AbstrakArtikel ini menjelaskan peran kolaborasi bisnis dan digital marketing terhadap kinerja bisnis UMKM. Era Industri 4.0 dan pandemi Covid-19, selain berdampak pada krisis kesehatan juga sangat berpengaruh terhadap ekonomi global maupun regional sepanjang tahun 2020 hingga tahun ini. Selain untuk menekan laju penyebaran Covid-19, pemerintah di setiap negara di dunia termasuk Indonesia terus melakukan mitigasi dan kolaborasi guna mempercepat pemulihan ekonomi. Usaha Mikro Kecil dan Menengah (UMKM), dalam sejarah perekonomian di Indonesia memiliki peran strategis. Di satu sisi UMKM menjadi sektor yang paling terpukul akibat pandemi, tetapi pelaku UMKM juga dituntut untuk segera beradaptasi dan melakukan tranformasi digital, kolaborasi bisnis untuk memenangkan persaingan. Survey ini telah dilakukan pada 112 pelaku UMKM di Propinsi Daerah Istimewa Yogyakarta (DIY). Teknik pengambilan sampel dilakukan dengan menggunakan simple random sampling, dengan menggunakan kuesioner terstuktur. Analisis data menggunakan pendekatan Structural Equation Modelling (SEM), dengan bantuan program LISREL. Hasil analisis menunjukkan bahwa kolaborasi bisnis dan digital marketing berpengaruh secara signifikan dan positif terhadap kinerja bisnis UMKM. Kinerja bisnis UMKM dapat dibangun dengan meningkatkan kolaborasi bisnis, serta penerapan digital marketing. Pengaruh yang kuat dari kolaborasi bisnis terhadap kinerja bisnis UMKM menunjukan bahwa kolaborasi bisnis merupakan variabel intervening yang baik dalam hubungan antara digital marketing dengan kinerja bisnis UMKM. Implikasi praktis penelitian ini adalah perlunya penerapan digital marketing dan strategi kolaborasi bisnis bagi pelaku UMKM guna mempertahankan dan memenangkan persaingan yang semakin ketat di masa pandemi maupun di New Era.Kata Kunci: Digital Marketing, Kolaborasi Bisnis, Kinerja Bisnis, UMKM AbstractThis article explains the role of business collaboration and digital marketing on the business performance of MSMEs. The Era of Industry 4.0 and the Covid-19 pandemic, in addition to impacting the health crisis also greatly affect the global and regional economy throughout 2020 until this year. In addition to reducing the rate of spread of Covid-19, governments in every country in the world including Indonesia continue to mitigate and collaborate to accelerate economic recovery. This survey has been conducted on 112 MSMEs in Yogyakarta Special Region Province (DIY Sampling techniques are done using simple random sampling, using the most directed questionnaire. Data analysis uses the Structural Equation Modelling (SEM) approach, with the help of the LISREL program. The results of the analysis showed that business collaboration and digital marketing had a significant and positive effect on the business performance of SMEs. SMEs business performance can be built by increasing business collaboration, as well as the application of digital marketing. The strong influence of business collaboration on SMEs business performance shows that business collaboration is a good intervening variable in the relationship between digital marketing and SMEs business performance. The practical implication of this research is the need for the application of digital marketing and business collaboration strategies for MSMEs to maintain and win increasingly fierce competition in pandemic times and in the New Era.Keywords: Digital Marketing, Business Collaboration, Business Performance, SMEs

The Covid-19 health crisis has roughly hit companies, which have had to adapt, react, and adapt new practices while maintaining their short and long-term goals. During Annual General Assemblies, especially since these were largely held behind closed doors, the challenge of maintaining good exchanges and an acceptable level of shareholder democracy, if not perfect, was a major task that seemed to us have to draw our attention. The challenge that was not met in the same way, there is a gap between some of them who made efforts and others. Beyond the formal conditions,items discussed in GA were impacted by this exceptional situation: the arise of ethical imperative and the current economic situation evolves, such as the health environment, drove boards of directors to index their dividend and earnings strategies on these new demands. Moreover, these requirements switched on governance itself, mainly on claims about more diversity on boards as executive or non-executive. For many items, Covid has been a revealer or an accelerator and questions are still there.It is within this framework that we sought to analyze answers of companies to three major questions: the conditions of shareholder democracy, the evolution of financial governance decisions and ESG criteria and the diversity and quality of the functioning of boards. Using various academic sources, statistical elements but also company reports, their declarations, viewing of the GA.The scope corresponds to twelve companies listed on the CAC40 ; La crise sanitaire de la Covid-19 a durement frappé les entreprises qui ont dû s'adapter, réagir, adapter de nouvelles pratiques tout en maintenant leurs objectifs de court et long terme. Lors des Assemblées générales, tout particulièrement puisque celles-ci se sont très largement tenues à huis-clos, le défi de la bonne tenue des échanges et d'un niveau de démocratie actionnariale acceptable sinon parfait a constitué un défi majeur prioritaire qui nous a semblé devoir attirer notre attention car le défi que n'a pas été relevé de la même manière, certaines faisant preuve de davantage d'efforts que d'autres. Au-delà des conditions formelles, les sujets abordés en AG eux même ont été impactés par cette situation exceptionnelle et pour certains durablement.On relèvera entre autres la montée d'un impératif éthique à l'aune de la conjoncture économique, et de la crise sanitaire qui ont amené les directions à indexer leurs politiques de dividendes et de rémunérations des dirigeants. Le champ de la gouvernance elle-même a été impacté interrogeant la composition des instances de gouvernement des sociétés cotées mais aussi la qualité de leur fonctionnement : l'équipe dirigeante devait réagir à une situation d'exception, à des risques nouveaux et d'autres aggravés et tous ont bien saisi que le retour au business as usual n'était pas une option.C'est dans ce cadre que nous avons cherché à analyser en mode les réponses d'entreprises à trois questions majeures en 2020 et 2021. A l'aide dediverses sources académiques, d'éléments statistiques mais aussi dans ce domaine qui demeure pratique les rapports d'entreprise, leurs déclarations et le visionnage des AG 2020 et 2021, ont été mises en évidence des tendances sur ces trois problématiques: les conditions de la démocratie actionnariale, l'évolution des décisions de gouvernance financière dont les critères ESG, enfin la diversité et la qualité du fonctionnement des conseils.Le périmètre correspond à douze sociétés cotées du CAC40.

