Keine Arbeitsplanung, kein Arbeitsgestaltungsdesign vom 'grünen Tisch' kann das bringen, was an Verbesserungsideen – mitsamt ihren positiven ökonomischen Effekten – im Prozess des Arbeitens entsteht. Das Erfahrungswissen der Mitarbeiter und deren sich darauf gründende Verbesserungsideen – Faktoren, die der Taylorismus ausschließen wollte – will KVP systematisch integrieren und nutzen. Wo dies gelingt, entstehen für ein Unternehmen auf Dauer erhebliche betriebswirtschaftliche Kosteneinsparungen sowie auch Innovationen. Darüber hinaus entstehen positive Lern- und Motivierungseffekte bei den Mitarbeitern. Gut gemanagt ist KVP insofern ein sich selbst verstärkender und verbessernder Prozess. Hinzu kommt ein Weiteres: KVP eignet sich auch dazu, ein Unternehmen mit den Wahrnehmungen seiner Mitarbeiter 'zu versorgen' und so seine Selbstbeobachtungskompetenz laufend zu verbessern. Darauf kann heutzutage kein Unternehmen mehr verzichten, wenn es wettbewerbs- und marktfähig bleiben will. Auf die Unterstützung der Selbstbeobachtungskompetenz kleiner und mittlerer Unternehmen wurde bei der Entwicklung der KVP-Praxistools in diesem Arbeitsbuch des RKW besonderer Wert gelegt.

Abstract Contemporary technology and artificial intelligence increasingly facilitate the delivery of justice by automating, accelerating, and supporting judicial procedures with digitisation and automation tools. This article analyses options for the automatisation of the European Small Claims Procedure. The authors propose the digitisation of the procedure to a greater extent by additional features, such as AI-powered translation and text-to-speech tools, as well as creation of a trustworthy system for submission and storing of procedural documents based on the Estonian e-File example within the framework of the ongoing EU-funded SCAN II-project.

The latter is especially relevant in terms of the liability of online intermediaries for digital services, taking into account the rapid transformation of the digital architecture and the emergence of new major digital platforms for sales and services. This chapter, which is based on the Bachelor thesis handed in by Sander Sagar and supervised by Thomas Hoffmann for graduation at TalTech Law School, Tallinn University of Technology, intends to elucidate how the transition towards a common digital market is legally established in practice using as an example the adoption of the intermediaries' liability regime to a digitalized environment from the E-Commerce Directive to the Digital Services Act.

