Wage theft is endemic among temporary migrants in Australia, including international students who are entitled to work up to 40 hours per fortnight on their student visa. This report responds to the need for empirical data on international students' responses to underpayment and other problems they encounter at work and potential effective interventions. It analyses findings from a nationwide survey of over 5,000 international students undertaken in 2019, addressing students' rates of participation in the labour market and their wages in their lowest paid job, considering how these vary among different student cohorts. It also considers the prevalence of other forms of underpayment and record-keeping failures, dismissal after complaint to their employer, accidents and injuries, sexual harassment and overwork. After examining information- and help-seeking among international students who experienced problems at work, the report identifies key reasons why most international students did not seek information or help. Finally, it evaluates international students' knowledge of their work rights and the prevalence of common misperceptions that may contribute to their acceptance or acquiescence to underpaid work. The report lays the foundation for education providers and government to develop more targeted interventions to address exploitation, that are evidence-based and directly respond to international students' lived experiences captured through the survey.

This article analyses the experiences of the International Committee of the Red Cross (ICRC) in Colombia, and has two main purposes: first, to elaborate on the relationship between international humanitarian law (IHL) and the practical work of the ICRC in internal armed conflict; and second, to use our enhanced understanding of that relationship to shed light on important questions regarding the nature and effectiveness of IHL with respect to non-State armed groups. It proceeds in three main parts. First, it provides background on the work of the ICRC to contextualise the subsequent analysis, establishing the importance of IHL in the work of the ICRC in general. Second, it shows that for the ICRC, IHL is a means to an end (namely protection) rather than an end in itself, and that it is not the only (or even necessarily the primary) means to that end. Third, it argues that the ICRC often finds that reference to IHL is counter-productive to achieving desired protection outcomes, and that this calls into question the adequacy and effectiveness of the IHL framework itself. Finally, it concludes by suggesting why the existing framework may be less than optimal for achieving its aims, and how future research could contribute to a more comprehensive assessment of the appropriateness and adequacy of existing IHL.

Studies of the International Law Commission of the United Nations have focused exclusively on the institutional level of analysis, contending that the Commission can best be understood by examining institutional factors such as the Statute of the Commission, the role of the General Assembly and the issues adopted by the Commission for consideration. Implicit in the literature is the assumption that Law Commission members function in a political vacuum, little influenced by the policies of home governments or events in the international arena. ; This dissertation seeks to examine external factors that influence the functioning of the Law Commission in its debate-oriented process of codifying international law. The theory advanced in this study posits that factors external to the Law Commission are influential in the Law Commission's progression towards consensus on legal issues. Two factors are examined: (1) regional blocs, and (2) the international environment, conceptualized in terms of the imposition of the cold war and its end. As such, this study fills an existing gap in the literature and challenges the core assumptions of the literature. ; The case study for examining the role of external factors in the Law Commission is the Draft Code of Crimes Against the Peace and Security of Mankind. The case selection is considered optimal because it incorporates multiple legal issues (including genocide, mercenarism, colonial domination, apartheid, economic aggression and statute of an international tribunal), rendering its findings more generalizable and less topic bound than other Law Commission issues. The case study is of interest, as well, due to the dramatic rise in calls for the prosecution of alleged war criminals, a process contingent on the Draft Code. ; A data base is constructed from Law Commission debate, from which content analysis is undertaken. Ten hypotheses test the relationship between Law Commission debate and factors external to the Commission. AbstractTo reach agreement, international negotiators often compromise by using flexible language: they make controversial provisions vague, or add options and caveats. Does flexibility in agreement language influence subsequent state behavior? If so, do states follow both firm and flexible language somewhat, as negotiators hope? Or do governments respond strategically, increasing their energies on firmly specified tasks, and reducing their efforts on flexibly specified ones? Testing theories about agreement language is difficult because states often reserve flexible language for controversial provisions. To make causal claims, we study an unusually drafted agreement in which states had almost no opportunity to dilute agreement language. We examine the influence of the 1991 Paris Principles on the Design of National Human Rights Institutions (NHRIs), using an original data set of twenty-two institutional safeguards of NHRIs in 107 countries, and case studies. We find that variations in agreement language can have large effects on state behavior, even when the entire agreement is nonbinding. Both democracies and authoritarian states followed the principles' firm terms closely. However, authoritarian states either ignored or reduced their efforts on flexibly specified tasks. If flexibly specifying a task is no different from omitting it altogether, as our data suggest, the costs of compromise are much greater than previously believed.