The legislation of the European Union and Ukraine on the transportation of dangerous goods is considered in the research. We have revealed that the essence of the legal regulation of the transportation of these goods is to determine the risk of potential negative consequences of non-compliance with regulations on the transportation of high-risk goods. The analysis of specialized national and international regulations for the transportation of dangerous goods has shown that the technical regulation for this kind of transportation does not establish special requirements for environmental safety, reporting and control. The study of the risks of state supervision of compliance with the legislation on air protection of freight stations of the regional branch of Lviv Railway substantiated the following: freight stations operating with dangerous goods require crisis management in such matters as the availability of permission for the emissions of pollutants into the atmospheric air with stationary sources; development of special measures for air protection in case of emergencies of both man-made and natural origin; performance of production control by instrumental and laboratory measurements of pollutant emission parameters; stationary and mobile sources; compliance with standards for the pollutant content in the exhaust gases of various mobile vehicles; payment and accrual of environmental tax on emissions of pollutants into the atmosphere. It is also defined that economic instruments in the field of environmental protection, namely data, fees for the use of collections, restrictions, embody motivators in the process of environmentally safe activities of enterprises for which it is necessary to create continuous monitoring systems, situational modeling of large-scale man-made accidents and disasters, safety of railway transport, to date, methodological problems have not been solved, which provide for their dynamics in the medium and long term scales. ; Розглянуто законодавство країн Європейського Союзу та України щодо перевезень небезпечних вантажів і встановлено, що суть питання правового регулювання перевезення цих вантажів полягає у визначенні ризику виникнення потенційних негативних наслідків за недотримання нормативного законодавства під час перевезення вантажів підвищеної небезпеки та здійснення з ними інших маніпуляцій під час транспортування, зокрема на залізницях. Проаналізувавши спеціалізовані національні і міжнародні регламенти перевезень небезпечних вантажів з'ясовано, що технічне регулювання перевезення небезпечних вантажів не встановлює спеціальних вимог екологічної безпеки, звітності та контролю. Унаслідок дослідження ризиків заходів державного нагляду за дотриманням вимог законодавства про охорону атмосферного повітря вантажних станцій регіональної філії "Львівська залізниця" визначено, що вантажні станції, які працюють з небезпечними вантажами, потребують кризового менеджменту у таких питаннях, як наявність дозволів на викиди забруднювальних речовин до атмосферного повітря стаціонарними джерелами; розроблення спеціальних заходів з охорони атмосферного повітря в разі виникнення надзвичайних ситуацій техногенного та природного характеру; виконання виробничого контролю інструментально-лабораторними вимірами параметрів викидів забруднювальних речовин; стаціонарних і пересувних джерел; виконання нормативів вмісту забруднювальних речовин у відпрацьованих газах транспортних та інших пересувних засобів; виплату та нарахування екологічного податку на викиди забруднювальних речовин до атмосферного повітря. Визначено також, що економічні інструменти у сфері природоохоронної діяльності, а саме податки, плата за завдані збитки, штрафи, є мотиваторами ведення екологічно безпечної діяльності підприємствами, для яких необхідним є створення системи безперервного моніторингу, ситуаційне моделювання великомасштабних техногенних аварій і катастроф, а також розроблення системи екологічного оцінювання безпеки залізничного транспорту, оскільки на сьогодні не вирішені методологічні проблеми прогнозу їх динаміки у середньо- і довготерміновій перспективі.

