The recent infatuation of first rank politicians for the Paris bar is intriguing and suggests the need to re-examine the border area between "politics" and the "bar". The article proposes to go beyond the traditional alternative between the thesis of a return to the "Republic of Lawyers" and that of a drift toward a "Business Republic" and conflicts of interests. By following the circulations, the adding up and transfers of positions in the border area between the world of politics and that of the Paris Bar, one can identify the emergence of a totally new zone -- albeit well-limited and precarious -- of contiguities and interdependence at the edge of the worlds of political and administrative elite and business lawyers' practices. Résumé L'engouement récent d'hommes politiques de premier plan pour le barreau de Paris intrigue et invite à explorer à de nouveaux frais l'espace-frontière entre «politique » et « barreau ». Cet article propose ainsi de dépasser l'alternative entre la thèse du retour à la « République des avocats » et celle de la dérive vers une « République des affaires » et du conflit d'intérêts. En suivant les circulations, cumuls et passages à la frontière du champ politique et du barreau de Paris, on montre ici l'émergence d'une zone inédite, quoique circonscrite et précaire, de contiguïté et d'interdépendance aux confins de l'élite politico-administrative et des cabinets d'avocats d'affaires.

How does the European Court of Justice (ECJ) firmly maintain a now 45-year-old consistent integrationist jurisprudence when exerting virtually no control over the recruitment of its members (a selection left to national governments)? Rather than considering such judicial consistency over time as a 'given', the paper questions the social fabric of judicial preferences. On the basis of a variety of commemorative materials produced within the Court (Festschriften, tributes, eulogies, and jubilees) and never studied so far, the paper stresses the manner in which these rituals are home to social processes of aggregation (into one unique judicial family), demarcation (from the political realm), and self-identification (to roles of so-called 'founding father', 'current spokesmen', or 'would-be judges'), thereby enabling transnational role transmission within international courts such as the ECJ.

Résumé Le présent article explore les fondements de l'autorité d'une cour internationale, la Cour de justice européenne, qui ne peut s'adosser ni sur un corps professionnel supranational, ni sur un appareil d'État. En s'appuyant sur un corpus de discours commémoratifs restés inexploités, il montre le soin avec lequel une élite de la Cour entretient depuis la fin des années 1970 un esprit de corps transnational. Mélanges , éloges et autres jubilés sont ainsi le lieu d'une mobilisation transnationale où se fixe tout à la fois l'identité institutionnelle d'une Cour à la légitimité fragile et les contours d'une « communauté » de soutiens dans laquelle la juridiction communautaire puise son autorité à prononcer ses « verdicts » sur l'Europe.

The present article explores the foundations or the authority of an international court, the European Court of Justice, which has neither a supranational professional corps nor a state apparatus to rely on. Based on a corpus of hitherto unexamined commemorative writings, we show the pains a judicial elite has taken to maintain a transnational esprit de corps since the 1970s Festschriften, laudations & other jubilees are the locus of a transnational effort to establish both the institutional identity of a Court whose legitimacy is fragile & the contours of a "community" of support which the Community courts draw on for their authority to pronounce "verdicts" on Europe. Résumé La participation de Jean Carbonnier à la refonte de la législation civile au cours des années 1963-1977 fait aujourd'hui figure de point de référence incontournable pour « l'art législatif » sous la V e République. On montre comment, armée des sondages d'opinion, et construite au service de l'exécutif, l'expertise juridique proposée alors par Jean Carbonnier s'inscrit dans les cadres d'intelligibilité d'un nouveau régime politique qui court-circuite élites professionnelles traditionnelles et commissions parlementaires. On montre aussi comment, une fois clos, cet épisode éphémère et la référence à son principal protagoniste le « Doyen Carbonnier » ont été érigés en véritable mythe, point d'appui rhétorique désormais incontournable de la critique juridique du politique.
Ce texte à paraître dans un Manuel de science politique propose une sociologie politique du pouvoir judiciaire.
