"H.L.A. Hart, dessen Buch 'The Concept of Law' (1961) als das wohl wichtigste rechtstheoretische Werk der zweiten Hälfte des 20. Jahrhunderts gilt, hat sich im Postscript zur 2. Auflage seines Buches (1994, postum) sehr kritisch mit Ronald Dworkins rechtstheoretischen Ansichten auseinandergesetzt. Der vorliegende Beitrag ist die - ihrerseits höchst kritische - Replik Dworkins auf Hart. Nach Dworkin vertritt Hart die Vorstellung, bei der Identifizierung von geltendem Recht gehe es um eine deskriptive Frage, die Analyse des Rechtsbegriffs allerdings sei eine philosophische Aufgabe, die sich nicht mit juristischen Methoden erledigen lasse. Beidem widerspricht Dworkin: Es gehe vielmehr bei der Identifizierung geltenden Rechts um eine wertende, auf Rechtfertigung abzielende Interpretation der Rechtspraxis; und die dabei verwendete Argumentationsweise sei keine andere als die des juristischen Alltags. Allgemeiner gelte: Begriffe wie Gleichheit, Freiheit, Recht usw. sind ebenso substantiell, normativ und parteiisch wie die konkurrierenden Ansichten, auf die man in den politischen Auseinandersetzungen über diese Ideale stößt; und Harts Ziel einer rein deskriptiven Lösung der zentralen Fragen der Rechtsphilosophie beruht ebenso auf einer falschen Grundvorstellung wie die vergleichbaren Ziele vieler führender politischer Philosophen." Examines the rhetoric behind the Chinese government's suppression of human rights & democracy in Hong Kong. An analysis of a government document from Tung Chee-hwa, the first Hong Kong executive appointed by the Chinese government, demonstrates Tung's cynicism regarding several aspects of democracy, especially free speech. Tung contends that restraints on free speech prohibit international criticism of such restraints, & "Asian values" are less individualistic & self-serving than those of Western democracies. However, it is argued that democracy is a communal & societal form of self-government, & all governments that deny free speech are tyrannical. It is concluded that the right of free speech is more fundamental than democracy, because the former is necessary to evaluate the legitimacy of the latter. J. W. Parker