The dissolution of the Soviet Union and the emergence of new independent countries in the international arena necessitated conceptual changes in Germany's foreign policy strategy for Central and Eastern Europe in general and Ukraine in particular. Effective cooperation with CEE countries is one of the priorities of German diplomatic relations, as it views these countries as a kind of «junior partners», and a successful example of Germany's Euro- and Euro-Atlantic integration strategy motivates the CEE region to take more active action on the path to European integration. For Ukraine, Germany is one of the key actors in the system of international relations, the «locomotive» of European organizations, on the position of which depends the further European and Euro-Atlantic integration of the Ukrainian state.The article analyzes the evolution of Ukrainian-German relations during Angela Merkel's chancellery, when bilateral interaction was particularly dynamic. At the beginning of her rule, Ukraine was considered by Chancellor Merkel only in the contextof cooperation with the Russian Federation, which was Germany's main economic partner. Merkel's position on fi nding a new formula for German-Ukrainian cooperation within the EU was limited to the European Neighborhood Policy and the Eastern Partnership. At the same time, Ukraine's full membership in the European Union was seen by the German leadership as a hasty step. Russia's annexation of the Crimea in 2014 and the aggression in eastern Ukraine began to dispel German illusions about cooperation with Russia. Support for the separatists in the Donbas has signifi cantly worsened German-Russian relations and at the same time transformed Germany's cooperation with Ukraine. From the very beginning of the Russian-Ukrainian confl ict, Chancellor Angela Merkel has taken a principled position on Russia's aggression, seeking to resolve the conflict in eastern Ukraine, restore stability in the region and promote Ukraine's European integration aspirations. The Ukrainian crisis has played a key role in strengthening Germany's international importance, in particular, making it a leader in the European political arena, turning it into a «middle power» that has consistently defended Ukraine.Keywords: German-Ukrainian interaction, European structures, annexation of Crimea, Russian aggression in the East of Ukraine, European and Euro-Atlantic aspirations. ; Розпад Радянського Союзу та поява на міжнародній арені нових незалежних країн зумовили необхідність концептуальних змін у зовнішньополітичній стратегії ФРН щодо Центрально-Східної Європи загалом і України зокрема. У статті проаналізовано еволюцію українсько-німецьких відносин під час канцлерства Ангели Меркель, коли двостороння взаємодія була особливо динамічною. На початку свого урядування Україна розглядалась Ангелою Меркель винятково у контексті взаємодії з Російською Федерацією, яка була для Німеччини основним економічним партнером. Водночас повноправне членство України у Європейському Союзі розглядалось німецьким керівництвом як передчасний крок. Російська анексія Кримського півострова у 2014 році та агресія на Сході України поклали початок розвіюванню німецьких ілюзій щодо взаємодії з РФ. Підтримка сепаратистів на Донбасі значно погіршила німецько-російські відносини та водночас трансформувала співпрацю ФРН з Україною.З початку російсько-українського конфлікту канцлерка Ангела Меркель зайняла принципову позицію щодо агресії РФ, прагнучи вирішити конфлікт на Сході України, відновити стабільність у регіоні та сприяти українським євроінтеграційним прагненням. Українська криза відіграла основну роль у посиленні міжнародного значення ФРН, зокрема зробила її лідером на європейській політичній арені, перетворивши на «середню силу», яка послідовно захищає Україну.Ключові слова: німецько-українська взаємодія, європейські структури, анексія Криму, російська агресія на Сході України, європейські та євроатлантичні прагнення.

After the Second World War, it slowly became clear that the implementation of violence had been "decentralized". If during XIX and half of XX century violence vastly took place in the territories of great powers and the central actors of world politics (even inviolable USA and the UK were plagued on their territories), in the 70s of XX century we have witnessed a cardinal shift as violence started to spread more extensively among the third world, underdeveloped and transitional countries. The epicenters of violence had been shifted from the "civilized" world into the "uncivilized" world. Conventionally and commonly, this shift was anticipated as a decline of violence by researchers like Arendt herself. Nevertheless, I am suggesting that through careful examination of the central political events unfolding after the 70s this perspective lacks cogency. For this, I will examine such regions as the post-soviet region and the Middle East. *** Noam Chomsky's ontological evaluation of the Cold War is decoding its essence and contradicts with the concept of deterrence which Arendt suggested: "The compact was that the US would be free to carry out violence and terror and atrocities with few limits in its own domains, and the Russians would be able to run their own dungeon without too much US interference. So the Cold War in effect was a war of the US against the Third World, and of Russia against its much smaller domains in Eastern Europe." The discernible and impregnable fact is that the Cold War was profitable for both main actors of international politics and the ideological antagonism between them was disguising this predicament. The two leading forces of the globalized world installed and maintained the bipolar system that gave them a possibility to control their share of the world. Arendt's concept of deterrence is not fully encapsulating the current global political crisis. Instead of stressing the role of hegemony in constructing world politics, she is asserting that deterrence can guarantee peace worldwide. *** In the smart machine age, the central front of resistance are social networks, the revolutions have moved from their traditional spaces such as streets and places of public gatherings and now it is running through the Internet. Mutiny and rebellion are less and less followed by the rivers of blood and armed conflict; revolutions have lost their organic intrinsic structure and became a spectacle and part of the simulation. The contemporary forms of the revolution have nothing to do anymore with a political or socio-economic fracture and became a synonym for shifting the power from one ruler to another. In modern times rebellions are blemished with lurking agreements among various influential groups and the system brutally cuts an entrance to politics for the innocent and uncorrupted forces. The next stage of development of the system can be displayed not only by disappearance and dematerialization of the ruling force but also by fading exploited entities, "The era of hegemony is the era of the cyber system. It governs, it regulates, but it does not dominate". This is how Baudrillard's vision of modernity can be theorized: "There are no longer any exploited or dominated. There is something else, something much harder to overtake by surprise. It is harder to critique as well, because critical thought is devitalized in this case".

