Signs of inadequacy and crisis in general international law as to the economic ownership interests of aliens have been numerous since World War II. The pages o f the J ournal have recorded and analyzed a number of situations in which the existing legal order is not working well: ineffectual resorts to international adjudication; unilateral disregard of arbitral commitments; national decisions made in the name of international law but of dubious international acceptability; professional frustrations so intense as to have directed prime attention to happenstantial "salvage" operations. In a phase now apparently ended, groups in capital exporting countries have tried time after time to put forward normative formulations of investment codes as new positive law, only to have their efforts ignored in developing countries. Now we seem to be in a new phase, one in which direct investment-receiving, or host, countries, organized into groups or regional arrangements, compact among themselves that a comprehensive normative system shall prevail in each of them as to the legal relationships between foreign investors and each of those countries. Although foreign investment codes for particular states, including systems of prior restraints on entry in some developed countries, are not new, the Andean Foreign Investment Code is, indeed, a new juristic phenomenon. The Editors of the Journal have wished, therefore, to record and analyze preliminarily this new development in transnational investment law, one whose text has been carried in International Legal Materials and considered as to its possible impact in Research Panels organized by the American Society of International Law.

Personal and collective obedience of other military, emotional reactions and values of Schwartz (2012) were measured. Showing enhancement of self-bias it is reported that the pairs would be more likely to shoot than one would. Replicating Milgrams's results, obedience is greater when the order is given directly by an authority, and lower when there is conflict between authorities and peers rebel. Confirming that identification with humanity and not just with the in-group may prompt respondents to reject an anti-normative order, values of transcendence of the self are associated with less obedience and congruent emotional reactions. Self-perceived transformational leadership was associated with positive emotions towards peer that disobey to fire. However a transformational style perceived in the superior was associated to positive emotions by respect to soldier who open fire, adding information on the potential dark side of this leadership style. The relevance of personal values, leadership style and affectivity in military context is discussed.

Abstract: The influence of the context on behavioral and emotional reactions to a war crime situation military cadets (N = 315) is analyzed. The study is based on Milgram's experience and the tragedy of My Lai.It examines personal and peer obedience to an anti-normative order (asking participants whether they would obey an order to shoot unarmed civilians) in five vignettes or scenarios that reproduce Milgram's conditions and MyLai scenario. El estudio se basa en la experiencia de Milgram y en la tragedia de My Lai. Examina la obediencia personal y de los compañeros ante una orden antinormativa (preguntando a los participantes si obedecerían una orden de disparar a civiles desarmados) en cinco viñetas o escenarios que reproducen las condiciones de Milgram y el escenario de MyLai. Se trata de un estudio experimental entre dos escenarios por dos condiciones (Milgram, 1974). Se midió la obediencia personal y colectiva de otros militares, las reacciones emocionales y los valores de Schwartz (2012). Mostrando el aumento de la auto-prejuicio se informa de que los pares serían más propensos a disparar que uno. Replicando los resultados de Milgram, la obediencia es mayor cuando la orden es dada directamente por una autoridad, y menor cuando hay conflicto entre autoridades y compañeros rebeldes. Confirmando que la identificación con la humanidad y no solo con el grupo interno puede impulsar a los encuestados a rechazar una orden antinormativa, los valores de trascendencia del yo se asocian con menos obediencia y reacciones emocionales congruentes. El liderazgo transformacional autopercibido se asoció con emociones positivas hacia los compañeros que desobedecen al fuego. Sin embargo un estilo transformacional percibido en el superior se asoció a emociones positivas por respeto al soldado que abre fuego, añadiendo información sobre el potencial lado oscuro de este estilo de liderazgo. Se discute la relevancia de los valores personales, el estilo de liderazgo y la afectividad en el contexto militar.