Zusammenfassung
Als Staats- und Regierungsform ist die liberale Demokratie bereits seit einiger Zeit herausgefordert, von innen und von außen. Russlands Überfall auf die Ukraine wurde vom Niedergang der liberalen internationalen Ordnung und von der Schwäche ihrer Führungsmacht USA ermuntert. Vor diesem Hintergrund weckte die von Bundeskanzler Olaf Scholz am 27. Februar 2022 verkündete "Zeitenwende" große Erwartungen. Sie schien als Paradigma für die postliberale Weltordnung geeignet, zumal der Kanzler sie kurz darauf zu einer "Global Zeitenwende" ausbaute. Unglücklicherweise wird sie ihnen jedoch nicht gerecht. Die Herausforderung besteht nicht darin, eine künftige multipolare Weltordnung zu steuern und der EU darin einen der vorderen Plätze zu sichern. Das drängende Problem besteht vielmehr in dem sich entwickelnden weltumspannenden Systemkonflikt zwischen revisionistisch orientierten Autokratien und Demokratien, die eine regelbasierte internationale Ordnung aufrechterhalten wollen. Der historische Vergleich mit der Zwanzigjährigen Krise von 1919 bis 1939 legt nahe, dass es dazu eines "demokratischen Antirevisionismus" bedarf.
Die Debatte über einen vermeintlichen globalen Währungskrieg ist durch die sehr expansive Geldpolitik vieler Industrieländer wieder aufgeflammt. Denn diese Politik führt zu Währungsabwertungen und damit tendenziell zu einer Verbesserung der internationalen preislichen Wettbewerbsfähigkeit einer Volkswirtschaft relativ zu ihren Wettbewerbern. Aus diesem Grund wiederholte der brasilianische Finanzminister Guido Mantega schon im Herbst 2012 - anlässlich des dritten Aufkaufprogramms für Staatsanleihen der US-Notenbank - seinen schon im September 2010 erhobenen Vorwurf eines globalen Währungskrieges. Jüngst hat der Schwenk des neuen japanischen Notenbankchefs Haruhiko Kuroda hin zu einer extrem expansiven Geldpolitik international viel Kritik auf sich gezogen - aus den USA und von der Europäischen Zentralbank (EZB) ebenso wie von der russischen Notenbank. In der Folge fand sich das Thema Währungskrieg auch auf der Agenda der jüngsten Tagungen der G7- und G20-Staaten. Aus Frankreich kamen im Zuge dieser Debatte bereits Forderungen nach einer aktiven Wechselkurspolitik für Europa. Dieser Beitrag hinterfragt die These vom Währungskrieg und nimmt dazu die Währungsrelationen zwischen den großen Industrieländern in den Blick.

Der Beitrag zum übergeordneten Thema des Niederschlags extremer Ideologien in den Diskursen, Visionen, Programmen und propagandistischen Bemühungen extremistischer Organisationen setzt sich mit dem Internationalen Islamistischen Terrorismus auseinander, der auch in Europa eine Gefahr darstellt. Der Autor geht der Frage nach, welche Gefahren diese Bedrohung hervorrufen und an welchen Merkmalen sie festzumachen sind. Ausgehend von den Erfolgskennzeichen verschiedener Terrorismus-Formen wird ein Analyseraster entwickelt, mit dessen Hilfe die Gefahren des Internationalen Islamistischen Terrorismus beschrieben und ergänzt werden. Die Analyse stellt dabei auf vier Variablen ab: (1) Akteure, (2) Ideologie, (3) Bezugsgruppe und (4) Rahmenbedingungen. Das Ergebnis ist ein Gefahrenbild, das sowohl die Gefahr der Gewalt als auch die der Durchsetzung politischer Forderungen des Islamismus berücksichtigt. Schwerwiegende Gefahren ergeben sich zudem durch die starke Einbindung Deutschlands in europäische, transatlantische und globale Prozesse und Strukturen. Die Bundesrepublik ist herausgefordert, in einem demokratischen Prozess den Werten der Sicherheit und der Freiheit entsprechende Problemlösungsstrategien zu entwickeln. (ICG2)

"Vielfach werden in der Standortdebatte die hohen Arbeitskosten in Deutschland als Beleg für eine mangelnde Wettbewerbsfähigkeit und als Erklärung für die hohe Arbeitslosigkeit herangezogen. Grundlage solcher Untersuchungen sind oftmals die Arbeitskosten je Stunde in der verarbeitenden Industrie. Danach scheint Deutschland im internationalen Vergleich mit weitem Abstand einen Spitzenplatz einzunehmen. Bei derartigen Untersuchungen der deutschen Wettbewerbsposition wird jedoch übersehen, daß diese Vergleiche lediglich auf den Stundenlöhnen von Arbeitern im verarbeitenden Gewerbe basieren, also nur einen kleinen Teil der Beschäftigten repräsentieren. Zudem weisen sowohl die Qualifikationsprofile der Beschäftigten als auch die Produktions- und Vorleistungsstrukturen von Land zu Land erhebliche Unterschiede auf. Für allgemeine Schlußfolgerungen zur deutschen Wettbewerbsposition und als Erklärung der Arbeitslosigkeit sind die Untersuchungen daher nicht geeignet.; In diesem Beitrag werden statt dessen die Arbeitskosten je Stunde in der Gesamtwirtschaft berechnet. Nach diesen Ergebnissen liegt Westdeutschland nicht mehr mit weitem Abstand an der Spitze der Skala, sondern ist Teil einer größeren Gruppe von Industrieländern, die im internationalen Vergleich ein hohes Lohnkostenniveau aufweisen."