Die Analyse der 26. Welle des IW-Personalpanels zeigt, dass im Spätherbst 2020 rund die Hälfte der Unternehmen in Deutschland von negativen wirtschaftlichen Auswirkungen der Covid-19-Pandemie berichtete. Das IW-Personalpanel ermöglicht darüber hinaus auch eine Einschätzung, in welchem Umfang Kurzarbeit sowie Maßnahmen des betrieblichen Leistungsmanagements im Laufe des Jahres 2020 eingesetzt worden sind, um mit den Folgen der Corona-Krise umzugehen, und welchen Beitrag sie zur Stabilisierung der Beschäftigung leisten konnten. Ökonometrische Schätzungen signalisieren, dass sich in Unternehmen, in denen sich die Corona-Pandemie negativ auf die wirtschaftliche Lage ausgewirkt hat, die Wahrscheinlichkeit eines Arbeitsplatzabbaus im Jahr 2020 um 16 Prozentpunkte reduziert, wenn eine Gewinnbeteiligung existiert. Gewinn- und Erfolgsbeteiligungen können auf betrieblicher Ebene daher eine wichtige Rolle zur Beschäftigungssicherung bei schockartigen Auftragseinbrüchen spielen. Sie sind aber nur in knapp jedem vierten Unternehmen in Deutschland anzutreffen. Gewinnbeteiligungen korrelieren signifikant positiv mit der Ausschüttung von Sonderzahlungen. Letztere sind aber deutlich verbreiteter. Jedes zweite Unternehmen zahlte im vergangenen Jahr eine Prämie für erbrachte Leistungen. Auch in vielen negativ von der Corona-Pandemie betroffenen Unternehmen sind Sonderzahlungen geleistet worden. Die Wahrscheinlichkeit einer Auszahlung unter solchen Umständen steigt mit einem zunehmenden Anteil von beruflich qualifizierten und akademischen Fachkräften. Dies spricht für die Hypothese, dass aufgrund des Wettbewerbs um Fachkräfte diese Unternehmen Sonderzahlungen zumindest für Teile der Belegschaft leisten, um das Risiko einer drohenden Abwanderung von Fachkräften und Experten zu Konkurrenten zu reduzieren, deren Geschäftsentwicklung während der Corona-Pandemie besser verläuft. Der massive Einsatz von Kurzarbeit hat vielerorts den Abbau von Arbeitsplätzen nicht verhindern, sondern lediglich abmildern können. Das wertet dieses beschäftigungspolitische Instrument keineswegs ab. Angesichts der rechtlich verlängerten Bezugsdauer und dem weiteren Anhalten der Covid-19-Krise bleibt dennoch die Frage offen, wie vielen der im Spätherbst Kurzarbeitenden sich mit dem Abflauen der Pandemie und ihrer Auswirkungen noch eine nachhaltige Beschäftigungsperspektive bei ihrem aktuellen Arbeitgeber eröffnet und bei wie vielen der Arbeitsplatz am Ende doch verloren geht. Diskretionäre Anpassungen im Leistungsmanagement wie das Aussetzen von Lohnerhöhungen oder eine Kürzung der Gehälter wirken bei isolierter Betrachtung der wirtschaftlich von der Corona-Krise negativ betroffenen Unternehmen nicht beschäftigungssichernd. Allerdings greift auch nur eine Minderheit der Unternehmen auf dieses letzte Mittel zurück. Dies dokumentiert zusammen mit der weit verbreiteten Aufstockung des Kurzarbeitergelds die Verantwortungsbe-reitschaft der Unternehmen, nachteilige Einkommenswirkungen der Corona-Pandemie bei ihren Beschäftigten abzumildern oder im Extremfall anzuwenden. ; Empirical evidence based on the IW Personnel Survey reveals that around half of the companies in Germany reported negative economic effects of the Covid-19-pandemic. An adversial impact was frequently accompanied by a reduction in the workforce. However, if a profit sharing scheme exists the likelihood of job losses has significantly been reduced by 16 percentage points. Thus, the empirical evidence supports the hypothesis that profit-sharing may be beneficial for securing employment, at least at the company-level. The existence of profit sharing - implemented in roughly one in four companies - correlates significantly positively with the distribution of special bonus payments in 2020. The latter, however, are much more prevalent. One in two companies (51 %) paid a premium last year. Special payments have also been made in many companies negatively affected by the Corona pan-demic. The probability of a payout under such circumstances increases with a higher proportion of skilled workers and academic professionals. This evidence suggests that due to the competi-tion for skilled workers firms stick to bonus payments despite an unfavourable development in order to reduce the risk of an impending brain drain to competitors. The widespread use of short-time working schemes was not able to prevent but, at least, mitigated job losses at the company-level. Furthermore, the risk remains that workers who currently are protected by short-time working schemes may become unemployed when the legally extended reference period (up to 24 months) will eventually expire on 31 December 2021. Many firms stock up the short-time working allowances that the workers receive by the employment agencies. The suspension of originally planned or regular pending salary increases as well as wage cuts are only applied by a minority of companies. Thus, the evidence indicates that the bulk of firms triesto shield employees from incomes losses due the covid-19-crisis.

The subject. This article represents an attempt to research the notion of "constitutional identity", which has recently emerged as a relevant concept in constitutional law, through the prism of its transformation reacting the world's challenges.The purpose of the research is to confirm or disprove hypothesis that both typical and extraordinary factors may influence differently on the transformation of constitutional identity.The methodology. The article is based on the dialectical method, as well as on the logical, historical, systemic methods. A comparative method was applied to study the features of the constitutional identity of States. Authors pay attention to the interaction of international and national policies.The main results, scope of application. Within the doctrine of constitutional identity it is presented a discussion with respect to terms and definitions of constitutional, state or national identity, constitutional identity of citizens. Moreover, such two notions as "individuality" and "identity" form a curious couple since "identity" may contravene "individuality". Different factors which can influence on transformation of the constitutional identity, are listed (globalization (antiglobalism), universalization of constitutional values, COVID-19 pandemic, migration, etc.). In particular, different countries choose different models of reflecting the processes of globalization in their domestic constitutional legislation: from striving for unification to systematic confrontation. In this regard, it seems necessary to assess these factors, taking into account the experience of different states. Besides, the activities of international bodies can give rise to the universalization of constitutional values. For example, supranational bodies (in particular, the European Court of Justice) develop generalcial common culture. Another example is the current epidemiological crisis. The coronavirus infection has made its own adjustments to the constitutional identity of states. Examples of such transformation are full border closures or partial closures with individual states; amendments to the national legislation, according to which the issues of measures permissible for implementation by the state are being revised in order to ensure the life and health of the population.Conclusions. Definition the constitutional identity is an important strategic framework for national policy. However, there is no certain fixed constitutional identity of the state. On contrary, the identity of the state tends to be changeable. Transformation can be regarded as voluntary, forced or consciously responsive, expected or not. Voluntary transformation usually becomes a response to the evolutionary development of society, scientific and technological advances and discoveries. Forced transformation is likely to be a reaction to economic, epidemiological, political crises. Therefore, in order to determine the constitutional identity of certain state it is necessary to understand the cultural, historical, social and political contexts of its formation and current development in the conditions of the contemporary world. ; Рассматривается доктрина трансформации конституционной идентичности и ее проявление в правоотношениях, складывающихся в условиях вызовов современности: глобализация и антиглобализм, пандемия коронавируса COVID-19, научные достижения, универсализация конституционных ценностей – эти и другие разнообразные факторы предопределяют необходимость трансформации конституционной идентичности или стимулируют ее. Ставится цель провести анализ терминов и понятий, используемых в доктрине конституционной идентичности, наработок ученых разных стран для определения ее конституционно-правовой природы, выявления факторов, обусловливающих изменчивость идентичности. Уделяется внимание взаимодействию международной и национальной политики. Делаются выводы о видах и современных практиках трансформации идентичности различных государств.