Although people establish norms that enable them to live together, some of these have to be coupled with a system of enforcement. This conforms to broad social contract theory and can also be applied to the international sphere. The international community is also based on a system of norms. However, unlike the domestic context, there is no overreaching authority to direct states on what they should do. Rather it is left to states themselves to police this framework. However, this has resulted in one of the conditions envisaged by social contract theorists, namely a stasis between the command order and the state of nature. This may explain, for instance, the indifference to some modern human rights violations. Hence the current system of International law, with its insistence on the Westphalian principle of equality of states has caused a substantial fracture in the enforcement of international law, particularly when it comes to serious human rights breaches, and caused something akin to the state of nature envisaged by social contract theorists. While it may be practically impossible to provide a command system in the international sphere similar to the one in the domestic life, there is some hope that a revised deontological ethic founded on global integration may provide one impetus for change. ; Šiame straipsnyje svarstoma bendroji socialinės sutarties teorija, kadangi dėl tam tikrų universalių žmogiškų tendencijų ne visuomet žmonės sugeba gerbti kitų teises. Taigi žmonių santykiams palengvinti būtina stipri direktyvų sistema. Ši paradigma taikoma ir tarptautinėje sferoje; teigiama, kad ir čia būtina stipresnė teisės aktų įgyvendinimo sistema. Tačiau akivaizdu, jog suverenumas iš dalies apsunkina padėtį. Taigi koks būtų teisingiausias sprendimas? Leviatanas ar visa apimanti ir šalis kontroliuojanti valdžia nėra būtina. Tereikia tvirto bendro sutarimo ar tarptautinės teisės įgyvendinimo svarbos suvokimo. Vis dėlto tai yra pagrindas, ant kurio buvo sukurta JTO, tad kodėl dabar turėtume kažką keisti? Pasaulinė integracija galėtų būti atsakymas. Pavyzdžiui, Kopenhagos klimato kaitos konferencijoje 2009-ųjų metų gruodį šalys nesusitarė dėl vienos sutarties anglies emisijai kontroliuoti, tačiau labai sustiprėjo suvokimas, jog dėl globalizacijos ir bendrų, valstybių sienas peržengiančių problemų šalys turi aktyviai veikti kartu gindamos pasaulinę gerovę. Tačiau kyla klausimas, iš kur atsirado tokios globalios viltys ir lūkesčiai? Jeigu galėtume tikėtis, jog politiniai lyderiai vidaus reikalų kontekste elgsis sąžiningai, kodėl buvo reikalaujama, kad taip pat elgtųsi tarptautinės politinės institucijos Kopenhagoje? Viena iš priežasčių galėtų būti nauja globali etika, susiformavusi per pastaruosius du dešimtmečius. Kai kuriose srityse žodis "moralė" ima įgauti neigiamą atspalvį, nes manoma, jog tai yra direktyva žmonėms elgtis tam tikru būdu. Dėl to nesunku įsivaizduoti, jog "globalios moralės" sąvoka taip pat įgaus Leviatano su kalaviju rankose, prižiūrinčio, ar laikomasi vieno elgesio kodo, įvaizdį. Vis dėlto toks požiūris nebūtų teisingas. Pavyzdžiui, per pastarąją visuotinę kreditų krizę buvo tikimasi, jog pasaulio lyderiai imsis sutelktų veiksmų problemoms spręsti. Tai nebūtinai reiškė, jog visas ekonominis suverenumas turėjo būti perleistas vienai tarptautinei institucijai. Iš tiesų buvo tikimasi, jog lyderiai ras bendrą išeitį, kurioje derėtų tarptautiniai bei vidaus interesai. Taigi galima teigti, kad pasaulinė integracija taps postūmiu toliau įgyvendinti tarptautinę teisę (iki šiol ji buvo nustelbta valstybinių interesų). Dėl integracijos tai, kas vyksta vienoje pasaulio dalyje, turi poveikį visam likusiam pasauliui, tad politiniai lyderiai neišvengiamai turės kartu spręsti bendras problemas. Vis dėlto šis pasaulinis procesas dar labai jaunas, tad gali praeiti nemažai laiko, kol šalys ras tinkamą spendimą. Prie šio tikslo galėtų prisidėti sėkmingesnis pasaulinis dialogas, tarptautinis pasitikėjimas bei pagarba įvairovei. Atsižvelgiant į pasaulio integracijos spartą ir būdą bei į ateityje tikėtinus pasaulinius iššūkius, tarptautinei bendruomenei būtina sukurti bendrų tarptautinių veiksmų sistemą. Tad globali etika galėtų tapti vienu iš būdų šį klausimą spręsti.
