"In Aligning Religious Law and State Law: Negotiating Legal Muslim Marriage in Pasuruan, East Java, Muhammad Latif Fauzi investigates the extent to which the Indonesian state has regulated Muslim marriage and how a local community in Pasuruan, East Java has dealt with the regulation and gets their marriages recognised by the state. Instead of reforming the marriage law which would only stir up controversies, the Indonesian government has used a citizens' rights approach to control marriage to guide people towards compliance with the state legal framework. The state officials in charge of marriage registration on the frontier levels are amenable to adopting a lenient approach towards regulations on marriage, which is the key to securing the functioning of state law"--

Mit dem Vertrag von Lissabon wurde erstmals ausdrücklich eine kriminalstrafrechtliche Rechtsetzungskompetenz der Europäischen Union in Art. 83 AEUV eingeführt, die auf Grundlage der zuvor geltenden Verträge aufgrund der Aussparung des Themas Strafrecht stark umstritten gewesen war.Das Werk stellt umfassend die Rechtslage hinsichtlich strafrechtlicher Kompetenzen der Europäischen Union - unter Berücksichtigung entsprechender EuGH-Rechtsprechung - und nach Inkrafttreten des Vertrags von Lissabon dar. Die hieraus folgenden tatsächlichen Veränderungen werden herausgestellt. Hierzu werden die Voraussetzungen und der Umfang der derzeit bestehenden Kompetenz dezidiert herausgearbeitet. Schließlich werden mögliche Kollisionen mit dem auch auf EU-Ebene geltenden Demokratieprinzip und entsprechende Lösungsansätze aufgezeigt.Dem Leser wird damit zum einen ein umfassender Überblick über die Problematik verschafft und zum anderen eine vertiefte Auseinandersetzung mit dem Thema geboten

Over the past two centuries, the concept of human dignity has moved from the fringes to the centre of the international legal system. This book is the first detailed historical, theoretical and legal investigation of human dignity as a normative value, the intellectual sources that shaped its legal recognition, and the main legal instruments used to give it expression in international law. Ginevra Le Moli addresses the broad historical and philosophical developments relating to the legal expression of dignity and the doctrinal geography of human dignity in international law, with a focus on international humanitarian law, international human rights law and international criminal law. The book fills a major lacuna in the literature by providing a comprehensive account of dignity within international law that draws on an extensive documentary and archival basis and a vast body of decisions of international judicial and quasi-judicial bodies.
The authors in a scientific article considers the negative criminal liability in the context of varieties of branch legal liability. The main focus is on the study of norms of the Criminal Code of Ukraine and the Law of Ukraine «On Amending Certain Legislative Acts of Ukraine on the Simplification of Pre-trial Investigation of Certain Categories of Criminal Offenses» in order to compare the norms of these laws and highlight the most urgent issues that may arise in practice in the realization of forms of criminal liability. According to separate opinions, different stages of criminal offense are the back accentuation of attention to possible problems in the realization of negative criminal liability. When considering preparation for criminal liability, the author made a separate retrospective analysis of the preconditions for not prosecuting a crime subject (criminal offense). The emphasis is placed on the fact that the preconditions for not bringing the subject of a criminal offense to negative criminal liability will expand (increase) from one to two. The analysis of the provisions concerning such stages of a criminal offense as an attempt and a criminal offense under the above-mentioned Law of Ukraine shows that the subject of a criminal offense (convicted) in practice after the entry into force of this law will receive, as a mitigation in the implementation of forms of negative criminal responsibility and in certain cases, deterioration of their position due to the restrictions determined by law. ; Авторами в науковій статті розглянута негативна кримінальна відповідальність в розрізі різновидів галузевої юридичної відповідальності. Основна увага зосереджена на досліджені норм Кримінального кодексу України та Закону України «Про внесення змін до деяких законодавчих актів України щодо спрощення досудового розслідування окремих категорій кримінальних правопорушень» задля того, щоб порівняти норми цих законів та виділити найбільш актуальні питання які можуть виникнути на практиці в процесі реалізації форм кримінальної відповідальності. По окремості розглянуті різні стадії кримінального правопорушення задля акцентуації уваги на можливих проблемах в реалізації негативної кримінальної відповідальності по відношенню до особи, яка вчинила кримінальне правопорушення. При розгляді готування до кримінального правопорушення автором здійснено окремий ретроспективний аналіз розвитку передумов не притягнення до кримінальної відповідальності суб'єкта злочину (кримінального правопорушення). Акцентовано увагу на тому, що передумови не притягнення суб'єкта кримінального правопорушення до негативної кримінальної відповідальності розширяться (збільшаться) з однієї до двох. Аналіз положень з приводу таких стадій кримінального правопорушення як замах та закінчене кримінальне правопорушення згідно вказаного вище Закону України показує те, що суб'єкт кримінального правопорушення (засуджений) на практиці після вступу в дію даного закону отримає, як пом'якшення в реалізації форм негативної кримінальної відповідальності так і в певних випадках погіршення свого становища через ті обмеження які визначаються законом.

The article is devoted to the study and analysis of such areas of civil law as non-contractual structures, within the inheritance law of individual European Union countries, the emergence, development and implementation of such structures in regulations governing the inheritance procedures of countries such as Poland, Czech Republic, Republic of Lithuania and the Republic of Latvia. The purpose of the study in the monograph is a comprehensive analysis of the nature and specifics of legal and doctrinal bases of regulation and practice of non-contractual constructions in the inheritance law of individual EU countries (Poland, Czech Republic, Lithuania, and Latvia). As a result of the study the concept of non-contractual constructions of inheritance law is formed in the work. The types of non-contractual constructions, first of all their dialectical classification, architecture and place in the system of inheritance law are singled out and analyzed. An analysis of their identification and separation in different states, depending on the legal family, traces the integrity of the fundamental structure of knowledge about the obligatory rights of the testator within the will, heirs and beneficiaries in their biocentric expression and in the context of social ties. Emphasis is placed on rethinking and solving some problems in inheritance law, from the point of view of new world realities.
