This study aims to analyze the transformation of the New Public Management into the New Public Management within the framework of institutional divergence. The study focuses on the transformation of New Public Management as an institutional phenomenon within the framework of bureaucratic hybridization that results in unique divergences according to the organization. Social actors as the main element of institutional normative coupled with other institutional mimetics have an impact on elaboration patterns of government, affecting efficiency and organization. The case study methodology was chosen to see how the roles of actors in the bureaucracy with the help of Text Network Analysis as a visual and structured confirmation tool. The results show that the hybridization of public management in the bureaucracy needs to go beyond coercive factors to encourage the potential of state apparatus in digital governance towards ideal Post New Public Management. Methodological findings in the form of qualitative research variants that are adaptive to the application of technology can be applied to build strong data validity and reliability. Theoretically, the findings also complement institutional divergence studies that have not yet examined the context of the digital bureaucracy era.

This study aims to analyze the effect of government expenditures, household consumption and net exports on economic growth seen from the PDRB of Madura Island which consists of four districts namely Bangkalan, Sampang, Pamekasan, and Sumenep within a period of six years from 2011-2016. National Human Rights Commission is positioned as an independent state institution at the same level as other state institutions which in carrying out its functions and authorities stand on a par with other state institutions whose authority is granted by law. The prohibition for judges to not sentence the defendant if the act is not described carefully, clearly and completely in the indictment of the public prosecutor, it turns out that in practice in court, there are judges who deviate from the article charged by the public prosecutor. The judge's action is called the ultra qui judicat principle, that is deviating from what was charged. The main problem in this paper is about the meaning of the Ultra Qui Judicat Principle and the Validity of Decisions in Criminal Cases. The main problems will be analyzed using normative legal research methods using a case approach and data sources from laws and regulations. The results show that the Ultra Qui Judicat Principle is an act of a judge deciding a case by placing justice as the goal of being able to deviate from the indictment of the public prosecutor based on the facts of the trial. This principle then has a specificity in the form of this principle being devoted to judges in deciding criminal cases, the use of this principle emphasizes the justice of judges in deciding criminal cases, and the scope of this principle is found in the facts of the trial. Furthermore, in exploring the meaning or value of the Ultra Qui Judicat principle, it is done by analyzing a judge's verdict, approach to legal expert opinion, and reviewing the legislation.

Preliminary elections are urgent to be implemented in the presidential nomination system in Indonesia. This needs to be done as an effort to create a more democratic and open mechanism for the presidential nomination, as well as a solution to determine the figure of the presidential and vice presidential candidates who will be elected in the general election, who really have high electability in society. Therefore, it is necessary to revise the Election Law, especially those related to the mechanism for nominating the President and Vice President.

The Presidential Election System in Indonesia is equipped with a unique mechanism that is not applicable in many other countries, namely the presidential nomination threshold by political parties or popularly known as the "Presidential Threshold". According to the Election Law, political parties need to have a minimum of twenty per cent of the Legislative House seats or twenty-five per cent of the votes cast in the most recent legislative member elections. Since this system was unconstitutional, it raised controversies because it limited the rights of established political parties and prevented new political parties from nominating presidential candidates. The purpose of this study is to ascertain the application of the Presidential Threshold process and its implications for the Indonesian general elections. This research is normative in nature. Three different approaches—the conceptual, legislative, and comparative ones—are employed. Legal primary and secondary sources of information were employed. A literature review was conducted to obtain data. Analysis of the data or legal materials is carried out by analytical prescriptive. The study concludes that raising the bar for presidential nominations results in several implications, including restricting political parties' ability to nominate candidates; weakening the essence of people's sovereignty; and contradicting the notions of justice and the presidential system. Because it does not pertain to the clauses outlined in the Republic of Indonesia's constitution, the regulation of the presidential nomination threshold in the Election Law should be deleted.