This article addresses two objectives: to study the role of the Costa Rican State in promoting sport ‒except soccer‒ through the educational system between the years 1933 to 1949, and to assess the role of sports practices in the socialization of children and youth. young people from Costa Rica during the same study period. Poverty in the public finances, economic crises, high desertion rates, political polarization, and the Civil War of 1948, influenced the shortage of adequate sports facilities and the sufficient number of physical education teachers in Costa Rica between 1933 and 1949. This made the teaching and practice of athletics, boxing, cycling, swimming, gymnastics, softball, baseball, basketball and volleyball only available to children and young people who studied in the main educational centers of the Central Valley. On the other hand, some of the implements to practice these sports were not available to students from the popular sectors, so they were not an important part of their socialization. The proposed objectives will be addressed through the review of the main national newspapers of the time. ; Este artículo aborda dos objetivos: estudiar el papel del Estado costarricense en la promoción del deporte ‒excepto el fútbol‒ por medio del sistema educativo entre los años de 1933 a 1949, y, valorar el papel de las prácticas deportivas en la socialización de niños y jóvenes de Costa Rica durante el mismo período de estudio. La pobreza de la hacienda pública, las crisis económicas, el alto índice de deserción, la polarización política y la Guerra Civil de 1948, influyeron en la escasez de instalaciones deportivas adecuadas y el suficiente número de maestros de educación física en Costa Rica entre 1933 y 1949. Esto hizo que la enseñanza y práctica del atletismo, boxeo, ciclismo, natación, gimnasia, softball, beisbol, baloncesto y voleibol solo estuviera al alcance de niños y jóvenes que estudiaban en los principales centros educativos del Valle Central. Por otra parte, algunos de los implementos para practicar estos deportes no estaban al alcance de los estudiantes proveniente de los sectores populares, por lo que no fueron parte importante de su socialización. Los objetivos propuestos se abordarán a través de la revisión de los principales periódicos de circulación nacional de la época. ; Este artigo aborda dois objetivos: estudar o papel do Estado costarriquenho na promoção do esporte deporte -exceto o futebol‒, por meio do sistema educacional entre os anos de 1933 a 1949, e avaliar o papel das práticas esportivas na socialização de crianças e jovens. jovens da Costa Rica durante o mesmo período de estudo. Pobreza nas finanças públicas, crises econômicas, altas taxas de deserção, polarização política e a Guerra Civil de 1948, influenciaram a escassez de instalações esportivas adequadas e o número suficiente de professores de educação física na Costa Rica entre 1933 e 1949. Tornou o ensino e a prática do atletismo, boxe, ciclismo, natação, ginástica, softball, beisebol, basquete e voleibol disponíveis apenas para crianças e jovens que estudaram nos principais centros educacionais do Vale Central. Por outro lado, alguns dos implementos para a prática desses esportes não estavam disponíveis para os alunos das camadas populares, portanto, não eram parte importante de sua socialização. Os objetivos propostos serão atendidos através da revisão dos principais jornais nacionais da época.

