The purpose of this book is to provide an easy access to and overview of the case law of the ECJ (the Court of Justice of the European Union, previously Court of Justice of the European Communities) pertaining to private international law. The book contains edited extracts from all ECJ decisions of immediate private international law relevance made before 1 January 2012. Most of the cases are important for the interpretation and understanding of the numerous existing European regulations and directives dealing with private international law, but cases affecting the interpretation of the EU Treaties are also included

International courts and tribunals now operate globally and in several world regions, playing significant roles in international law and global governance. However, these courts vary significantly in terms of their practices, procedures, and the outcomes they produce. Why do some international courts perform better than others? Which factors affect the outcome of these courts and tribunals? The Performance of International Courts and Tribunals is an interdisciplinary study featuring approaches, methods and authorship from law and political science, which proposes the concept of performance to describe the processes and outcomes of international courts. It develops a framework for evaluating and explaining performance by offering a broad comparative analysis of international courts, covering several world regions and the areas of trade, investment, the environment, human rights and criminal law, and offers interdisciplinary accounts to explain how and why international court performance varies.
International information security: universal legal dimension

The article is devoted to the development of the system of legal support of international information security. A scientific understanding of the concept of international information security and the main threats in this area has been carried out. The strategic objectives and main directions of the state policy of the Russian Federation in the field of international information security are analyzed. The current state of the system of legal support of international information security and the main problems in this area are investigated. A systematic analysis of various approaches of states regarding the applicability of the norms and principles of current International Law to the ICT environment, the development and adoption of new rules, principles and norms related to security in the ICT environment. Of particular interest from the standpoint of International and national Law is the problem of voluntary and non-binding norms of responsible behavior of states in the ICT environment. The research conducted by the authors made it possible to scientifically substantiate conclusions from interdisciplinary positions regarding the priority vectors of the development of the system of legal support for international information security at the universal, regional and bilateral levels in the conditions of geopolitical confrontation of the leading world powers.
Critically Considering International Social Work Practica

Schools of social work in Canada and other countries of the North are increasingly offering their students the option of undertaking an international practicum. Often implied in this term is a placement in a Southern country. In this article I draw on a critical social work perspective, and the notion of the "encumbered self," to consider the ethics of international practica in the context of a larger movement in Canada and elsewhere towards short-term international postings of various kinds. In conclusion, I argue for not only substantive pre-practicum preparation, but a post-practicum curriculum that leads students to interrogate, rather than consolidate, their learning overseas.

Pour lutter contre le capitalisme financiarisé mondialisé et pour retrouver l'esprit du syndicalisme ouvrier international de la fin du XIX e siècle, la forme réticulaire apparaît particulièrement prometteuse. Elle permet en effet de contourner les obstacles organisationnels et politiques nationaux classiques, pour partager l'information et réagir de manière coordonnée à l'échelle internationale. À partir des exemples de combats menés depuis 2013 par le Réseau syndical international de solidarité et de luttes, Stéphane Enjalran de Solidaires évoque les potentialités de ces nouveaux moyens d'action. Il s'agit notamment de rendre visibles les abus des multinationales, de dénoncer la répression étatique et de diffuser des expériences d'alternatives au capitalisme.
Auf dem Weg zum Weltumweltrecht?: Tendenzen und Wirkungen der Verrechtlichung der internationalen Umweltpolitik

Im Bereich der internationalen Umweltpolitik gibt es heute (Stand 2004) mehr als 200 bedeutsame Vertragssysteme. Die Regelungsdichte nimmt dadurch zu, dass die Mitgliedsstaaten die Vertragssysteme im Licht neuer wissenschaftlicher Erkenntnisse sowie sich wandelnder ökonomischer und politischer Bedingungen weiter entwickeln. Der vorliegende Beitrag zeigt, dass und warum die Verrechtlichung in der internationalen Umweltpolitik nicht nur quantitativ, sondern auch qualitativ erheblich fortgeschritten ist. Untersucht wird weiterhin, wie sich die Verrechtlichungsprozesse erklären lassen und welche Konsequenzen sie im Hinblick auf eine wirksame Global Environmental Governance nach sich ziehen. Ein vergleichsweise hoher Grad an Transparenz und Öffentlichkeitsbeteiligung bei der Rechtsetzung im Umweltbereich unterstützt die Legitimation der Verfahren und Abkommen. Begrenzt werden die Verrechtlichungsprozesse vor allem durch das Beharrungsvermögen des von der Mehrzahl der Staaten entschieden verteidigten Souveränitätsprinzips. Als Folge ist den für die Rechtsprechung und Rechtsdurchsetzung verantwortlichen Ausschüssen zwar eine zunehmende, aber noch in keinem Fall eine vollständige politische Unabhängigkeit zugestanden worden. Außerdem bleiben die Möglichkeiten zur Autorisierung und Vollstreckung von Sanktionen im Allgemeinen beschränkt. Und schließlich ist auch der Grad der Konstitutionalisierung der internationalen Umweltpolitik gering. (ICA2)
The National Interest in International Relations Theory
Berbagai diskusi politik dewasa ini telah membangkitkan kembali sebuah konsep "klasik" dalam teori Hubungan Internasional (HI), yaitu "kepentingan nasional". Konsep ini menjadi kata kunci paling penting bagi penganut pendekatan realisme yang memang sangat percaya pada "kedaulatan negara" sebagai satu-satunya aktor/entitas dalam HI. Secara lebih luas, istilah "kepentingan nasional" juga terutama muncul dalam dokumen-dokumen kebijakan di berbagai kementrian, terutama Kementrian Luar Negeri dan Kementrian Pertahanan, serta menjadi salah satu doktrin yang memandu pelaksanaan politik luar negeri di banyak negara.Namun, secara konseptual istilah ini juga menyisakan pertanyaan penting: apa yang dimaksud dengan "kepentingan nasional" ini? Kendati sering sekali didiskusikan dalam teori HI kontemporer, pada dasarnya istilah ini masih dengan serius diperdebatkan.

This book enquires into the counter-hegemonic capacity of international criminal justice. It highlights perspectives and themes that have thus far often been neglected in the scholarship on (critical approaches to) international criminal justice. Can international criminal justice be viewed as a 'counter-hegemonic' project? And if so, under what conditions? In response to these questions, scholars and practitioners from the Global South and North reflect inter alia on the engagement with international criminal justice in the context of Ukraine, Palestine, and minorities in South-Asia while also highlighting the hegemonic tendencies built into the institutional structure of the International Criminal Court on the axes of gender and language.
