Will international law colonize the last bastion of sovereign discretion? As a matter of traditional doctrine, international law has had little to say about the citizenship practices of states and the terms on which states determine the boundaries of their memberships. Through much of the Westphalian era, states have been essentially unconstrained with respect to who gets citizenship and on what terms. Historically, citizenship status has been considered a matter of national self-definition, jealously insulated more as a matter of reflex than justification. Nationality has been equated with identity, in most cases coinciding with ethnic, religious, or other sociocultural community markers, which, in turn, have more or less mapped onto territorial spaces.

Could World War I have been averted if Franz Ferdinand and his wife hadn't been murdered by Serbian nationalists in 1914? What if Ronald Reagan had been killed by Hinckley's bullet? Would the Cold War have ended as it did? In Forbidden Fruit, Richard Ned Lebow develops protocols for conducting robust counterfactual thought experiments and uses them to probe the causes and contingency of transformative international developments like World War I and the end of the Cold War. He uses experiments, surveys, and a short story to explore why policymakers, historians, and international relations scholars are so resistant to the contingency and indeterminism inherent in open-ended, nonlinear systems. Most controversially, Lebow argues that the difference between counterfactual and so-called factual arguments is misleading, as both can be evidence-rich and logically persuasive. A must-read for social scientists, Forbidden Fruit also examines the binary between fact and fiction and the use of counterfactuals in fictional works like Philip Roth's The Plot Against America to understand complex causation and its implications for who we are and what we think makes the social world work.

During the Cold War, international relations and international law were deeply shaped by the struggle for global dominance between the United States and the Soviet Union. The clashes between the superpowers reverberated in legal issues relating to the functioning of the United Nations, the use of force, nuclear nonproliferation, human rights, etc. The many newly independent states, caught in the middle, repeatedly made claims for reform and initiated rule-making initiatives, but with limited results. After the end of the Cold War, the United States, its Western allies, and their shared economic and geopolitical interests remained largely unchallenged in the international arena.

Die Parallelität der Souveränitätsfixierung der Nationalstaaten einerseits und der Internationalisierung von Wirtschaft und Verkehr andererseits hat zu einer Spannung geführt zwischen dem Interesse der Staaten, den zwischenstaatlichen Verkehr steuern und kontrollieren zu können, und der Notwendigkeit, sich im Interesse der eigenen Entwicklung für eine grenzüberschreitende Kommunikation zu öffnen. Dementsprechend ist es bis heute nicht gelungen, ein Prinzip der Freiheit des Verkehrs und eine daraus folgende generelle völkerrechtliche Pflicht der Staaten anzuerkennen, ihre innerstaatlichen Verkehrsnetze an die anderer Staaten anzuschließen. Jede Öffnung für den grenzüberschreitenden Verkehr geschieht vielmehr weiterhin freiwillig. Das vorliegende Werk arbeitet unter Berücksichtigung der daraus resultierenden Komplexität erstmals die internationale Verkehrsordnung (Landverkehr mit Kraftfahrzeugen und Eisenbahn sowie Verkehr zu Wasser und in der Luft) umfassend und zusammenhängend auf. »The International Legal Sytem of Transport« There is a tension between national sovereignty and globalization – also in the field of transport. States want to control transboundary transport. At the same time, there economic development depends on it. Therefore, a general freedom of transboundary transport does not exist. Instead, an international legal system of transport, consisting of a large number of treaties, developed. The present book gives a comprehensive overview over this complex field of international law.
