The text also gives an overview of the general rules of the Code of Private International law, with specific attention to the innovations (such as the escape clause to be found in Article 19).

Gerechtigkeitsbelange treten in den internationalen Beziehungen häufig auf. Sie sind in allen Verhandlungen präsent und daher ein Kernbestandteil internationaler Diplomatie. Einen Gegenstand mit dem Etikett 'Gerechtigkeit' zu versehen, kann in derselben Weise als Sprechakt analysiert werden, wie der Vorgang der 'Versicherheitlichung' ('securitization'). 'Justization' definiert eine Sachfrage als moralisch relevant, emotional belastet und nur bedingt kompromissfähig. Der Sprechakt signalisiert internationalen Partnern eine harte Verhandlungsposition und dient der Mobilisierung der einheimischen Öffentlichkeit. Ist es zur 'Justization' gekommen, so haben Diplomaten und politische Führungen später Probleme, Verhandlungskompromisse an die Öffentlichkeit zu verkaufen, die zuvor mit Gerechtigkeitsansprüchen mobilisiert wurde. Öffentliche Diplomatie, in der Gerechtigkeitsbelange auftreten, macht daher Einigungen schwieriger. Da Gerechtigkeitsvorstellungen in kulturellen Traditionen verankert sind, die sich erheblich unterscheiden können, ist für Verständigung, Kompromiss und Lösungen die Brückenbildung über die Kulturgrenzen hinweg nötig. Das ist zwar nicht unmöglich, ist aber zugleich eine gewaltige Aufgabe. Der Autor beschäftigt sich in seinem HSFK-Arbeitspapier mit der Analyse von 'Justization' und ihren Folgen, die einen Wissenszuwachs über das Wesen von Verhandlungen verspricht, indem sie den herkömmlichen Interessenanalysen eine wichtige moralische Dimension hinzu fügt.

Die Studie untersucht aus einer konstruktivistischen Perspektive den möglichen Einfluss der transnationalen Öffentlichkeit auf die Installierung von internationalen Menschenrechtsnormen in Ländern mit einem beobachtbaren Ausmaß an Menschenrechtsverletzungen. So argumentiert die Autorin, dass ein Wandel im Bereich der staatlichen Menschenrechtspolitik in einem 'Zielstaat' über Herausbildung einer problemfeldspezifischen, transnationalen Öffentlichkeit vermittelt ist. Über diese Öffentlichkeit gelingt es zivilgesellschaftlichen Akteuren (Menschenrechtsorganisationen), Einfluss auf die Menschenrechtspolitik in dem Zielstaat zu nehmen, indem die menschenrechtsverletzende Herrschaftspraxis angeprangert und damit einer systematischen Kritik zugänglich gemacht wird. In einem ersten Schritt wird zunächst das Konzept einer transnationalen Öffentlichkeit vorgestellt und gezeigt, in welcher Art und Weise sich im Bereich Menschenrechte eine problemfeldspezifische Teilöffentlichkeit herausgebildet hat. Ferner wird die Hauptthese der Untersuchung theoretisch fundiert und auf die methodische Vorgehensweise, die Inhaltsanalyse amtlicher Veröffentlichungen und Publikationen der Menschenrechtsorganisationen, eingegangen. Im zweiten Schritt wird am Beispiel der öffentlichen Debatte über Menschenrechte in Indonesien 1979-1993 aufgezeigt, auf welche Weise sich hier eine transnationale Öffentlichkeit herausgebildet hat, wie sich diese auf eine nationale Öffentlichkeit ausgewirkt und wie sie schlussendlich einen Wandel in der nationalen Menschenrechtspolitik Indonesiens herbeigeführt hat. Im dritten Schritt wird schließlich detaillierter illustriert, wie sich die Schaffung einer transnationalen Öffentlichkeit auf die Menschenrechtspolitik des Suharto-Regimes 1979-1993 ausgewirkt hat. Dabei wird argumentiert, dass eine transnationale Opportunitätsstruktur aus transnationalen Menschenrechtsnetzwerken einerseits und den Vereinten Nationen auf der anderen Seite dazu beigetragen hat, Osttimor auf der Agenda einer internationalen Weltöffentlichkeit zu halten. The 140th session of the Governing Body of the International Labor Office was held in Geneva from November 18–21, 1958. It decided to place three new items on the agenda of the 44th (1960) session of the International Labor Conference, viz.: contribution of the International Labor Organization (ILO) to the raising of incomes and living conditions in rural communities in countries in process of development; reduction of hours of work; and workers' housing. In general, the Governing Body endorsed the suggestions before it regarding action to be taken on the resolutions adopted by the International Labor Conference at its 42d session, specifically by authorizing the Director-General to communicate to the governments of member states resolutions concerning publication of labor laws, industrial health and safety campaigns, management development, and the expansion of international trade. The resolution regarding the last topic was also to be sent to the UN and to the Executive Secretary of the General Agreement on Tariffs and Trade. A resolution dealing with labor-management relations was to be communicated to governments with the request that they bring it to the attention of employers' and workers' organizations, while a resolution concerning increased technical assistance for the integration of indigenous populations was to be sent to governments, to the UN, and to several relevant specialized agencies.

This essay examines the relationship between history and theory through a historical and political analysis of the rise of distinctly social theories, concepts, and practices in the 'long 19th century'. Sociomania, obsession with things 'socio', is a problem in international theory. It is also a serious missed opportunity for Buzan and Lawson's study of the 19th century. The Global Transformation contributes to international theory in showing how mainstream IR has failed to grasp the full significance of this period. But, in this crucial regard at least, so too have its authors. In adopting rather than fully historicizing the rise and expansion of social theories, works of 'historical social science' obscure rather than illuminate the historical and political origins of social forms of governance and thought; underestimate their significance for the history of international theory; and are unable to identify the more fundamental governance form of which the rise of the modern social realm is a concrete historical expression.