Tujuan yang ingin dicapai dalam penelitian ini adalah Untuk Mengkaji, mengetahui dan menganalisa rasio logis dari Pasal 21 ayat (1) Undang-Undang No. 30 Tahun 2014 tentang Administrasi Pemerintahan, yang memberi wewenang kepada peradilan Tata Usaha Negara untuk menguji unsur penyalahgunaan wewenang dan implikasi wewenang PTUN dalam menguji penyalahgunaan wewenang terhadap penegakan tindak pidana korupsi. Metode yang digunakan dalam penelitian ini adalah penelitian hukum Normatif dengan Teknik penelusuran bahan hukum dilakukan dengan studi Pustaka. Hasil penelitian dengan metode diatas menunjukan bahwa Rasio logis dari Pasal 21 Undang-Undang Nomor 30 tahun 2014 Tentang Administrasi Pemerintahan adalah Pengawasan oleh Peradilan Tata Usaha Negara sebagai sarana pencegahan penyalahgunaan wewenang dalam keputusan dan/atau tindakan (diskresi) oleh pejabat administrasi pemerintahan menjalankan tugas pelayanan dan implikasi hukum yang bisa timbul dari wewenang Peradilan Tata Usaha Negara menguji ada tidaknya penyalahgunaan wewenang yang berkaitan dengan Tindak Pidana Korupsi adalah bahwa Wewenang PTUN membawa implikasi dalam proses penegakan hukum tindak pidana korupsi. Narcotics crime in society (especially in Indonesia) shows an increasing trend both quantitatively and qualitatively with widespread victims, especially among children, adolescents, and the younger generation in general. Based on this, the government must increase efforts to prevent and eradicate narcotics crimes by any means, whether reforming the Narcotics Law, imposing strict sanctions and so on. The purpose of this research is to find out how the legal ratio of the Special Minimum Limit Regulation in the Law on Narcotics. This research is normative legal research with a conceptual approach and a philosophical approach. The legal materials used are primary and secondary with the technique of analyzing legal materials using the interpretation method. The results of the study indicate that the Ratio legis regulation specific minimum criminal provisions in the three laws studied, namely: the Narcotics Law and the Supreme Court Circular Number 03 of 2015, is intended to prevent disparities in the sentencing of crimes by judges. The regulation of types of criminal sanctions in legislation is one of the functions of the State to protect legal interests, in the form of life, property and dignity. The regulation of criminal sanctions is one of the criminal policy systems that can be seen from several aspects, namely the criminal system, namely: types of sanctions, alternative and cumulative forms of sanctions and their duration, namely the maximum-minimum of the punishment threatened.

The Ministerial Regulation provides the legal basis for the Minister to form laws and regulations in their respective fields as an assistant to the President in carrying out governmental power.

This article aims to analyze the legal implications of regulating the judicial review of district/city regulations in Indonesia. The author sees that there is incomplete regulation in the examination of statutory regulations under the law against the law, namely the incomplete set of the regional regulations touchstone, the incomplete set of the scope of the material and formal examination, the incompleteness of the legal standing arrangement, and the incomplete setting of the nature of the trial examination open to the court. This study uses a normative juridical research method with a statutory approach and a conceptual approach to provide answers to problems. The existence of incomplete regulation in the examination of legislation under the law against the law has legal implications as follows: legal uncertainty scope of material and formal testing, the absence of legal order, violation of the hierarchy of legislation, the loss of the central government's legal position in testing local regulation, and weak supervision of regional regulations by the central government.

The principle of audi et alteram partem is a general principle in the study of law, so the judicial review process in the Supreme Court which is only one-way and closed should not be carried out. This article analyzes and explores the original intent of granting judicial review authority to regional regulations at the Supreme Court. This article is normative legal research conducted by examining legal materials (library studies) or secondary data. The original intent the granting of judicial review authority to the Supreme Court is intended to foster checks and balances between various high state institutions. In addition, the granting of the right of judicial review is intended to enforce checks and balances between the three branches of power.
