The Greek fiscal crisis which is evidenced in a sharp deterioration of public finances resulting in the highest public deficit and debt in the E.U. makes even more urgent the necessity to make accurate assessments of the problem so as to apply the appropriate policy measures. After repeated downgrades by all rating agencies in a period of a few months, along with the loss of access to financial markets in spring of 2010, the unaffordable cost of borrowing due to record high spreads, reached such levels that the necessary fiscal adjustment is now nearly impossible. The international support mechanism created by the IMF, European Commission & ECB in order to avoid sovereign default, and preserve Greece's position as a member of the Euro-zone, was an urgent and necessary step. Besides the policy measures stated in the memorandum of understanding, which are an attempt to correct years of structural imbalances in Greek public finances, borrowing cost become a crucial factor for achieving the above targets. In this paper we try to present and explore the evolution of borrowing cost from Greece's entry to the Euro-zone until the end of 2009 and its severe deterioration afterwards. As will be shown, at the close of 2009, borrowing cost became one of the most crucial component in restoring fiscal consolidation and discipline. The spill-over effects of the borrowing cost on the private sector- crowding out effects- following the loss of access to international financial markets by domestic banks, will be investigated. Also, necessary preconditions for sustainable markets and E.U. enforced fiscal discipline by appropriate policy measures to restore market's confidence and reduce borrowing cost, will be discussed. ; peer-reviewed
The strategic risks of information security are determined by the development of digital technologies, the improvement of tools for destructive impacts in the geopolitical confrontation of key actors. In the European region, strategic risks of information security are taken into account, first of all, in the EU policy documents and activities, as well as in the national security strategies of European countries with significant geopolitical, economic, scientific and technological potential, such as theUK,FranceandGermany. The purpose of the article is to study the factors of modernization of information security strategies in theUK,FranceandGermany. The study is based on a methodology that includes analysis of documents and programs of supranational institutions of the EU and national information security strategies of certain European countries, studies of foreign and domestic scientists, analytical publications of experts from the expert community. The author has demonstrated that initiatives to address the EU's information and cybersecurity problems are to deepen coordination of supranational and national institutions to counter information threats. It is shown that in theUKdocuments, countering threats to the country's information sovereignty and ensuring the protection of information resources and infrastructure is seen through the establishment of information security standards, strengthening control over the protection of personal and confidential data, involving the private sector and public associations in creating an information culture environment and international cooperation.France's information security strategy aims to create mechanisms to overcome information threats, coordinate European cyber security legal issues and hold accountable terrorist cyber attacks. The information security policy ofGermanyis focused on maintaining the openness of the information and digital space. The article explores updated EU security policy strategies, including information and cybersecurity, and analyzes the practices of leading European countries in addressing current information challenges and threats. Complementing Europe's bank-based system with deeper capital markets and more cross-border financial integration promises benefits, but despite long-running debate and policy action, financial system change remains slow. Fintech has the potential to change financial intermediation structures substantially. It could disrupt existing financial intermediation with new business models empowered by intelligent algorithms, big data, cloud computing and artificial intelligence. Lower costs and potentially better consumer experiences could be the driving forces. However, empirically, fintech remains at a small scale, especially in the European Union. Even the largest fintech market, in China, is of marginal size compared to overall financial intermediation. In the EU, much of fintech is concentrated in the United Kingdom. We argue that policymakers need to consider four questions urgently: (1) Develop a European or national fintech market? (2) What regulatory framework to pursue? (3) Should supervision of fintech be exercised at the European level? (4) What is the overall vision for the EU's financial system? Getting the answers to these questions right at an early stage of market development would be an opportunity to shape a stable and cost-efficient financial system. In contrast, late action could mean that Europe loses out to foreign competitors and misses an opportunity to improve financial intermediation in Europe.
This contribution examines the role of the duration of lawful residence and the assessment of the facts of the individual case for the determination of the rights of (European) Union citizens and their family members by the Court of Justice of the European Union. While the Court initially embraced an approach which aimed at furthering and strengthening the rights of Union citizens, a conceptual shift has become visible over the last couple of years which seems to aim at limiting Union citizen's rights. This article seeks to shed light on the underlying rationale of the Court's judgments regarding Union citizens and their third-country family members by focusing on the application of the criterion of an individual assessment and the criterion of the duration of lawful residence respectively. To that end, it examines the Court's case law in four selected areas of European Union law: the protection against expulsion, the right of permanent residence, access to non-contributory cash benefits, and the right of residence of third-country family members of Union citizens upon return to the latter's Member State of nationality after having exercised free movement rights. It is submitted that the Court's application and interpretation of these criteria in the areas under scrutiny seems to be driven primarily by the aim to limit citizens' rights and not by the attainment of legal certainty which has been brought forward by the Court.

In this Article is analyzed financial transaction tax projects proposed by the European Commission in 2011 and 2013. The article focuses on the proposed regulation of the object and the jurisdiction of the financial transaction tax. The proposed regulation of the financial transaction tax is analyzed concerning possible threats of the new taxation related with tax avoidance. In this article the analysis of the proposed regulation was done reviewing the main arguments of the opponents of the financial transaction tax. The analysis of the proposed financial transaction tax projects leads to conclusion that the chosen regulation of the object of the financial transaction tax when the tax object is defined through two separate elements (financial transaction and financial security) is effective and comprehensive – the new regulation is safe enough against possible cases of tax avoidance. Also the analysis of the proposed financial transaction tax projects leads to conclusion that the proposed regulation of the financial transaction tax jurisdiction is based on the two separate principles (counterparty principle and issuance principle). This new and innovative legal construction fully prevents possible tax avoidance issues related with changing the jurisdiction of the taxable financial activities.
