Studies legal processes that incorporate the law of the Other, exploring images of death & transmission & murder & inheritance in modern law in three contexts. The work of J. F. Stephen is analyzed & considered to characterize the scene of modern law, in which law & death exchange places. This theme is examined in Australia's postcolonial legal system in two cases: Mabo and Others v. State of Queensland (1992); & Coe v. the Commonwealth (1993). A myth of the foundation of Anglo-Australian law, representing the destruction of the Aboriginal Other & the defacement of another image of jurisdiction, is recounted. It is concluded that the jurisdiction of modern, postcolonial law is internally split as it incorporates an Other law. 43 References. J. Ferrari
