"There is no one way of writing the modern history of international commercial arbitration, but rather a "radical pluralism" of historical methods and approaches, several of which will be used in this book. Schematically, one could focus on the history of events, the history of concepts, or the history of individual people (there are indeed many well-known, as well as less known but no less fascinating, figures in the modern history of international arbitration). When it comes to concepts, one could trace the history of the notion of lex mercatoria or that of the arbitral legal order, for example. With regard to events, one could explore narrow timescales, focusing, for example, on a few key events and explaining how they led to the present state of international commercial arbitration. This approach - which some might call histoire événementielle or event-based history, with its "brief, rapid, nervous fluctuations" - views history as closely tied to specific events. Applied to the study of international arbitration, it would focus on a few relevatory moments that led to the current state of affairs. For example, the genesis of the New York Convention was a seminal moment and turning point in the modern history of international commercial arbitration. Participants from a wide range of national, cultural, and legal backgrounds gave detailed thought to the role that individual states should play in the modern international arbitration compact. Den meisten Steuersystemen liegt als Leitgedanke zwar ein synthetischer Einkommensbegriff zu Grunde, doch resultiert aus den Gesetzesvorschriften regelmäßig eine faktische Schedulierung des Einkommens. Systematisch fragwürdig wird eine solche Schedulierung dann, wenn die vorgenommene Differenzierung keinen klaren Abgrenzungsregeln folgt. Dies schafft nicht nur Rechtsunsicherheit, sondern auch Akzeptanzprobleme, mit denen Steuergestaltungs- bzw. -umgehungsüberlegungen einhergehen können. Fokus dieser Arbeit ist die Unternehmensbesteuerung, die von der unsystematischen Behandlung besonders stark betroffen ist, da oft einzelne Komponenten im Rahmen des internationalen Steuerwettbewerbs einer wettbewerbsfähigen Sonderbehandlung unterzogen werden. Als unternehmerische Tätigkeit kann nationalen und internationalen Abgrenzungen zufolge jeder Kapital- und/oder Arbeitseinsatz zur selbständigen Erwirtschaftung von Einkünften gewertet werden. Hier stellt sich die Frage, ob und inwieweit die Besteuerungspraxis vor dem Hintergrund der internationalen Entwicklungen das synthetische Ideal in einem Gesamtkonzept noch verwirklichen kann. Überprüft werden daher auch Möglichkeiten einer steuerlichen Differenzierung, falls eine durchgängige Gleichbehandlung ausscheidet. Entscheidend für ein gegenüber dem Status Quo vorzugswürdiges Besteuerungsmodell sind neben der Vereinbarkeit mit den Anforderungen des Gemeinschaftsrechts auch Umsetzungskonsequenz, internationale Praktikabilität und Wettbewerbsfähigkeit. Im Rahmen der vorliegenden Arbeit werden verschiedene Konzepte der Unternehmensbesteuerung untersucht. Dies sind zum einen die Grundmodelle personaler und institutioneller Besteuerung sowie hochaktuelle Reformvorschläge (Kirchhof-Modell, Kölner Entwurf, Konzepte einer dualen Unternehmensbesteuerung des Sachverständigenrates), zum anderen aber auch existente Ländersysteme (Frankreich, Österreich, Schweden, Finnland und Norwegen), die aufgrund interessanter Ansätze Vorbildcharakter für die Systemneukonzeption entfalten können.

Un nouvel enjeu international : le Balouchistan ? par Selig S. Harrison
L'occupation soviétique de l'Afghanistan a révélé aux Occidentaux l'importance stratégique du Balouchistan : si la zone côtière du territoire national baloutche tombait sous l'emprise des Soviétiques, ceux-ci pourraient contrôler la mer d'Oman et le détroit d'Ormuz, ce qui modifierait profondément l'équilibre militaire de la région. Les dirigeants pakistanais et iraniens, sans exclure l'hypothèse d'une intervention directe de Moscou dans la région, redoutent un éventuel soutien technique et militaire des Soviétiques au mouvement nationaliste baloutche dans le but d'obtenir l'utilisation des ports baloutches à des fins militaires. Les dirigeants du mouvement national baloutche, se heurtant à l'hostilité traditionnelle des Panjabis et l'intransigeance de Zia au Pakistan et rejetés par la nouvelle Constitution iranienne, explorent les perspectives possibles d'aide étrangère (que ce soit celle de l'Union soviétique, de la Chine, des Etats-Unis, de l'Inde ou du monde arabe...) et encouragent les groupes nationalistes en Iran et au Pakistan à s'organiser en vue d'une éventuelle reprise de l'insurrection. Ce mouvement national, qui a acquis une force indépendante au cours d'une histoire sanglante jalonnée de luttes pour la survie pendant plus de 2000 ans, suscite néanmoins une attitude de réserve de la part de Moscou : les stratèges soviétiques conviennent que le nationalisme baloutche connaît un regain mais ne le jugent pas encore mûr... D'autre part, leur prudence est fondée sur une appréciation globale des perspectives à court terme en Iran et au Pakistan.
