Цель: определение этапов механизма досудебного принятия обвинительного заключения и выявление основных ошибок, допускаемых при принятии обвинительного заключения, предложение способов их устранения.Методы: логический, сравнительно-правовой, нормативно-логический и статистический, а также метод комплексного изучения явлений и процессов правовой действительности.Результаты: в рамках предложенного механизма досудебного принятия обвинительного заключения, а также на основании проведенного анализа 45 обвинительных заключений и расписок об их получении по различным категориям дел выявлены часто встречающиеся ошибки субъектов уголовно-процессуального права, участвующих в механизме составления и принятия обвинительного заключения. Среди них: наличия клякс, подчеркиваний и помарок в тексте обвинительного заключения; несоответствие обвинительного заключения обвинению, изложенному в постановлении о привлечении в качестве обвиняемого; путаница с вопросом согласования руководителем следственного органа обвинительного заключения и т.д. Поэтому в работе предлагается дополнить ч. 1 ст. 39 УПК РФ пунктом 9.1. «Согласовывать обвинительное заключение после его подписания следователем», увеличить срок предварительного следствия и выделить на согласование обвинительного заключения дополнительные дни, ввести в практику встречи всех субъектов уголовного процесса, задействованных в механизме принятия обвинительного заключения, в целях анализа качества и полноты расследования, характерных следственных ошибок и нарушений уголовно-процессуального законодательства.Научная новизна: в результате проведенного исследования определены часто встречающиеся ошибки, возникающие при принятии обвинительного заключения, начиная с момента окончания предварительного следствия с обвинительным заключением до принятия уголовного дела с обвинительным заключением судом, а также сформулированы предложения по их недопущению.Практическая значимость: основные положения и выводы статьи могут быть использованы в научной и педагогической деятельности, при рассмотрении вопросов, касающихся механизма составления и принятия обвинительного заключения.Objective: to determine the stages of the mechanism of pre-trial adoption of indictment, to identify the main mistakes made when making an indictment, and offer ways of their elimination.Methods: logical, comparative-legal, normative-logical and statistical, as well as the method of complex study of phenomena and processes of legal reality.Results: within the framework of the proposed mechanism of pre-judicial indictment adoption, and basing on the analysis of 45 indictments and their receipts in various categories of cases, the common errors were identified of the subjects of criminal procedural law involved in the mechanism of indictment preparation and adoption. These include: the presence of smudges, underlined places and erasures in the text of the indictment; the discrepancy between the indictment and the charges set out in the resolution on impleading of a defendant; confusion referred to the approval of the indictment by the head of the investigative body, etc. Therefore, it is proposed to supplement Part 1 of Article 39 of the Russian Criminal-Procedural Code with paragraph 9.1. "To agree on the indictment after its signing by the investigator", to extend the term of preliminary investigation and to assign additional days for the indictment approval, to put into practice the meeting of all actors of the criminal process involved in the mechanism of the indictment adoption, in order to analyze the quality and completeness of the investigation, typical investigation errors and violations of criminal-procedural legislation.Scientific novelty: as a result of the study, frequent errors arising from the adoption of the indictment were identified, occurring since the end of the preliminary investigation with indictment till the adoption of the criminal case with the indictment by the court; suggestions on avoiding them were formulated.Practical significance: the main provisions and conclusions of the article can be used in scientific and teaching activities, in addressing the issues related to the mechanism of the indictment preparation and adoption.

