This article examines trade negotiations and disputes between China and the United States. It begins by ascertaining the unique political aspects of China-U.S. bilateral economic ties and explains the historical background underlying the relations. The article then argues that trade frictions between China and the United States are unlikely to repeat the Depression-era trade wars. The article observes that both the Chinese and U.S. governments are aware that the adoption of WTO-inconsistent measures may result in retaliatory actions from the other side. Hence, the two governments have attempted to resolve potential disputes through high-level official talks. Even when certain issues cannot be solved through dialogue, the WTO dispute settlement system has proven to be efficient as an instrument of final resort to deal with bilateral trade frictions. Finally, the article submits that the change in China's attitude toward WTO disputes further integrates the country into the international economic order and paves the way for a more positive development of China-U.S. trade relations.

Cross-strait relations underwent a fundamental change when both China and Taiwan joined the World Trade Organization (WTO) in 2001. The WTO is the first world-wide multilateral organization in which China and Taiwan share equal statuses. Thus, the WTO provides a neutral forum for China and Taiwan to resolve trade conflicts. More importantly, the WTO requires the two states to behave toward one another in a manner consistent with WTO norms. Consequently, the trade policies of China and Taiwan would change in response to their WTO obligations. In addition to the WTO, Asian regionalism, which refers to the recent accelerated integration of Asian countries also shapes relations between China and Taiwan, along with their foreign policies in the Asia Pacific.The purpose of this Article is to analyze cross-strait trade relations as it relates to recent developments of the WTO and Asian regionalism. After the introductory section, Section II will examine cross-trade relations under the WTO framework, including implications of WTO obligations for trade policies of China and Taiwan. Furthermore, this section will analyze cross-strait trade disputes occurring in the post-WTO era. Section III will discuss the development of the Asia-Pacific Economic Cooperation (APEC) and the Association of Southeast Asian Nations (ASEAN), as well as China's and Taiwan's involvement in and interactions with these organizations. In addition, this section will assess the impact of Asian regionalism on cross-strait relations. Section IV will explore the China-Hong Kong Closer Economic Partnership Agreement (CEPA) and the prospect for the cross-strait free trade agreement. Finally, Section V will present the conclusion of this Article.

In the 1970s, Taiwan lost its United Nations seat, and most nations switched diplomatic recognition from Taiwan to the People's Republic of China (PRC). The loss of Taiwan's diplomatic recognition became a fundamental issue in judicial proceedings. Contrary to the PRC's claim, the article argues that, from the viewpoint of international law, Taiwan has never been succeeded by the PRC. The article explores the Taiwan question faced by foreign courts and finds that, albeit the lack of diplomatic recognition, the courts around the world have almost uniformly accorded Taiwan the status of state and this judicial recognition has risen to the level of customary international law. As for the standing of Taiwan before the international courts, the article analyzes whether Taiwan, as a non-UN member, may be granted standing before the International Court of Justice. The article also argues that Taiwan, as a fishing entity, has the right to access the International Tribunal for the Law of the Sea. Furthermore, Taiwan's status as a separate customs territory in the World Trade Organization enables the nation to utilize the dispute settlement mechanism. The article concludes that, to avoid the judicial black hole in terms of global justice, it is both necessary and pragmatic to deem Taiwan a state in all judicial proceedings.

On Nov 11, 2001, in Doha, Qatar, the Fourth Ministerial Conference of the World Trade Organization (WTO) unanimously approved Taiwan's application for WTO membership, just 24 hours after approving China's admission. Taiwan's choice as the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu, abbreviated as Chinese Taipei, in the WTO, instead of its official name, Republic of China (PRC), shows its reluctant compromise with political reality. The PRC's claim that accession procedures applying to Taiwan and Hong Kong should be identical erroneous because, under international trade law, the ROC is the automatic government acting on behalf of Taiwan and thus does not need the PRC's sponsorship. Coexistence of China and Taiwan makes the WTO a new diplomatic battle. Under the WTO framework, both China and Taiwan should abide by WTO law and treat the other as an equal trade partner. The WTO provides opportunity for facilitating cross-straight dialogues, and increasingly intensified economic relations may lead to political integration.

The fast-growing last decade of strong economic growth of the Association of Southeast Asian Nations (ASEAN) has played a critical role in Asia-Pacific regionalism and global trade. This book explores the concept of ASEAN law under the normative framework of the new regional economic order. It examines the roadmap of the new ASEAN Economic Community Blueprint 2025 by evaluating the impact of ASEAN trade agreements on domestic legislation on professional services, financial integration, investment disputes and digital trade. More importantly, it sheds light on the legal implications of ASEAN's agreements with China and India and the potential developments of mega-regional trade agreements such as the CPTPP and the RCEP.