The post-crisis change of approaches of the national regulator (National Bank of Ukraine) to liquidity monitoring and its consequences for banks has been investigated. The nature of formation of liquidity risk of the national banking system due to maturity mismatch between the ratio of long-term assets (credit transactions) to short-term liabilities (customer funds) has been illustrated.It has been proved that transition from discrete to continuous-approximated monitoring leads to reorganization of the risk management systems in banks, which have to develop and implement peculiar models of liquidity management on the basis of forecasting the inflow and outflow of clients' funds at different time intervals, in order to ensure financial sustainability.The introduction by the National Bank of Ukraine of more in-depth approach to the construction and operation of the risk management system causes banks to transform the risk management system, which should be adequate to the peculiarities of the bank's activities, nature and volume of banking and other financial services.It is proposed to consider the adequacy of the bank liquidity not only on the basis of compliance with economic standards, but also based on the results of compliance with the internal liquidity adequacy assessment process (ILAAP), which will be further verified by the regulator in the framework of the supervisory procedures (SREP).The article describes the general approaches to the calculation of ratios of instant liquidity (H4), current liquidity (H5), short-term liquidity (H 6), the reasons for introduction of LCR and NSFR standards by the regulator instead of the standards that exist for a long time, changes in the approaches in controlling the liquidity risk due to introduction of new regulatory requirements.On the one hand, these processes can be considered as a process of implementation of European legislation, in particular Basel II – III; on the other hand, they should be considered as a mechanism for improving the process of liquidity management for reducing banks' vulnerability to shocks and external risks (political, macroeconomic, financial), in order to ensure stable functioning of institutions. ; Досліджена посткризова зміна підходів національного регулятора (Національного банку України) до моніторингу ліквідності ліквідності. Проілюстрована природа виникнення ризику ліквідності національної банківської системи через невідповідність строковості між довгостроковими активами (кредитні операції) та короткостроковими зобов'язаннями (кошти клієнтів).Доведено, що перехід від дискретного до неперервно-апроксимованого моніторингу зумовлює реорганізацію систем управління ризиками в банках, які повинні розробити та впровадити своєрідні моделі управління їх ліквідністю на основі прогнозування надходжень і відтоку коштів клієнтів на різних часових інтервалах для забезпечення фінансової стійкості установи.Запропоновано розглядати достатність ліквідності банку не лише на основі дотримання економічних нормативів, а й за результатами дотримання внутрішньої оцінки достатності ліквідності банку (ILAAP), яка у подальшому перевірятиметься регулятором в рамках проведення оцінки банків за методологією (SREP).В статті охарактеризовано загальні підходи до розрахунку нормативів миттєвої ліквідності (Н4), поточної ліквідності (Н5), короткострокової ліквідності (Н6), причини впровадження регулятором коефіцієнтів короткострокової ліквідності (LCR) та довгострокової ліквідності (NSFR) замість існуючих тривалий час нормативів, зміни у підходах при контролю за ризиком ліквідністю, у зв'язку із впровадженням нових регуляторних вимог.Зазначені процеси, з одного боку, можна вважати процесом імплементації європейського законодавства, зокрема Базель II - ІІІ, з іншого, варто розглядати як механізм удосконалення процесу управлінням ліквідністю з метою зменшення уразливості банків від шоків та зовнішніх ризиків (політичних, макроекономічних, фінансових) для забезпечення стабільного функціонування установ.

The article is devoted to the topical issues of concluding an employment contract with employees who work remotely. The author points out the relevance of the chosen research topic, as remote work is acceptable for both the employee and the employer both under normal circumstances and in certain crisis or atypical situations (for example, in the introduction of quarantine restrictions in Ukraine in connection with the COVID-19 pandemic). According to the author, the expression of the will of both to conclude an employment contract for remote work (at home) shouldbe considered a prerequisite for the formation of atypical employment relations between the employee and the employer. In the study of doctrinal approaches to determining the form of employment contract, the author pays attention to the fact that some scholars determine the possibility of choosing an electronic form of employment contract with employees working remotely. The author agrees that the electronic form of employment contract, along with written, has the right to exist and its appropriate enshrinement in labor law, including it can be used in relation to the consolidation of employment of home workers. The author analyzed the current labor legislation, which defines the concept and form of employment contract for telework, especially the definition of its conditions, which led to the conclusion that the legal regulation of telework in general and the procedure for concluding employment contracts with employees working remotely. narrowed and needs further improvement. Inconsistency of labor legislation in terms of concluding employment contracts with employees who work remotely, the transformation processes taking place in society, is not only a problem for both the employee and the employer, and for the state as a whole, as it potentially affects its economic and social development. ; Статтю присвячено актуальним питанням укладення трудового договору з працівниками, що виконують роботу дистанційно. Автор указує на актуальність вибраної теми дослідження, оскільки дистанційна робота є прийнятною для працівника і для роботодавця як за звичайних обставин, так і в умовах певних кризових чи нетипових ситуаціях (наприклад, в умовах уведення карантинних обмежень на території України у зв'язку з пандемією СОУЮ-19). Передумовою формування атипових відносин зайнятості між працівником та роботодавцем, на думку автора, слід уважати вираження волі обох щодо укладення трудового договору про виконання роботи дистанційно (на дому). У ході дослідження доктриналь-них підходів до визначення форми трудового договору автор звертає увагу на те, що деякі науковці визначають можливість вибору електронної форми укладення трудового договору з працівниками, що працюють дистанційно. Автор погоджується, що електронна форма трудового договору нарівні з письмовою має право на існування та її відповідне закріплення у трудовому законодавстві, у тому числі вона може бути застосована по відношенню до закріплення трудових відносин надомних працівників. Автором проаналізовано чинне трудове законодавство, що визначає поняття та форму трудового договору під час дистанційної роботи, особливості визначення його умов, що дало змогу зробити висновки щодо того, що правове регулювання дистанційної роботи загалом та порядку укладення трудових договорів із працівниками, котрі виконують роботу дистанційно, є звуженим та потребує подальшого вдосконалення. Невідповідність трудового законодавства в частині укладення трудових договорів із працівникам, що виконують роботу дистанційно, трансформаційним процесам, які відбуваються у суспільстві, є не лише проблемою для як для працівника та роботодавця, так і для держави у цілому, оскільки потенційно впливає на її економічний та соціальний розвиток.

