Whether or not pollution havens exist in poor countries has been the subject of a great deal of debate in recent decades. This concern is warranted, as the intensity of dirty industry is rising in the developing world just as it is falling in the industrialized world. But identifying pollution havens is extremely difficult in practice. Part of the reason for this is that there are important flaws with the methods and measures used in the pollution havens literature which results in an overly narrow debate. It may be time to abandon the narrowly constructed pollution havens debate in favor of a more open-ended analysis of the linkages between global trade and investment and environmental regulation.

The regulations that govern the international trade in toxic waste materials are investigated in order to demonstrate shortcomings in such trade rules. Overviews of the emergence of the global trade in toxic waste materials & the creation of international rules designed to monitor toxic waste transference are provided. Problems that this rules regime has experienced in getting certain nations, particularly the US, to abide by existing international laws are then discussed. Although the Basel Ban Amendment prohibits the trade of toxic waste materials between wealthy & developing nations, it is noted that the legality of such trade between two developing nations has created significant problems. In addition, it is stated that foreign investment, especially in the form of industry relocation, has engendered further problems; the US's relocation of certain industries that generate toxic waste materials to Mexico is cited as an example. Recommendations for preventing the abuse of toxic waste trade laws in the future are offered, eg, trying to cut down on the overall production of such materials. J. W. Parker
