche intorno alla legittimità dei giuramenti, alla loro natura "ecclesiastica" e all'importanza della dispensa concessa dal papa sotto forma di un vero e proprio atto di deroga di un canone imperativo contenuto nel Liber Extra. […] Tutto ciò si inserisce – inoltre – nel preciso contesto storico della Restaurazione sabauda, le cui vicende istituzionali, giuridiche e politiche costituiscono ormai da anni un terreno d'incontro di diverse prospettive storiografiche. A partire dall'impportante contributo di Enrico Genta, sull'eclettismo giuridico della Restaurazione, si sono potuti – infatti – cogliere alcuni caratteri delle istituzioni e della cultura giuridica del Regno di Sardegna, che erano rimasti sulla sfondo delle più tradizionali ricostruzioni".
Il tema delle rappresentazioni del potere e dell'uso delle immagini con scopi politici è oggetto oramai da diversi anni di un crescente numero di studi. Stemmi, oggetti di oreficeria, dipinti e sculture sono presi in esame non solo per il loro status di oggetti d'arte ma anche come prodotto della volontà di committenti facoltosi, spesso sovrani, che li utilizzano per accrescere il consenso intorno a loro. Il Trecento registra, in ambito mediterraneo, importanti personalità che utilizzano le immagini come forma di consolidamento visuale della loro autorità. Tra questi Roberto d'Angio, re di Napoli, e Pietro il Cerimonioso, sovrano della Corona d'Aragona, costituiscono dei casi - studio ampiamente esaminati. In questo saggio si vogliono offrire alcune riflessioni relative alla figura di Mariano IV, sovrano del giudicato d'Arborea, in rapporto ai governanti a lui coevi, in un momento storico, la metà del XIV secolo, nel quale la Sardegna sta entrando de facto nei territori della Corona d'Aragona.
ITALIANO: L'obiettivo del contributo è valutare quanto e come l'evoluzione del più ampio contesto politico e culturale influenzò strategie conservative, politiche di ordinamento e scelte organizzative dei Regi archivi di Corte, la massima istituzione archivistica del Regno di Sardegna, nel periodo compreso tra il 1831, anno dell'ascesa al trono di Carlo Alberto, e il primo decennio postunitario, quando giunsero a compimento i processi iniziati almeno mezzo secolo prima. / ENGLISH: The paper aims to evaluate how and to what extent the evolution of the broader political and cultural context influenced the strategies of conservation, and the guidelines and choices of archival organization implemented by the Royal Court archives – the highest archival institution of the Kingdom of Sardinia – between 1831 (when Charles Albert became king) and the first decade after the unification of Italy, when the process begun at least half a century before came to completion.
Nella prima metà del XIX secolo i viaggiatori italiani in Renania provengono in larga maggioranza dal Regno di Sardegna. Si tratta di letterati, ma anche di medici, scienziati, ingegneri. L'interesse per la regione si concentra su diversi aspetti: l'amministrazione prussiana della Renania, l'assetto doganale, le istituzioni universitarie e mediche. Il Reno non è inizialmente percepito come simbolo nazionale. Presenti nella memoria culturale sono semmai le vicende collegate all'armata del Reno negli anni Novanta del secolo precedente. E' in clima risorgimentale che il Reno diventa simbolo nazionale anche per gli osservatori italiani che vi vedono, in analogia con la situazione politica italiana, il simbolo di una "Kulturnation" che prescinde dall'unità politica.