Les inégalités de revenu augmentent partout en Occident depuis les années 1980. Le 1% d'individus les plus riches de tous les pays d'Europe et d'Amérique du Nord capte une part de plus en plus grande du revenu national total, alors que cette part stagne ou diminue pour les 90% les moins nantis. Les causes du creusement des inégalités sont institutionnelles: ce sont des mécanismes mis en place par les États qui favorisent l'accumulation de revenu par les plus aisés au détriment des moins fortunés, la diminution du taux marginal maximal d'imposition (le dernier palier d'imposition) en étant l'illustration exemplaire. Mais pourquoi les États empruntent-ils ce chemin depuis une quarantaine d'années? Suite à la récession du début des années 1980, on a assisté à la remise en question de l'État-providence, lequel avait marqué la pratique gouvernementale du sceau de l'interventionnisme depuis la fin de la Seconde Guerre mondiale. Cet interventionnisme visait essentiellement à protéger les individus des aléas du marché et avait concordé avec une réduction des inégalités. Or, la crise poussa les États à reconsidérer leurs politiques économiques. On a alors vu triompher l'idée voulant que si l'interventionnisme était un échec, il fallait laisser le marché organiser la société. On assista ainsi à un retour du libéralisme. Mais, entre-temps, ce dernier s'était renouvelé, abandonnant l'idée du laissez-faire et admettant désormais qu'il revient à l'État d'assurer activement non seulement la mise en place du marché, mais également la généralisation de ses principes à des domaines qui lui échappaient traditionnellement. C'est ce néolibéralisme qui a guidé et qui guide encore aujourd'hui la pratique des États, et c'est à sa théorie qu'il faut se frotter pour comprendre l'augmentation récente des inégalités. ; Abstract Income inequality has been increasing everywhere in the West since the 1980s. The 1% of the richest individuals in all European and North American countries getsa larger and larger share of total national income, while this share stagnates or decreases for the poorest 90%. The causes of widening inequalities are institutional: they are mechanisms put in place by the states which favor the accumulation of income by the rich ones at the expense of the less fortunate ones, the reduction of the marginal maxima ltax rate (the top tax rate) being the prime example. But why have the states been following this path for forty years? Following the recession of the early 1980s, the welfare statethat prevailed since the end of the Second World War, whose practice was characterized by a strong interventionism, was challenged. This interventionism was essentially aimed at protecting individuals from the riskiness of the market and had concurred with a decrease in inequalities. The crisis led states toreconsider their economic policies. We then saw the triumph of the idea that if interventionism wasa failure, the market must be allowed to organize society. We thus witnessed a return of liberalism. But in the meantime, the latter was renewed, abandoning the idea of laissez-faire and now admitting that it is up to the state to actively ensure not only the establishment of the market, but also the generalization of its principles to areas that traditionally eluded it. It is this neoliberalism that has guided and still guides state practice today, and itis itstheory that must be analyzedto understand the recent increase in inequality.

Banditry is one of the most dangerous crimes against public safety. Given the recent events in Ukraine, when the political and social crisis in the country is increasingly creating organized criminal groups, often armed, there are illegal paramilitaries, there are a large number of weapons that are illegally owned by individuals and whose movement is very difficult to control. or to trace, it becomes clear why the number of crimes committed with the use of firearms, explosives, both by individuals and armed criminal groups is increasing. The operation of gangs in Ukraine, the purpose of which is to carry out armed attacks on enterprises, institutions, organizations or individuals, threatens public safety in general and the lives, health of individuals and their property, hinders the normal economic activity that creates the state insecurity of society from criminal encroachments. All this presupposes the need for the state to take effective measures, including criminal law, aimed at combating banditry. But the effectiveness of such measures is hardly possible without a clear understanding of the legal nature of banditry, which can be achieved, including by analyzing the experience of criminal liability for banditry in the legislation of foreign countries. In the criminal law of some foreign countries, the legislator differentiated the responsibility of gang members depending on the roles performed. Foreign experience in differentiating criminal liability for banditry deserves attention, because the creation of a gang, participation in crimes committed by it, and other forms of participation in this association are different in content and degree of public danger forms of the objective side of banditry. Therefore, it is not expedient to establish criminal liability for these acts in one part of the article of the Special Part of the Criminal Code (as provided for in Article 257 of the Criminal Code of Ukraine). ; Бандитизм є одним із найнебезпечніших злочинів проти громадської безпеки. Враховуючи останні події в Україні, коли на тлі політичної та соціальної кризи у державі все частіше створюють організовані злочинні групи, часто озброєні, виникають незаконні воєнізовані формування, наявна велика кількість зброї, що на незаконних підставах знаходиться у володінні окремих осіб і рух якої дуже важко проконтролювати або відстежити, стає зрозумілим, чому збільшується кількість вчинюваних злочинів з використанням вогнепальної зброї, вибухівки як окремими особами, так і озброєними злочинними угрупуваннями. Функціонування в Україні банд, метою існування яких є вчинення озброєних нападів на підприємства, установи, організації чи на окремих осіб, загрожує як громадській безпеці, так і життю, здоров'ю окремих громадян та їх власності, перешкоджає нормальній господарській діяльності, створює стан незахищеності суспільства від злочинних посягань. Все це зумовлює необхідність вжиття з боку держави ефективних заходів, у тому числі й кримінально-правового характеру, спрямованих на протидію бандитизму. Але ефективність таких заходів навряд чи можлива без чіткого розуміння юридичної природи бандитизму, якого можна досягнути, проаналізувавши досвід кримінальної відповідальності за бандитизм у законодавстві зарубіжних країн. У кримінальному законодавстві окремих зарубіжних держав законодавець диференціював відповідальність учасників банд залежно від виконуваних ролей. Зарубіжний досвід диференціації кримінальної відповідальності за бандитизм заслуговує на увагу, оскільки створення банди, участь у вчинених нею злочинах та інші форми участі в цьому об'єднанні - різні за змістом і ступенем суспільної небезпеки форми об'єктивної сторони бандитизму. Тому встановлювати кримінальну відповідальність за ці діяння в одній частині статті Особливої частини КК (як це передбачено у ст. 257 КК України) не доцільно.

