In this chapter, I demonstrate that simulation models, and in particular system dynamics models, could be a cheap and efficient way of examining policies that could allow public servants and service providers to learn and evaluate the different scenarios they are facing in delivering transitional justice remedies. In particular, I concentrate on the simulation and resultant evaluation of possible alternatives to be considered in relation to the reparation and restitution of land rights for the victims of forced displacement in Colombia. To this end, this chapter first presents a brief description of the phenomenon of forced displacement in Colombia and its impact on the society as a whole, thus highlighting the nature of the challenge for government institutions in tackling the results of decades-long conflict in the country.
This introduction presents an overview of the key concepts discussed in the subsequent chapters of this book. The book begins with a brief history of the conflict and of previous peace processes, making the case that the current peace process is best understood in relation to the wider historical process of state consolidation and successive peace attempts in Colombia. The book discusses in detail the agreements between the Fuerzas Armadas Revolucionarias de Colombia—Ejercito del Pueblo (FARC—EP) and the Colombian Government and its transitional justice component. The book focuses on identifying the challenges facing the implementation of the objectives of the transitional justice component of the peace agreement between the FARC—EP and the Colombian Government. It examines the challenges encountered in relation to policies regarding land and its restitution in Colombia. The Colombian Government has implemented and experimented with a diversity of measures in pursuit of justice and transitional justice in Colombia.
This chapter discusses the evolution of the Colombian conflict and the existence of peacebuilding initiatives with different groups as part of the process of consolidation of statehood in Colombia since 1948. It presents a brief summary of the Colombian conflict, and of previous peace processes that took place in the country after 1948. The emergence of violence in modern Colombia saw its inception in the period known as 'La Violencia' (the violence), a wave of inter-party violence between 1948 and 1958 in which almost 2" of the population of the country was assassinated. This process led to the rise of multiple liberal guerrilla groups and armed right-wing groups. The birth and the origins of the Fuerzas Armadas Revolucionarias de Colombia—Ejercito del Pueblo are a matter of academic debate; the fourteen different accounts of the origin of the conflict in Colombia presented by the historical commission of the conflict of Colombia.
[spa] Con esta investigación que tiene por objetivo general el realizar un análisis geográfico e histórico del proceso de urbanización de la ciudad de Pereira-Colombia, con el propósito de identificar y explicar las causas y factores determinantes de la desigualdad social y fragmentación espacial que caracteriza las diferentes etapas de su desarrollo y crecimiento urbano, se destacan entre los principales resultados, en primer lugar, que su origen es subproducto del proceso de colonización agraria de la vertiente andina establecida desde la segunda mitad del siglo XIX. Posteriormente, se identifica a Pereira con la inserción territorial de algunas regiones especializadas en recursos estratégicos y materias primas como el café a las redes internacionales del comercio, pero sin una integración planificada a un modelo de desarrollo autárquico nacional. Por otra parte, la "época de la violencia" impacta en forma aguda a las zonas potencialmente más ricas en cuanto a su producción cafetera de exportación, generando un éxodo y desplazamiento campesino, siendo el proceso de urbanización de Pereira durante estos años corolario de esta dinámica social, con tasas de crecimiento intercensal para el área urbana entre 1938-1951 del orden de 68 por cada mil habitantes, y entre 1951-1964 de 50 por cada mil habitantes, siendo estas las cifras más altas en su evolución demográfica. La ciudad de Pereira ha venido configurando por tanto una urbanización dual, con un crecimiento urbano que ha estado asociado a la instauración de una base económica productiva "formal" instaurada desde el período de modernización local, y de otro lado, un crecimiento espontáneo e "informal" relacionado con la dificultades estatales para atender los requerimientos económicos y habitacionales de la población de menores ingresos provenientes de las diferentes oleadas migratorias. En este sentido, el desarrollo de la periferia popular obedece a la acción individual o colectiva de organizaciones de viviendistas y a los deficientes programas de desarrollo progresivo para los sectores de bajos ingresos (lotes con servicios para autoconstrucción). En cuanto a las áreas de elitización rururbana (multiplicación atomizada y dispersa de condominios neo-rurales) se puede afirmar que este proceso se ha dado a partir de la relación entre agentes urbanos que han adquirido las tierras baratas rurales anticipando la urbanización, y la posterior llegada de los promotores y constructores, que han sido favorecidos por las débiles políticas de gestión local para frenar los intereses inmobiliarios en un territorio rural con alto potencial agroecológico, paisajístico y ambiental. Asimismo, cabe reiterar sobre los agentes sociales comprometidos en la urbanización marginal, que éstos han estado