RESUMEN The arguments on the basis of which the judges of the Colombian Constitutional Court supported the solution to the problem of whether enhanced stability is limited to persons who have lost their ability to work and are incorporated into the world of work under an employment contract are described; the arguments on the basis of which the Court's magistrates justified their response to the case as to whether the infringement of enhanced stability entails the application of the benefits laid down in Law 361 of 1997 even in the context of the provision of a service and without the worker being classified as a loss of capacity for work are presented; it is concluded that, in the SU-049 of 2017 judgment, those magistrates updated the scope of the right to enhanced stability in accordance with constitutional principles of equality, solidarity, dignity and protection of the various forms of work, granting compensation of 180 days' salary and reimbursement by the worker regardless of the possession of the certificate certifying the loss of capacity to work or the form of contractual relationship. Considering the development of civil society as the driving force of the reform of the civil (public) service as a personalized basis for ensuring public administration in various spheres of social and political activity, in this study, the civil service is characterized by the prism of its implementation in the national defense sector. Analyzing the current domestic and foreign legislation, the following features of the civil service were distinguished: the two levels – the internal (staffing of the service) and the external (tasks and functions in the national defense sector); connection with militarized service; a supporting role in the implementation of the main tasks by specially authorized actors (their officials), etc. The legal regulation of the civil service in the national defense sector of Ukraine is characterized by dualism, which consists in regulating the issues of its passage in two directions: the general (Law of Ukraine «On Civil Service») and the special (for example, the Law of Ukraine «On Prosecutor's Office»). Particular attention during the study is given to foreign experience in this field, based on comparison of such service in Ukraine and Lithuania. Such dualism is inherent in the legal regulation of civil service in the system of national defense of Lithuania. In addition, both in Ukraine and in Lithuania, it plays a very important role for the implementation of an effective defense policy of the state. With radical comparative analysis of regulatory and legal bases, the imperfect legal regulation of relations that arise in this area in Ukraine has become apparent. National legislation on civil service in the national defense sector needs improvement by supplementing the Law of Ukraine «On Defense of Ukraine» with the provisions on civil service in the field of defense and, in connection with this change, other normative and legal acts in this area require the bringing in of conformity. Proper legal consolidation in Ukraine also requires the administrative and legal status of civil servants of the defense industry and the status of citizens and public associations that voluntarily participate in the provision of national security and defense. Establishing in Ukraine at the legislative level of a clearly defined notion of «civil service in the field of national defense» will, to a certain extent, help to regulate relations in the course of such service and avoid problems in law enforcement practice. ; Дане дослідження охарактеризовує цивільну службу крізь призму її здійснення у секторі національної оборони, виокремлюючи наступні її особливості з огляду на специфіку відповідної сфери та на основі аналізу вітчизняного та зарубіжного законодавства: цивільна служба у секторі національної оборони як публічна професійна діяльність поєднує два рівні: внутрішній (організаційний) – кадрові питання проходження служби; зовнішній (правозастосовний) – виконання завдань і функцій у секторі національної оборони; вона нерозривно пов'язана з мілітаризованою службою та часто покликана виконувати забезпечувальну роль щодо втілення основних завдань спеціально уповноваженими суб'єктами (їх посадовими особами). Слід враховувати також те, що правове регулювання цивільної служби у секторі національної оборони України характеризується дуалізмом, що полягає у регулюванні питань її проходження у двох напрямах: загальному (Закон України «Про державну службу») та спеціальному (наприклад, Закон України «Про прокуратуру»). Особливу увагу приділено закордонному досвіду в цій сфері (Литва). Як в Україні, так і в Литві цивільна служба відіграє досить важливу роль для здійснення ефективної оборонної політики держави. При докорінному порівняльному аналізі нормативно-правових баз очевидним стало недосконале правове регулювання відносин, що виникають у цій сфері в Україні. Доведено потребу удосконалити вітчизняне законодавство у сфері цивільної служби у секторі національної оборони шляхом доповнення Закону України «Про оборону України» положеннями щодо цивільної служби у сфері оборони і привести у відповідність інші нормативно-правові акти в цій царині. Належного правового закріплення в Україні вимагають і адміністративно-правовий статус державних службовців сфери оборонно-промислового комплексу, статус громадян і громадських об'єднань, що добровільно беруть участь у забезпеченні національної безпеки та оборони. This paper connects in a preliminary way realms of analysis and data regarding practices of disseminating Japanese literature and writing translated in English and Association of Southeast Asian Nations (ASEAN)–located languages since about 2000. The assumption is that translations from different languages have been consistently silo'ed – separated and allowed to accumulate and dynamically evolve. I outline a history of the de-linking of 'writing' from 'literature' as well as language study itself, which has led to both a withdrawal and an explosion of funding since about 1990. I note secondary effects of re-concentration in English and European languages, a flourishing of small-press activity and writing on food (Jonathan Gold) and self-help (Kondo Marie), and a focus on the 'authorised translator' model in both English and ASEAN languages following a tendency to standardise copyright law. Second, I introduce some histories and distinctive practices that could model support for translators. Last, I discuss economies of both money and prestige in different practices, and offer some suggestions based on interviews with an eye to supporting translators so that all languages have a hand in creative practice, and English-language–based translators can collaborate with translators in other languages.