Summary In the Netherlands, many groups are sidelined regarding their labor market opportunities, i.e., youth, low-educated individuals, ethnic minorities, and partially disabled individuals, particularly in times of economic downturn. Due to increased labor market dualization, access to better jobs is reserved only for those who have mastered professional skills. TI1e public support rapidly brings the unemployed back to work but is criticized for its negligible and sometimes even adverse long-term impacts for vulnerable workers. Explanations point to the limited supportive and skills-upgrading services in this genera! approach along with the unemployed' unrepaired deficit in the desired skills, making these groups continuously prone to nonstandard employment and unemployment. More inclusive efforts might support these vulnerable workers to secure jobs more adequately, which appears to be more topical than ever, e.g., the COVID-19 crisis on unemployment. The Philips Employment Scheme ( Philips Werkgelegenheidsplan [WGP] in Dutch) offers vulnerable unemployed workers one-to-two years of work experience with (in)formal training to move participants into jobs externally. Participants are employed, seen from the outside, in regular employment. In contrast, people on public support might remain long-term unemployed and have increased risks of nonstandard employment. The literature teaches us that such programs pay off in the long run only but have little impact on short notice. However, the WGP already proved to be effective on short notice, making it an interesting case for study. This dissertation observed the extent to which this company-based work-experience program better supports low-educated and inadequately-ski!led workers to return to the labor market and to build up high levels of employment security in sustainable jobs with proper wage matches over their future careers than public activation programs based on workfare principles that !ack these human capita! and work-experience investments? Earlier studies on ALMPs limited their observation periods to one-to-five years later. In contrast, the Statistic Netherlands' register data used for this dissertation made it possible to study the long­term impact of the WGP up to ten years later. The long-term effect of the WGP is determined by comparing the labor market outcomes of its former participants (1999-2014) with a comprehensive matched control group, sharing a large number of pre-treatment covariates as participants before the intervention, but public activation entitlement instead. Findings show that WGP participants have 8% more employment security for over ten years than control units. Still, the different studies conducted in this dissertation show substantial variation in the impact of WVGP participation among these studied groups. More investment opportunities would improve vulnerable unemployed' chances to regain sustainable employment, as the WGP does with its more tailored approach. Other large companies might start similar tailor-made initiatives to improve the career opportunities of the disadvantaged, particularly in industries and regions that forecast declines in qualified personnel. This dissertation provides an argument for encouraging other employers to take up their responsibilities as well, and to invest in work experience and training for all their employees, but also urges the Dutch government to increase the budget on forma! training for the unemployed. Closer collaboration between public authorities and the business sector might forward vulnerable workers' careers, notably from a long­term perspective.

Africa, because of its weakness, its failures at many levels, and all the difficulties it faces in meeting the global standards of democracy, has over the years become the ideal receptacle for all kinds of experimentation on the issue of development.And it was only from a public finance crisis, the most emblematic manifestation of which was that of public debt, which had already begun a decade earlier, that Africans referred to structural adjustment policies. Strongly encouraged by international organizations, these countries have adopted decentralization as an effective means of good governance.Despite its adaptation in the various constitutions, decentralization really began only about fifteen years ago in many African countries such as Côte d'Ivoire, Senegal and Cameroon. Decentralization thus appears to be one of the best means of modernizing the centralized state, promoting citizen participation and good governance. It could, together with good governance, shed light on how the incumbent authorities manage state's resources.Seen as a means of economic growth and development, decentralization and good governance, according to the observations of recent years, do not seem to have the same effects in the developing countries, still tribal and especially very poor and plagued by many problems. This model of territorial organization has just become a condition for receiving international assistance.What are the causes of the failure of decentralization in West Africa, and what are the means these countries possess in order to succeed in changing the democratic ideals still locked in ancestral rites and Customs? ; L'Afrique, à cause de sa faiblesse, de ses faillites à plusieurs niveaux, et de toutes les difficultés qu'elle rencontre pour répondre aux critères mondiaux de démocratie, est devenue au fil des années, le réceptacle idéal pour toutes sortes d'expérimentation sur la question du développement. Et ce n'est qu'à partir d'une crise des finances publiques dont la manifestation la plus emblématique fut celle de la dette publique qui avait déjà été amorcée une décennie plus tôt que les Africains se sont référés aux politiques d'ajustement structurel. Fortement encouragés par les organisations internationales, ces pays ont adopté la décentralisation comme moyens efficaces de bonne gouvernance. Malgré son aménagement dans les différentes constitutions, la décentralisation a véritablement débuté il y a seulement une quinzaine d'années dans de nombreux pays africains comme la Côte d'Ivoire, le Sénégal ou le Cameroun. La décentralisation apparait donc comme l'un des meilleurs moyens de modernisation de l'appareil étatique centralisé, de promotion de la participation citoyenne et de bonne gouvernance. Elle pourrait, avec la bonne gouvernance, apporter une lumière sur la manière dont les autorités en exercice gèrent les ressources de l'État. Vu comme un moyen d'essor et d'évolution économique, la décentralisation et la bonne gouvernance, selon le constat de ces dernières années, ne semble pas avoir les mêmes effets dans les pays du sud encore tribaux et surtout très pauvres et gangrenés par de nombreux maux. Ce modèle d'organisation territorial est juste devenu une condition pour bénéficier de l'aide internationale. Quelles sont les causes de l'échec de la décentralisation en Afrique de l'Ouest, et de quels moyens disposent ces États pour réussir à faire évoluer les idéaux démocratiques encore enfermés dans des rites et coutumes ancestrales ?
