Die Eigenart des deutschen Föderalismus erschließt sich in einer historischen Analyse der bundesstaatlichen Institutionen. Dabei wird ein hohes Maß an Pfadabhängigkeit sichtbar, die ihre Persistenz über einen langen Zeitraum hinweg der Ko-Evolution von politisch-kulturellen Orientierungen (Unitarismus) und institutionellen Arrangements verdankte. Die institutionellen Arrangements entfalteten sich sukzessive über mehrere Entwicklungssequenzen hinweg, die in einer Abfolge komplementärer institutioneller Weichenstellungen (1849, 1867/1871, 1919, 1945-1949) ein System von zunehmender, überaus veränderungsresistenter Komplexität hervorbrachten. Die Langfristanalyse führt zu dem Schluss, dass der institutionelle Kern des komplex verflochtenen unitarischen Bundesstaates, wie das Ergebnis dieses Entwicklungspfades genannt worden ist, weiterhin eine durch Pfadabhängigkeit bedingte Resistenz gegen institutional engineering aufweist. Die unitarischen politisch-kulturellen Orientierungen hingegen, die seit der Mitte des 19. Jahrhunderts zur Selbstreproduktion dieses Entwicklungspfades beitrugen und deren Bezugsrahmen der Nationalstaat war, werden in zunehmendem Maße obsolet. Dies könnte Veränderungsspielräume eröffnen, die sich am Dezentralisierungsparadigma orientieren. ; The characteristic traits of German federalism are best explored in a historical analysis of the federal institutions. These exhibit a high degree of path-dependence that is due to the co-evolution of cultural orientations (unitarism) and of the institutional arrangements. The institutional arrangements were shaped in successive sequences of development (1849, 1867/71, 1919, 1945-49) which generated, due to complementary critical junctures, a system of increasing complexity that was more and more resistant to change. The longitudinal analysis shows that the institutional core of German 'unitary federalism' (as it has often been called) with its complex architecture withstands attempts at institutional engineering. However, the 'unitary' cultural orientations whose frame of reference was the nation state and which have contributed to the self-reproduction of this development path are now increasingly becoming obsolete. This might open windows of opportunity for greater decentralization.

Germany, although it was never included in the "classical" cases of consociational democracy, can nevertheless be categorized as "semi-" or "quasi-consociational." This does not just mean that Germany can be located somewhere on a scale measuring the degree of consociationalism with the established criteria of the earlier literature. A discussion of the evolution of a discourse of "embedded capitalism" in Germany & Japan from the late 19th century to the present focuses on institutions that solidified the market economy. Prescriptions for social control over markets are described, noting that state leaders sought "discourse coalitions" & turned toward conservative reform when liberalism proved incapable of guaranteeing rapid economic development. Examination of early experiments with liberal solutions in Germany highlights philosophical & religious attitudes that promoted state activism in economic affairs. However, a new discourse of conservative reform was adopted during the financial crash of the 1870s. The hegemony achieved by the nonliberal discourse in Germany was the origin of a path-dependent process of institution building. Social conservatives in Japan's Meiji era integrated some ideas from the German discourse to develop a social model of the (vertical) "ie society." The impact WWI & WWII is discussed, along with the ability of the embedded capitalism discourse to adjust to major political upheavals & external challenges. Prospects for the future are discussed. German social scientists have often stressed that the East German transformation was a process sui generis that differed strongly from the transformation paths of eastern European countries. This difference was of course mainly due to the integration of the former GDR into the Federal Republic of (West) Germany. Indeed, it is commonly assumed that the wholesale transfer of West German institutions left little room for the endogenous paths of transformation observed in eastern Europe and the former Soviet Union. The unintended outcome of this strategy of "exogenous" institutional change was a transformation crisis with the effect of a profound external shock. To be sure, this shock was mitigated by the simultaneous introduction of the West German "social net," accompanied by massive transfer payments. But many of the dire predictions made by skeptical observers in 1990 have indeed come true.

Der Verfasser setzt sich kritisch mit der Erklärung des Transformationsprozesses in den neuen Bundesländern durch das Paradigma des Institutionentransfers auseinander. Er analysiert die institutionelle Transformation als sektorspezifische Reorganisation von Verfügungsrechten. Als Fallbeispiele werden die Landwirtschaft, das System der ambulanten ärztlichen Versorgung, das System der außeruniversitären Forschung und das System der Freien Wohlfahrtspflege herangezogen. Ein erfolgreicher Transfer der sektorspezifischen Institutionen der alten Bundesrepublik setzte eine weitgehende Kompetenz des Staates zur Reorganisation von Verfügungsrechten voraus. Je mehr Märkte oder marktähnliche Strukturen eine Rolle spielen, desto stärker wurde das Transformationsergebnis durch die Anpassungskalküle korporativer und individueller Akteure bestimmt. Insgesamt sind die Governance-Strukturen des "Modells Deutschland" durch die Vereinigung deutlich heterogener geworden. Die Kompetenz des Staates zur Reorganisation von Verfügungsrechten war ein zentrales Element des Transformationsprozesses, stieß jedoch an deutliche Grenzen. (ICE2)