históricamente asociados a la falta de políticas de planificación territorial orientadas a prever las demandas de suelo para los estratos de ingresos más bajos, de modo que se pudiera mitigar su proliferación en un contexto social de fuerte inmigración como es el de Pereira, aumentando la acción de los procesos de invasión. Por último, con el nuevo modelo de vivienda de interés social ofertada por el entramado "sector financiero y constructoras privadas" se ha limitando aún más la posibilidad de acceder al mercado de vivienda formal a los sectores de menores ingresos y pauperizados por la crisis económica que vive la ciudad y la región desde 1990 como consecuencia de la recesión del agro-negocio cafetero y el impacto de las políticas neoliberales y aperturistas en sus principales sectores productivos, entre ellos la manufactura local (textil, etc.). ; [eng] The main objective of this research is to make a geographical and historical analysis of the urbanization process of Pereira, Colombia, in order to identify and explain the causes of social inequality and spatial fragmentation that characterizes the different stages of its development and urban growth. Among the most important results, the first one is that the origin as a town of Pereira was related with the process of rural land colonization of the mountainous areas of the central Colombian Andes established since the second half of the nineteenth century. Subsequently, Pereira is part of the territorial insertion of some regions specializing in strategic resources and commodities such as coffee to international trade networks. After that, the "violence period" hits sharply to the potentially richest areas in terms of coffee production for export, generating an peasant exodus, with the urbanization process of Pereira as a main effect of this social dynamic. Therefore, Pereira has been shaped a dual urbanization, associated with a "formal" productive economic structure from the local modernization period, and on the other hand, a spontaneous growth related with the state difficulties in order to get proper solutions to economic and housing needs of the population who has the lower income. In this sense, the development of the popular periphery has been produced by individual or collective actions from social organizations, and from public housing politics such as progressive development programs. Finally, rural gentrification has been ocurred because of relationship between urban agents who have purchased cheap land anticipating rural urbanization, and subsequent arrival of developers and builders, with several effects in these areas with high agro-ecological potential, environmental and landscape heritage
Unlike other Latin American countries, Colombia has consistently been governed by centre-right or right-wing political parties. The absence of political space for the Left in this country allowed governments to portray protests as subversive and criminal. However, starting in 2008, right-wing politicians have embraced, supported and used the protest as a tactic; undertaking, calling for, and giving support to various protest movements across the country. This has had an unexpected consequence: right-wing parties, government institutions, and even some sectors within the security and armed forces now see protests as valid and normal. Drawing on a brief historical analysis of protest movements in Colombia since 1948, and particularly after 2002, this article argues that to understand the recent normalization of this form of political expression we should look at changes in the dynamics of competition within the Right.
El objetivo principal de este artículo es examinar los vínculos entre la Epístola moral a Fabio, de Andrés Fernández de Andrada, y la obra de los escritores españoles exiliados. Especialmente, este trabajo se acerca a los textos críticos de Luis Cernuda y María Zambrano en los cuales se destaca la relevancia de la tradición poética durante los años iniciales del exilio, y se constata la relevancia que tuvo el gran poema de Fernández de Andrada entre los exiliados. Es de importancia destacar el hecho de que hasta ahora no se había estudiado la recepción de la Epístola en los textos preparados por esta generación de autores.
Durante la segunda mitad del siglo XVIII, el régimen borbónico buscó avanzar sobre aquellos territorios que permanecían por fuera del control colonial. La región del Catatumbo (en la actual Colombia), habitada por los llamados indígenas motilones, constituía una de esas fronteras que separaban los territorios controlados por la colonización de aquellos que resistían a su influjo. Con base en esta hipótesis, la pregunta central del texto apunta a identificar esta región como uno de aquellos espacios de frontera en los que constantes conflictos y negociaciones definían las relaciones interétnicas, donde los pobladores resultaron actores políticos relevantes en la definición de las relaciones de poder, que no permitieron la consolidación de una posición hegemónica, a pesar del interés de la Corona española. Por tanto, se examinarán y contrastarán fuentes relacionadas con el desarrollo comercial y con el avance misional dados en aquella región durante la época referenciada. Asimismo, se buscará analizar otras fuentes que permitan identificar la variedad de dispositivos de control que concurrieron como parte del interés colonizador, y se concluirá que, más allá del establecimiento de misiones religiosas en esa zona de frontera y del desarrollo comercial, los indígenas sostuvieron su resistencia al asedio colonial.
