Gesellschaftliche Politisierung, die im Bereich der internationalen Besteuerung
ein sehr junges Phänomen ist, hat ihre Ursache in einer Governancelücke. Das traditionelle
institutionelle Arrangement zur Vermeidung von internationaler Doppelbesteuerung
hat nicht-intendierte Nebenfolgen in der Form von schädlichem und unfairem
Steuerwettbewerb. Als Reaktion auf dieses Problem haben zivilgesellschaftliche
Akteure den Mangel an Effektivität und Fairness skandalisiert. Sie versuchen nationale
Regierungen und internationale Organisationen zu mehr internationaler Regulierung
des Steuerwettbewerbs anzutreiben. Anders als in Teilen der Literatur angenommen
wird, ist die gesellschaftliche Politisierung nicht das Resultat eines Zuwachses an
politischem Einfluss von nicht ausreichend legitimierten internationalen Institutionen,
sondern sie thematisiert im Gegenteil den Mangel an effektiven internationalen
Institutionen. Die zivilgesellschaftlichen Forderungen haben bisher nicht zu institutionellen
Reformen geführt. Stattdessen lässt sich lediglich indirekter und inkrementeller
Wandel beobachten, der nicht ausreichend ist, um das Problem schädlichen Steuerwettbewerbs

Entwicklungspolitik verändert sich immer schneller. Sie ist heute multilateraler und dezentraler als früher, hat ein wesentlich komplexeres Zielsystem und ist darauf angewiesen, politikfeldübergreifende Kooperationen einzugehen. Damit haben sich die Kompetenzanforderungen an entwicklungspolitische Fachkräfte gewandelt. Vor allem zwei große Trends stellen die Personalentwicklung (PE) entwicklungspolitischer Organisationen vor neue Herausforderungen: Erstens die zunehmende Komplexität des entwicklungspolitischen Zielsystems: Armutsminderung, Stabilisierung fragiler Staaten, Gestaltung der Globalisierung, Eindämmung des Klimawandels und Bewältigung seiner Folgen in den am meisten betroffenen Ländern. Zweitens die fortschreitende Ausdifferenzierung der Partnerländer, wodurch neue Kompetenzen beim Einsatz eines immer vielfältigeren Instrumentariums notwendig werden. Ausgehend von diesen Trends ergeben sich veränderte Kompetenzanforderungen für entwicklungspolitische Fach- und Führungskräfte. In der vorliegenden Studie geht es um die Frage, ob die Personalentwicklung (PE) in der deutschen Entwicklungszusammenarbeit (EZ) die einschneidenden Veränderungen des Politikfeldes bereits hinreichend reflektiert. Die Autoren stellen zunächst eine knappe Interpretation der entwicklungspolitischen "Großwetterlage" zur Diskussion, wie sie sich aus unserer Sicht in der Fachdebatte und den internationalen Deklarationen darstellt. Daraus werden die (neuen) Kompetenzanforderungen abgeleitet, die sich im PE-System der deutschen EZ widerspiegeln sollten (Kapitel eins). Das zweite Kapitel analysiert die gegenwärtige Praxis der Personalentwicklung für Fachkräfte in der staatlichen Entwicklungspolitik in Deutschland. Im dritten Kapitel werden internationale Erfahrungen mit PE für entwicklungspolitisches Personal ausgewertet. Im vierten Kapitel werden zunächst die Ergebnisse der Ist-Analyse zusammengefasst. Daran anschließend werden vor dem Hintergrund der internationalen Erfahrungen Schlussfolgerungen für eine Fortentwicklung des deutschen PE-Systems gezogen. Die Autoren kommen zu dem Ergebnis, dass es im deutschen EZ-System interessante Entwicklungen in der PE gibt. Viele der künftig wichtigen Kompetenzen reflektieren sich in den PE-Konzepten der einzelnen EZ-Institutionen. Dennoch scheint es, dass der strukturelle Wandel der internationalen Entwicklungspolitik noch nicht vollständig im bestehenden PE-System angekommen ist. (ICD2)

Insists both on the unavoidable interrelation of the disciplines of International Law & International Relations & the problematic nature of combining a critical standpoint with the necessity of decompartmentalizing these fields of study heretofore regarded as separate. The idea of a 'constituent relationship' between the two is presented is presented as the basis of a future reconceptualization for researchers. This new approach would be both critical & holistic. In addition, suggests theories of problem resolution may indicate modes of emancipating these disciplines from familiar restraints, although states an awareness that problem solving techniques themselves are misleadingly presented as simple tools when they involve unexamined assumptions of their own. Due to current statistical methods, the tendency is to do a cost-benefit analysis of the growing institutionalization of international law, focusing on what this or that agent can gain in the way of information or conflict resolution. Some limit this analysis to states; others factor in special interest groups. But the big, unanswered question in research is the two disciplines' interrelation in the problematics of international dynamics. In this regard, a major problem is the predetermined, often binary, rational categories because they make it difficult to deal with the specificity of contemporary problems. Examples given include such oppositions as legal/illegal, stable/anarchic, economic/political, public/private, all categories that do not allow for all possible variables. Two important heuristic dimensions in the future: recognizing that structures & dynamics of international power do not exist apart from the judicial relationships that crystallize & institutionalize them. Law in general & international law in particular cannot be reduced to the 'will' of nations or the idea of 'national interests.' Neither can economics be factored out.