In den Transformationsländern haben sich auf der einen Seite landwirtschaftliche Großbetriebe herausgebildet, auf der anderen Seite produzieren sehr viele Klein- und Kleinstbetriebe zum Eigenverbrauch. Für deutsche Landtechnikhersteller war das Jahr 2017 ein gutes Geschäftsjahr. Weil die meisten Transformationsländer einen veralteten Maschinenpark haben, wird auch für die kommenden Jahre ein hoher Bedarf an Neumaschinen erwartet. Politische und wirtschaftliche Regelungen in Russland und China haben das Ziel, Produktionskapazitäten im eigenen Land aufzubauen, entweder durch landeseigene Unternehmen oder durch namenhafte ausländische Hersteller. In den letzten Jahren sind zahlreiche neue Maschinenentwicklungen auf den Markt gekommen. Länder wie Russland und China investieren viel in neue Technologiefelder im Bereich Digitalisierung der Landwirtschaft. ; Large agricultural enterprises have developed in transformation countries on the one hand, while on the other, many small and micro enterprises produce for their own consumption. 2017 was a good year for German agricultural machinery manufacturers. Because most transformation countries have outdated machinery, demand for new machinery is expected to remain high in the coming years. Political and economic regulations in Russia and China aim to establish production capacities in their own countries either by state-owned companies or by well-known foreign manufacturers. In recent years, numerous new machines have come onto the market. Countries like Russia and China are investing in new technologies in the field of digitalization of agriculture.
Russland und die Europäische Union haben infolge der Kampfhandlungen in der Ukraine und der Annexion der Krim durch Russland gegenseitig Handelssanktionen bei Landwirtschaftserzeugnissen und Lebensmitteln verhängt. Russland ist bemüht, die Folgen der Sanktionen durch eine Belebung der eigenen Produktion auszugleichen. Die Ukraine kann infolge der politischen Diskrepanzen zu Russland kaum noch Produkte nach Russland verkaufen und sucht in der EU neue Handelspartner. Deutsche Hersteller können keine Lebensmittel und nur noch sehr eingeschränkt Landtechnik nach Russland verkaufen und suchen neue Absatzmärkte. Ein potentieller Absatzmarkt ist China. China muss seine Landwirtschaft modernisieren. Nach Vorgabe der chinesischen Regierung sollen jedoch die für die Modernisierung erforderlichen Maschinen und Geräte aus chinesischer Produktion stammen. ; As a result of the hostilities in the Ukraine and the annexation of the Crimea by Russia, Russia and the European Union impose bilateral trade sanctions on agricultural products and food. Russia tries to compensate the consequences of these sanctions by a stimulation of the domestic production. The Ukraine has hardly any possibilities to sell products to Russia due to discrepancies and therefore tries to find new trading partners in the EU. German producers have to look for new markets as selling food to Russia is prohibited and selling agricultural machinery is allowed in a very limited amount, only. China is a potential partner because it needs to modernise its agricultural production but by order of the Chinese government the required machines and equipment need to be made from Chinese production.
Seit dem Zusammenbruch der Sowjetunion wurden in den ehemaligen Sowjet-Staaten große Flächenanteile aus der landwirtschaftlichen Nutzung genommen. Ein großer Teil dieser Flächen wurde trotz guter landwirtschaftlicher Bedingungen aufgegeben. Der Importstopp der russischen Regierung auf ausgewählte Lebensmittel im Jahr 2014 bescherte den Lieferländern einen erheblichen Rückgang an Exporten nach Russland. Der Landmaschinenmarkt in den Transformationsländern gestaltete sich für westliche Hersteller überwiegend schwierig. Als Ursache dafür sind Importbeschränkungen, der Rückgang an Subventionen und Währungsabwertungen zu nennen. ; Since the collapse of the Soviet Union lager areas of agricultural land were taken out of the agricultural use in the former Soviet states. A larger portion of this area was taken out despite good agricultural conditions. The import ban on selected foods by the Russian government in 2014 caused among supplying countries in substantial decline in export to Russian. The market of agricultural machinery in the transformation countries was difficult for manufactures of western countries. This is due to import restrictions, the reduction of subsidies for the agriculture and currency depreciations.
Abstract: Intellectual property law is being reformed in various countries worldwide, among which in the European Union at present Estonia endeavours one of the most comprehensive reform projects. While legislative challenges deriving from the 'digitalization' of social interaction, globalization, and general technical progress are widely discussed in public, some of the most essential purely legal questions to be answered while drafting Estonia's new Intellectual Property Law codification would usually stay within the small circle of the working group. The question in how far the abstraction principle - one of the core principles of both Estonian and German laws - shall be applied within the new codification is one of these issues that are of interest not only to Estonian working group members and Estonian/German legal research but also to scholars of European Private Law in general, as the central task - determining the demand for protection of author's economic rights - at present is not comprehensively regulated in any European Intellectual Property Law system. After having elucidated the current German and Estonian approaches in both written law and legal practice, this paper provides a proposal for the Estonian codification procedure that may serve as model for running Intellectual Property Law reforms in other European countries as well. Résumé: Le droit de la propriété intellectuelle est en cours de réforme dans différents pays autour du monde, parmi lesquels dans l'Union européenne à l'heure actuelle l'Estonie s'efforce l'un des projets de réforme les plus complets. Même si les questions législatives résultant de l'usage de l'internet, la mondialisation et le progrès technique général sont largement discutés en public, quelques-unes des questions les plus essentielles purement juridiques à répondre lors de la rédaction législative estonienne habituellement restant dans le petit cercle du groupe de travail au ministère. La question dans quelle mesure le principe d'abstraction - l'un des principes fondamentaux du droit estonien et allemand - doit être appliqué dans le cadre de la nouvelle codification est l'une de ces questions qui présentent un intérêt non seulement pour les membres du groupe de travail estonien et le monde scolaire estonien-allemand, mais aussi aux chercheurs de droit privé européen en général, comme la question centrale - la détermination de la demande de protection des droits économiques de l'auteur - à l'heure actuelle n'est pas réglementée de manière détaillée à ne aucun système européen de droit de la propriété intellectuelle. Après avoir élucidé l'approche actuelle allemande et estonienne par la loi et la pratique juridique, cet article-ci fournit une proposition à la procédure législative estonienne, qui peut servir comme modèle pour l'exécution de réformes du droit de la propriété intellectuelle dans autres pays européens ainsi.
Ausgehend von dem Problem des "Lernens am gemeinsamen Gegenstand" (Feuser) setzt sich der vorliegende Artikel mit der Frage auseinander, welchen Beitrag die Tätigkeitsanalyse für eine entwicklungsorientierte Didaktik leisten kann. Die Argumentation erfolgt in sechs Schritten: Im ersten Abschnitt wird zunächst begründet, warum der Begriff des "Lernens am gemeinsamen Gegenstandes" in der aktuellen didaktischen Diskussion kritikwürdig erscheint. Als ein zentrales Problem wird im zweiten Abschnitt das Verhältnis von Subjekt, Tätigkeit und Objekt näher untersucht. Im dritten und vierten Abschnitt werden vor dem Hintergrund des psychologischen Ansatzes der "kulturhistorischen Schule" (Wygotski, Leontjew, Luria) allgemeine Überlegungen zur Struktur menschlicher Tätigkeiten sowie zur Entwicklung von Sinn und Bedeutung dargestellt. Der fünfte Abschnitt skizziert knapp, inwiefern Bildung als "Dispositiv der Macht" (Foucault) begriffen werden kann und welcher Nutzen für die Didaktik von einer Erweiterung der psychologischen Tätigkeitsanalyse um die soziologische Dimension der Macht- und Diskursanalyse zu erwarten ist. Abschließend wird im sechsten Abschnitt das Verhältnis von Unterricht, Lernen und Entwicklung betrachtet und ein Ausblick auf offene Forschungsfragen gegeben.