The subject. The modern world is constantly changing, which makes it necessary to update the means and methods of legal regulation of public relations. Moreover, these relations themselves are changing, new areas of public relations are emerging, for which it is necessary to create a legal framework. The sphere of financial and legal regulation is no exception. The most important issue, which has been on the agenda of the international community for several years, is the development of the digital economy. The legal realities of digitalization largely determine what place the Russian economy will occupy in the emerging global digital market. It is necessary to develop a comprehensive legal concept that allows ensuring compliance with the fiscal interests of the state in the context of digital transformation. In this regard, the transformation of tax relations and their legal regulation is particularly important.Purpose of the study. The article is devoted to the transformation of the legal regulation of tax relations in the digital economy. In order for Russian financial and legal regulation to contribute to an effective response to the challenges posed by digitalization, it is necessary to develop a comprehensive legal concept that allows ensuring compliance with the fiscal interests of the state in the context of digital transformation. In this regard, the transformation of tax relations and their legal regulation is of particular importance.Methodology. The research was carried out with the application of the formally legal interpretation of legal acts as well as the comparative analysis of Russian and European legal literature. Structural and systemic methods are also the basis of the research. The main results. The necessity to develop legal solutions in the field of taxation of the digital economy is determined by the focus on legal support for the stability of financial and legal regulation and the principle of certainty of taxation. In these circumstances, it is important to implement the control function of financial law. The need to ensure compliance with the fiscal interests of the state, both at present and in the long term, requires the transformation of essential approaches to the legal regulation of the system of taxes and fees, the principles and elements of taxation, tax administration and tax control. In this regard, it is proposed to provide for special rules for calculating and paying income tax on foreign digital companies and, in parallel, to expand tax incentives for Russian companies.Сonclusions. The authors come to the conclusion that the actual scientific task is to develop a methodological position on the directions of reforming the national tax legislation and the international tax doctrine of the Russian Federation in the context of the digital transformation of public relations. According to the results of the study, it is concluded that it is necessary to ensure compliance with the fiscal interests of the state. This requires the transformation of essential approaches to the legal regulation of tax relations, both in the context of determining the appropriate legal forms for regulating the tax base levied in Russia in the context of the emerging digital economy, and for influencing international tax policy in order to use all the advantages provided by international tax cooperation and neutralize the threats caused by international tax competition. ; Рассматривается трансформация правового регулирования налоговых отношений в условиях цифровой экономики. Актуальной научной задачей объявляется выработка методологической позиции относительно направлений реформирования национального налогового законодательства и международной налоговой доктрины Российской Федерации в условиях цифровой трансформации общественных отношений. По итогам исследования делается вывод о необходимости обеспечения соблюдения фискальных интересов государства, что требует трансформации сущностных подходов к правовому регулированию налоговых отношений как в контексте определения надлежащих правовых форм для регламентации налоговой базы, облагаемой в России, в условиях формирующегося цифрового уклада экономики, так и для воздействия на международную налоговую политику с целью использования всех преимуществ, предоставляемых международной налоговой кооперацией, и нейтрализации угроз, вызываемых международной налоговой конкуренцией. В этой связи предлагается предусмотреть специальные правила исчисления и уплаты налога на прибыль иностранных цифровых компаний и параллельно расширять меры налогового стимулирования российских компаний.

