Social dialogue is usually seen as a tool, but it is much more than that; it is worth democratic culture. It is based on freedom and recognition of it by the State. This idea contrasts with more extreme views ranging from self-regulation by the market to authoritarianism. While there is a valuable legal and dogmatic instrumental, dialogue, it depends primarily on the type and degree of democratic culture and then; a set of factors that influence their development. This document explains the different approaches and conditions, there are plenty of examples where pragmatism arises out of conviction or for convenient routine, or forced call, but in any case; it is indicative of progress and good results for the countries that tested. ; El diálogo social es visto normalmente como una herramienta, pero es muchomás que eso: es un valor de la cultura democrática. Se basa en la libertady en el reconocimiento que de ella hace el Estado. Esta idea se contrapone aconcepciones más extremas que van desde la autorregulación por parte delmercado hasta el autoritarismo. Si bien existe un instrumental jurídico y dogmáticovalioso, el diálogo, este depende primero del tipo y grado de culturademocrática y luego de un conjunto de factores que influyen en su desarrollo.El presente documento explica sus diferentes enfoques y condiciones, aprovechandola existencia de ejemplos en donde surge por convicción o pragmatismo,por conveniente rutina, o forzada convocatoria, pero en cualquier caso essigno de progreso y de buenos resultados para los países que lo ensayan.

International audience ; Der vorliegende Artikel untersucht, ob und wie der Sozialdialog die Sparpolitik in der französischen Kommunalverwaltung beeinflusst hat, und befasst sich dabei vorrangig mit den Gemeinden. Hinsichtlich der Beschäftigten in den Kommunalverwaltungen findet der soziale Dialog auf zwei Ebenen statt. Die Löhne und die allgemeinen Regelungen werden auf nationaler Ebene erörtert, während die Arbeitsbedingungen und Fragen zur individuellen beruflichen Laufbahn auf der lokalen Ebene verhandelt werden. Zu den Sparmaßnahmen auf landesweiter Ebene gehören – wie in zahlreichen anderen Ländern auch – einseitig beschlossene Lohnstopps. In der staatlichen Verwaltung ist es zwar bereits zu Personalabbau gekommen, bisher sind die Kommunen davon jedoch (noch) nicht betroffen. Unsere Fallstudie zeigt, dass es bei Sparmaßnahmen wie Einschränkungen des Dienstleistungsangebots und Umstrukturierungsmaßnahmen zu echten Verhandlungen kommt, einschließlich der Lösung von Konflikten und formalisierter Vereinbarungen. Auch wenn diese Auseinandersetzungen nicht zu formellen Tarifverträgen führen, stärken sie doch die Rolle der offiziellen Ausschüsse und weisen auf die potenziellen Stärken des sozialen Dialogs in unmittelbarem Schulterschluss mit den Entscheidungsinstanzen und den betroffenen Bürgern hin. ; This article investigates whether and how social dialogue has influenced austerity policies in French local government, with a particular focus on municipalities. With regard to local government staff, social dialogue takes place at two levels, with wage and general rules being discussed at national level and working conditions and individual career issues at local level. National-level measures, as in many countries, have included unilateral wage freezes. However, though staff reductions have already occurred in the state administration, they have not (yet) affected municipalities. As seen in our case study, when it comes to local-level austerity measures such as cuts in services and restructuring measures, we are witnessing a situation of real bargaining – including conflict and formalized agreements. Even if not leading to official collective agreements, this strengthens the role of formal committees and suggests the potential resilience of social dialogue linked to the proximity of decision-making authorities and affected citizens. ; Cet article examine si et comment le dialogue social a influencé les politiques d'austérité au sein des pouvoirs locaux français, en particulier des municipalités. S'agissant des fonctionnaires locaux, le dialogue social est mené à deux niveaux: les salaires et les règles générales sont discutés au niveau national, alors que les conditions de travail et les questions liées aux carrières individuelles le sont au niveau local. Comme dans de nombreux pays, les mesures adoptées au niveau national comprennent un gel unilatéral des salaires. Mais si des réductions de personnel ont déjà eu lieu dans l'administration publique, elles n'ont pas (encore) touché les municipalités. Comme le montre notre étude de cas, quand il s'agit de mesures d'austérité au niveau local, comme des réductions de service et des mesures de restructuration, nous observons une situation de véritables négociations comprenant des conflits et des accords formalisés. Même sans déboucher sur des accords officiels, cette situation renforce le rôle des comités formels et suggère une résilience potentielle du dialogue social, liée à la proximité entre les autorités qui prennent les décisions et les citoyens affectés.

