Der weltweite Frieden wird hauptsächlich durch Streitigkeiten um Land- und Seegebiete gefährdet. In der Regel wird dabei allerdings nicht um das anwendbare Völkerrecht, sondern über (historische) Fakten und deren rechtliche Bewertung gestritten. Territorialstreitigkeiten sind daher rechtlich wenig ergiebig. Interessante und neuartige Fragen werfen hingegen Räume jenseits staatlicher Herrschaft auf. Zu diesen gehören als noch geographische Räume der Luft- und Weltraum sowie die Antarktis. Zunehmend an Bedeutung gewinnt der Cyperspace, ein neuartiger virtueller Raum. Zu den nicht fassbaren Räumen gehören auch kulturelle Räume. Zum Teil wird in Nachbarschaftsräumen gedacht, wie die EU-Nachbarschaftspolitik verdeutlicht. Zu den Wirtschaftsräumen gehören Freihandelszonen, Zollunionen und Gemeinsame Märkte. Daneben existieren politische Räume, in denen es um Macht- und Einflussgebiete geht. Hinzu treten schließlich Rechtsräume, die sich aus (rechts-) kulturellen Unterschieden ergeben. »Spaces in International and European Union Law« Territorial disputes represent the main threat to global peace and security. From a legal point of view, however, they are generally of little interest. It is only in areas and spaces beyond national jurisdiction that they raise complicated and to a certain extent novel issues. These spaces include geographical areas like air, outer space and Antarctica, as well as virtual and ambiguous spaces like cyberspace, as well as cultural, neighbourhood, economic, political and legal spaces. Territorialstreitigkeiten stellen die Hauptgefährdung des weltweiten Friedens dar. Rechtlich betrachtet sind sie jedoch in der Regel wenig interessant. Das ist bei Räumen jenseits staatlicher Herrschaft anders. Sie werfen komplizierte und teils völlig neuartige Fragen auf. Zu diesen Räumen gehören nicht nur der Luft- und Weltraum sowie die Antarktis. Hinzu treten virtuelle und schwer fassbare Räume wie der Cyperspace oder kulturelle, Nachbarschafts-, Wirtschafts-, politische und Rechtsräume. Prof. Dr. Kerstin Odendahl ist Inhaberin des Lehrstuhls für Öffentliches Recht mit Schwerpunkt Völkerrecht, Europarecht und Allgemeine Staatslehre an der Universität Kiel sowie Geschäftsführende Direktorin des Walther-Schücking-Instituts für Internationales Recht. Davor war sie von 2004 bis 2011 Professorin für Völker- und Europarecht an der Universität St. Gallen, Schweiz. Ihre Forschungsschwerpunkte liegen bei den Grundlagen des Völker- und Europarechts sowie dem internationalen Umwelt,- Kultur- und Sicherheitsrecht. Kerstin von der Decken (née Odendahl) is Professor for Public Law, Public International and European Law as well as Director of the Walther Schücking Institute for International Law. From October 2004 to January 2011, she held the Chair of Public International and European Law at the University of St. Gallen (Switzerland). She was elected member of the Academy of Sciences and Humanities in Hamburg in 2015. From July 2016 until June 2018 she was Dean of the Law School of the University of Kiel. Her main areas of research are International Cultural Heritage Law, International Human Rights, International Dispute Settlement, International Environmental Law, and International Peace and Security.
