This publication has been prepared by the UN system organizations and related international entities as input to the second UN General Assembly High-level Dialogue on International Migration and Development on 3 and 4 October 2013. The individual chapters illustrate the work undertaken by the various contributors in support of migrants, their families, and societies touched by migration. The agency chapters draw the attention of policymakers and practitioners to tools, guides and good practices in the area of international migration and development. The book also offers some unique insights into the growing coherence of action among these key international players in the migration field. The collaboration among the agencies represented in this book reflects ongoing efforts to advance global understanding and inter-agency cooperation on migration. The book thus helps to fill a gap in knowledge about the "international system" around migration. This is a publication of the UN System Chief Executives Board for Coordination, coordinated by UNFPA and IOM, in collaboration with the Global Migration Group and other members of the Chief Executives Board, as well as the Special Rapporteur on the Human Rights of Migrants and the NGO Committee on Migration. Essentially, international relations are those between global societies with political & territorial boundaries. The territorialization of global societies gives rise to a specific kind of contradiction: the political occupation of tracts of land & their delimitation from other areas occupied in the same way brings about an interdependence between global societies, since no single given territory can contain all those natural requisites which a country as a whole can offer. Using the methods of historical sociology & anthropology, two types of interdependence are noted: original & technological. The former results from natural conditions while the latter results from the development of the production which compensates for natural deficiencies. Relations between states depend upon the form & the degree of interdependence, themselves affected by variables that could be investigated both quantitatively & qualitatively, helping to explain the course of the relations between the observed states. Für viele Anhänger der idealistischen Schule derInternationalen Beziehungen führt eine Judizialisierunginternationaler Streitschlichtungsverfahren nahezu automatisch zu einer besseren Einhaltung des Völkerrechtsund zu einer Gleichbehandlung vergleichbarer Rechtsbrüche.Die Existenz eines gerichtlichen Streitbeilegungsverfahrens beispielsweise im GATT bzw. inder WTO deutet jedoch nur dann auf das Entstehen internationaler Rechtsstaatlichkeit hin, wenn bei konkreten Rechtsstreitigkeiten die jeweils betroffenenStaaten allgemein dieses Streitbeilegungsverfahren auchfür Klagen nutzen und die beklagten Staaten das Verfahrenanerkennen. Der vorliegende Beitrag benennt eine Reihevon Anzeichen dafür, dass diese Bedingungen internationaler Rechtsstaatlichkeit heute zu einem höherenGrad erfüllt sind als noch vor zwei oder drei Jahrzehnten.Um dies zu belegen, werden drei Sphären des Völkerrechts untersucht: (1) der dem nationalen Privatrecht entsprechende Bereich des Völkerrechts; (2)der dem nationalen Strafrecht entsprechende Bereich desVölkerrechts; (3) der dem nationalen Verwaltungsrecht entsprechende Bereich des Völkerrechts.(ICA2)

Katharina Reiling entwickelt anhand der Verwaltung der Seeschifffahrt ein Konzept für ein internationales Verwaltungsrecht. Ihre tragende Idee lautet, dass sich die internationale Verwaltung strukturell als Konglomeratsverwaltung darstellt und deswegen ihr Instrumentarium und die juristischen Kautelen zur Einhegung internationaler Verwaltungstätigkeit auf dieses Konglomeratsdenken ausgerichtet sein müssen. Sie untersucht die Organisation, die Handlungsinstrumente, die Verwaltungslegitimation sowie den Rechtsschutz in der internationalen Verwaltung. Abschließend wird ausgelotet, ob und inwiefern Rechtsgrundsätze des internationalen Verwaltungsrechts eine Alternative zum Verfassungsdenken liefern können

Internationale Organisationen sind zu wichtigen internationalen Akteuren geworden, die innerhalb der Völkerrechtsordnung agieren. Ihr Handeln beruht auf rechtlicher Grundlegung und bedarf rechtlicher Einhegung. Dies gilt um so eher, je mehr dieses Handeln in die Rechtsphäre von anderen Völkerrechtssubjekten und von Individuen einwirkt. Ausgehend von einer breit angelegten historischen Analyse entwickelt die Arbeit eine Kompetenzlehre internationaler Organisationen.