It is my purpose to make an analytical link between the development of criminal law that was established in the territory of the recently inaugurated Republic of New Granada, such its name at the time, and the general process of national state building in Colombia, as we can now call it. After the period of the independence wars throughout the first decade of the 19th century the leading sectors of the new Republic assumed the task of instituting the new framework of legitimacy for that political order. The classification of the conducts that were supposed to attempt against the religious faith, and its judicial treatment, show a clear sample of the particularities of the said linkage. ; En este artículo propongo realizar una vinculación analítica entre el desarrollo de la normatividad penal que fue estableciéndose en el territorio de la recientemente inaugurada República de la Nueva Granada, su denominación de entonces, y el proceso general de construcción del Estado nacional que ahora podemos denominar colombiano. Se parte del entendimiento de que tras el periodo de las guerras independentistas a lo largo de toda la primera década del siglo xix, los sectores dirigentes de la naciente república asumieron la tarea de instituir el nuevo marco de legitimidad para ese orden político. La tipificación de las conductas que suponían atentar contra la religión, así como su tratamiento judicial, aspectos que acá se abordan, manifiestan una clara muestra de las particularidades de dicha vinculación.

In this chapter we analyze the Transitional Justice framework defined by the peace agreement between the FARC-EP and the Colombian government. In analyzing the Transitional Justice framework, we will examine the principles that inspired the agreement on victims and four of the mechanisms described in it: The Truth Commission, the Unit for Searching for disappeared people, the measures for reparation considered, and the guarantees of non-repetition stated. In addition, we will analyze the Special Jurisdiction for Peace. In the final section, we will analyze some possible scenarios for the future of the implementation of the Transitional Justice agreements, reflecting on the uncertainties surrounding the implementation of the agreements and how its implementation can provide for legal stability (or instability) for different constituents and for the peace project in Colombia.

One of the most valuable features of Capital and Ideology is its concern to take history seriously and consider how the emergence of different political and economic regimes relate to discourses about fairness and justice across time. This paper pushes this agenda further by acknowledging that the experience of a few developed nations should not be taken as the template for the generalized study of inequality dynamics across time and space. In this paper, we interrogate Piketty's analysis and policy proposals against specificities that are central to understanding the production and reproduction of inequalities within South Africa. We reflect on the South African case, the structure of inequality and its changes since 1994. We review a battery of policy interventions that have been implemented to address inequality in the last 25 years. We emphasize that the long shadow cast by centuries of colonialism and various forms of apartheid strongly affirm Piketty's emphasis on understanding history. But this is both affirmation and critique given the foundational, imbedded impact that this specific legacy has had on post-apartheid society and its policies. Piketty is aware that the levels of inequality in South Africa are so high that this is "unknown territory." We map out some of this territory to reveal how these extreme initial wealth and racial inequities inform the reproduction of inequalities in all dimensions and undermine well intentioned policies. We claim that understanding extractive histories, imbedded wealth inequalities, and complex social and political institutions allows us to understand and confront some of the reasons why even in light of progressive policies, many of which are in line with the proposals from Piketty, government interventions have thus far failed to reduce inequality.
Por su posición geográfica, el departamento Archipiélago de San Andrés, Providencia y Santa Catalina sirvió durante muchos años como guía de navegación para los europeos, quienes utilizaron el mar Caribe para expandirse hacia el Nuevo Mundo durante el siglo XVI. Sus ecosistemas marinos y costeros son de gran belleza y riqueza ambiental, tanto así que en el año 2000 fueron declarados Reserva de la Biósfera por la Organización de las Naciones Unidas para la Educación, la Ciencia y la Cultura (Unesco). La base económica de su población ha sido dinámica, pasando de la agricultura como principal medio de subsistencia desde el siglo XVII y hasta mediados del siglo XX, hasta llegar al comercio y el turismo como principales actividades en la actualidad. Dada la relevancia de este departamento colombiano, Adolfo Meisel, María Aguilera, Andrés Sánchez y Javier Yabrudy, investigadores del Centro de Estudios Económicos Regionales (CEER), del Banco de la República, sucursal Cartagena, realizaron diversos estudios acerca de la historia, la economía, la geografía, el mercado laboral, el medio ambiente, las finanzas públicas y la violencia en el archipiélago. El propósito fundamental de este proyecto es generar conocimiento sobre este territorio, que contribuya al diseño de políticas públicas adecuadas para promover el desarrollo armónico y mejorar la calidad de vida de sus habitantes.--