In 1998, the European Commission decided to institutionalize European sectoral social dialogue (ESSD) committees under a new harmonized form. As of 2010, there are 40 sectors with a sectoral committee. A recent Commission assessment suggested that there is a direct correlation between the effectiveness of ESSD and that of social dialogue on a national level. This article analyses in greater detail the relationships between the European committees and national-level social partners, showing that these relationships play a decisive role in the ability of ESSD to work efficiently. The article examines four dimensions of this 'vertical coordination': the representativeness of the European social partners; the Europeanization of interests; national players' involvement in the ESSD committees and, finally, the implementation of joint texts. As these four dimensions are by no means autonomous, the article briefly examines their interaction in its last section, showing that this can fuel either a vicious circle hindering ESSD or, by contrast, a virtuous circle facilitating it.
The article discusses the issues of the formation of social dialogue in Ukraine in the context of the need for further scientific research to form the doctrine of social dialogue. Evaluating the achievements of the modern science of labour law in the field of social dialogue, it can be stated that there is no research into the ideas of social dialogue, the prerequisites for their emergence, analysis of the factors contributing to their emergence and development, the evolution of social dialogue on the territory of Ukraine, analysis of the concept of social dialogue as an element of the formation of social and labour relations.First of all social dialogue until its own age and become "the basis and change of mind to accept any government decisions in the country, but also from economic and social changes in Ukraine", it is necessary to go through an, discovering clearances and openings of nobles and usunions, advancing international information, scientific advice of all elements of social dialogue. In order to accelerate these processes, the need for the activation of scientific advances in this region, some examples of the implementation of any institutes, as not to blame the science of science, is doomed to failure. ; У статті розглядаються питання становлення соціального діалогу в Україні в контексті необхідності проведення подальших наукових досліджень для формування доктрини соціального діалогу. Оцінюючи досягнення сучасної науки трудового права в сфері соціального діалогу, можна констатувати відсутність комплексних досліджень ідей соціального діалогу, передумов їхнього виникнення, аналізу факторів, що сприяють їхній появі та розвитку, еволюції соціального діалогу на території України, аналізу концепції соціального діалогу як елементу становлення соціально-трудових відносин

The article presents the different reasons why social dialogue is important in the current EU enlargement process. First because of developments of social dialogue at the Community level, described in the first section, from its establishment in the Treaty of Rome, to Delors' Val Duchesse initiative in the mid-1980s to the new rights for the social partners under the Amsterdam treaty and the new 'macroeconomic dialogue'initiated at the Cologne Economic Summit in 1999. Second, because social dialogue is clearly part of the current legal and institutional acquis, implying important responsibilities for the social partners. The third section discusses the implications for the social partners in the candidate countries. In particular they are called upon to play a more active role in their respective country's accession negotiations, to support implementation of the acquis 'on the ground', and to prepare themselves for participation in European social dialogue. Currently, collective bargaining institutions at both enterprise and supra-enterprise level remain underdeveloped in the CEECs, placing a question mark over implementation of some aspects of the acquis. Social dialogue is an important part of the acquis communautaire, and substantial efforts on the part of governments and the social partners in the candidate countries will be required prior to accession.

This article reviews recent developments in social dialogue demonstrating that consultation between government and key stakeholders contributes to labour peace, social stability and national development. After defining the stages through which social dialoguehas developed, the author explains the various ways in which it contributes to economic and social development. He considers four developing countries (Barbados,Indonesia, Kenya and Panama), and one transition economy (Czech Republic), examining how they have used tripartite institutions to achieve social peace, labour market adjustment and socio-economic development. Finally, he offers a model to integrate "new" actors into the tripartite framework for social dialogue. (International Labour Review / FUB)