This report's starting point is thus to acknowledge that despite Sweden's many virtues, there are areas in which it can do better, and the task has been to identify those areas, focusing particularly on the quality of the investment climate and competitiveness. This has been done in two main ways. First, by looking at areas of the business environment captured by databases compiled in the World Bank Group's Global Indicators Group—Doing Business, Foreign Direct Investment (FDI) Regulations, and Women, Business and the Law. And second, by examining other critical areas where there is a large body of data, knowledge and insight that casts relevant light on several key policy challenges facing the country in coming years. In the paragraphs that follow we present a summary of the report's main conclusions.

All politics is local. This is the title of the book that describes the political trajectory of Democrat Tip O'Neill, the only US politician to serve consecutively during five legislatures (1977-1987) as Speaker of the US House. In his political biography, O'Neill says he heard from his father, "All politics is local. Don't forget that." when he lost the first election he ran for. His father could not have been more correct. Political participation and influence, as well as coming to power, exercising, and maintaining it depend on articulations and human relationships established at the local level, whether represented by a house, an office, a family, a neighborhood, or a city.

Während der Strafvollzug in Gefängnissen in Deutschland nach wie vor als nicht privatisierbarer Kernbereich staatlicher Aufgaben gilt, wurde der damit eng verwandte psychiatrische Maßregelvollzug (MRV), also die Unterbringung schuldunfähiger oder gemindert schuldfähiger Straftäter in psychiatrischen Kliniken zur "Besserung und Sicherung", in den letzten 10 Jahren in Deutschland in 6 von 16 Bundesländern funktional privatisiert, d.h. in die Hände privater Betreiber übergeben, und in weiteren 3 formell privatisiert, ohne dass dies von einer breiteren Öffentlichkeit bemerkt worden wäre. Der Beitrag beschreibt zunächst diese heikle Staatsaufgabe, gibt dann einen Überblick über die bislang erfolgte Privatisierung und skizziert schließlich weitere politikwissenschaftliche Forschungsperspektiven, die sich zum einen mit den Ursachen für die Privatisierung (und für die erheblichen Unterschiede zwischen den Bundesländern in der Privatisierungspolitik) und zum anderen mit den Folgen der Privatisierung befassen.

This article argues that in Colombia, decentralization and electoral reforms adopted in the late 1980s and in the 1991 Constitution – designed to improve democratic quality – brought about a gradual deinstitutionalization of this country's traditional party system as an unintended consequence. Building upon resource-based theories of party configuration, we contend that in developing countries, where resources are usually crucial for party aggregation, "democratizing" reforms designed to distribute power and resources in the political system can reduce local candidates' incentives to join and remain loyal to political parties, particularly when those parties' reputations are weak. In Colombia, these reforms (i) reduced the power of intermediate-level party leaders over the distribution of selective incentives, making these leaders less important for local politicians, and (ii) gave more political and financial autonomy to local candidates, reducing their need to join parties in order to advance their electoral goals. As a result, party cohesion and discipline become difficult to maintain, and the party system gradually deinstitutionalizes.

An analysis of the political economy of Israel during the 1990s.

This report aims at identifying the particular needs and constraints faced by the poorest women and men when accessing the judicial system. Similarly to the Judicial Functional Review,6 the scope of this report focuses primarily on the courts because they are the main vehicle for justice service delivery and the primary institutions of justice in Serbia. The scope includes all types of services and covers litigious and non-litigious aspects of civil, commercial, administrative, and criminal justice. The focus is on the actual implementation and day-to-day functioning of the sector institutions that deliver justice to people, rather than the law on the books . The scope includes other institutions in the sector to the extent that they enable or impede service delivery by the courts, including: the Ministry of Justice (MOJ), the High Judicial Council (HJC), the State Prosecutorial Council (SPC), the courts, the Public Prosecutor Offices (PPOs), the Judicial Academy, the Ombudsperson s Office, the police, prisons, and justice sector professional organizations (such as the Bar, notaries, bailiffs, and mediators). The focus of this report is on access to justice services, including relevant financial, informational, and geographic barriers to such access.