Victor Amadeus II is generally recognized by historiography as the initiator of a major administrative and judicial reorganization, begun after the Peace of Utrecht and the conclusion of the War of the Spanish Succession. This has been a long and complex process, which also led to the issuing of a new body of laws: the Leggi e Costituzioni di Sua Maestà il Re di Sardegna of 1723. Victor Amadeus II's action also involved the Savoy judicial system. Recent studies have analysed the reforms carried out by this sovereign during his long reign on the most important existing magistracies in the Kingdom of Sardinia (the Senates and the Camera dei Conti). This article aims to examine one of the most critical episodes in the institutional and legal history of Savoy, namely the conflict between 1722 and 1723 between Victor Amadeus II and the Senate of Piedmont.This clash led to the replacement of a significant number of Turin senators including President Paolo Francesco Leone. The king came into conflict with his Senate due to the acquittal that this magistrate gave to Carlo Lorenzo Revello, a country guard who was caught armed near Mondovì. In fact, an edict of 1699 punished the conduct of carrying weapons in those places with the death penalty. The Senate, however, ignored the king's rule and did not condemn Revello: according to the judge's reasoning, Revello exercised a profession that made it necessary to carry arms. Thus, a close correspondence between the Senate of Turin and the king began: on the one hand, the sovereign insisted on the application of his edict of 1699, on the other, the judiciary of Turin upheld Revello's innocence and good faith.The issues that were at the basis of this institutional dispute were two. One of a legal nature and one of a more political nature. The legal one contrasted two opposing views of law: on the one hand the Senate, in favour of the use of equity in the application of law, and on the other the king interested in imposing his will without further discussion. In practice, we have a more formalistic and stringent vision of the law that seeks to impose itself on the Savoy judiciary, used to exercising a certain arbitrariness in the interpretation of laws.However, this clash at the top of the Savoy state was not caused only by legal reasons. This strong contrast also concealed a political question: Victor Amadeus II was a reforming sovereign, but with absolutist and centralizing tendencies; it was certainly among hisobjectives to reaffirm his position of strength against a Senate that claimed to have a lot of freedom.A fairly minor legal question became a very sensitive political issue. Several members of the Senate were in fact convinced of the specious nature of the affair and of the accusations made by the king. For example, Maurizio Ignazio Graneri, one of the senatorsdirectly affected by the Victor Amadeus II's sanctions, argued that the Revello case was just the king's excuse to dissolve the Senate and fill it with new, more loyal members. The article begins with an analysis of this conflict at the head of the State and then extendsthe study to the complex relationship between political and judiciary power during the reign of Victor Amadeus II. The sovereign grievances, the defences of the senators and the opinions of other jurists consulted by the king allow us to reconstruct this clash butalso to investigate a more important question: how far could the interpretative power of a sovereign court on royal legislation go? ; L'articolo intende approfondire la contrapposizione che si ebbe a cavallo tra il 1722 ed il 1723 tra Vittorio Amedeo II e il Senato di Piemonte a causa dell'assoluzione che questa magistratura diede ad una guardia campestre che era stata sorpresa armata nel mandamento di Mondovì in violazione di un editto regio. Le rimostranze sovrane, le difese dei senatori e i pareri degli altri giuristi interpellati dal re consentono di ricostruire questo scontro ma consentono anche di indagare una questione più importante: fino a che punto poteva arrivare il potere interpretativo di una corte sovrana sulla normativa regia?
Questa raccolta di saggi, dedicata alle corts del regno di Sardegna in età moderna, intende approfondire – sulla scia di recenti ricerche sulla rappresentanza – il tema del parlamento quale "teatro della parola", palcoscenico dove progressivamente si sedimentano specifiche regole di comportamento e dove tenta di radicarsi una comunità politica. Tenendo come filo conduttore il rapporto fra oralità e scrittura, fra parola parlata e parola scritta, si valorizza la centralità politica del parlamento sardo e si approfondiscono questioni fino a questo momento analizzate solo dal punto di vista storico-istituzionale.
Abstract The reform of the legal studies brought in by Cesare Alfieri di Sostegno in 1846 was a turning point for the Faculty of law of the University of Turin. This paper aims to underline the contributions given by the professors of law, in particular Felice Merlo, Luigi Amedeo Melegari and Pietro Lugi Albini, to the debate arisen in this field. The analysis highlights their belief of the importance of the legal studies, and details the subsequent legislative changes that shaped the legal cursus studiorum up to the accomplishment of national unity, with a special focus on the Bon-Compagni and the Casati laws.
