In 1998, the source materials of the Polish Ethnographic Atlas – collected over many decades with the participation of the Institute of History of Material Culture (a unit of the Polish Academy of Sciences) and several leading ethnological centres – were moved to the Cieszyn Branch of the University of Silesia (currently the Faculty of Ethnology and Education). It was then that Z. Kłodnicki, the editor of the PEA, came up with the idea to continue and finish the atlas studies. However, the work on fulfilling the PEA, the biggest project in the history of Polish ethnology, is still going on. Nowadays, the materials of the Polish Ethnographic Atlas constitute a precious, unique in the national scale, documentary base. For several years, a lively cooperation has taken place between the PEA staff (representing the Faculty of Ethnology and Education of the University of Silesia) and various cultural institutions, government and non-government organizations. The discussed projects are usually aimed at the preservation and protection of the cultural heritage of the Polish village as well as the broadly related promotion actions for activating local communities. The workers of the Polish Ethnographic Atlas since 2014 have been also implementing the Ministry grant entitled The Polish Ethnographic Atlas – scientific elaboration, electronic database, publication of the sources in the Internet, stage I (scientific supervision: Ph.D. Agnieszka Pieńczak). What is an integral assumption of the discussed project is the scientific elaboration of three electronic catalogues, presenting the PEA resources: 1) field photographs (1955-1971) 2) the questionnaires concerning folk collecting (1948-1952), 3. the published maps (1958-2013). These materials have been selected due to their documentary value. The undertaking has brought about some measurable effects, mostly the special digital platform www.archiwumpae.us.edu.pl. This material database of ethnographic data might become the basis for designing various non-material activities aimed at preserving the cultural heritage of the Polish village. ; DIAKOWSKA E. La politique monétaire est l'action par laquelle l'autorité monétaire, en générale la banque centrale agit sur l'offre de monnaie dans le but de remplir son objectif de stabilité des prix. Elle tâche également d'atteindre les autres objectifs de la politique monétaire, qualifié de triangle Keynésien : la croissance, le plein emploi, l'équilibre extérieur. La politique monétaire se distingue de la politique budgétaire. La politique monétaire peut avoir pour objectif de maintenir le taux de change de la monnaie nationale avec une monnaie. La fixité des taux de change peut-être obtenue par la banque centrale en vendant et en achetant des devises au jour pour atteindre le taux objectif. L'objectif déclare de la politique monétaire que mène la Banque Centrale au Congo est d'obtenir et de maintenir la stabilité des prix à travers l'ajustement de l'offre de monnaie à la demande de monnaie. Pour mettre en oeuvre celle-ci, la Banque Centrale du Congo détermine le cadre de pilotage à travers lequel la politique monétaire sera mise en oeuvre au cours de l'année. A partir de ce cadre, elle décide la mesure dans laquelle il convient de réserver ou d'assouplir les conditions monétaires. En effet, il ressort des analyses effectuées sur l'évolution de la conjoncture en République Démocratique du Congo au cours de ces trois dernières décennies (entre 1970 et 2000), que les épisodes de dépréciations de la monnaie nationale (Zaïre, Nouveau Zaïre et/ou Franc congolais) correspondent très souvent à une accélération du rythme de formation des prix intérieurs, de même que les périodes de fortes tensions inflationnistes se caractérisent également par des pertes de vitesse de la monnaie nationale par rapport aux devises étrangères. Fort de ces considérations, nous posons les questions suivantes : - Est-ce que le Franc congolais est stable ? - Quelles sont les politiques de la BCC pour soutenir la stabilité du Franc congolais ? Les réponses à ces questions constituent l'objet même de nos investigations tout au long de la présente étude. A travers l'article on a analysé les difficultés de la politique monétaire dans le contexte de la dollarisation complète de système bancaire et les faiblesses institutionnelles. L'analyse empirique confirme que la Banque centrale en République Démocratique du Congo est en mesure de contrôler la quasi-inflation, malgré qu'on pourrait avoir une réaction rapide des chocs inflationnistes. Après avoir analysé les avantages et les inconvénients des différents régimes de taux de change, on peut affirmer que le renforcement du cadre actuel de la politique monétaire reste la meilleure solution, étant donné que le pays est exposé aux nombreuses échanges de monnaies étrangères (change de devises). L'augmentation de l'exigence de réserve semble contredire d'autres mesures prises par la banque centrale. Le taux d'intérêt est conçu pour réguler la liquidité dans le système financier et influe sur le développement de l'activité économique. Il est l'un des principaux outils des autorités monétaires pour influencer l'octroi de prêts et de l'inflation de modulation dans le pays. ; Polityka pieniężna jest procesem, w ramach którego władze monetarne, na ogół bank centralny, wpływają na podaż pieniądza dążąc do realizacji celu, jakim jest stabilność cen. Dążą one również do osiągnięcia innych celów zwanych keynesowskim trójkątem: wzrostu gospodarczego, pełnego zatrudnienia i równowagi zewnętrznej. Polityka pieniężna różni się od polityki fiskalnej. Polityka pieniężna dąży do utrzymania kursu wymiany waluty krajowej. Celem państwa w ramach polityki pieniężnej jest osiągnięcie i utrzymanie stabilności cen poprzez dostosowanie podaży pieniądza do popytu na pieniądz. Aby móc to zrealizować Bank Centralny Konga określa ramy kontroli, w jakich polityka pieniężna będzie realizowana w ciągu roku. Jak wynika z analizy sytuacji w Demokratycznej Republice Konga w latach 1970–2000 można zaobserwować, iż deprecjacji waluty krajowej odpowiadają przyspieszone tempo wzrostu cen w kraju, a także okresy silnych presji inflacyjnych. W związku z podjętymi rozważaniami nasuwają się następujące pytania: - Czy frank kongijski jest stabilny? - Czy polityka pieniężna Kongijskiego Banku Centralnego wspiera stabilność franka kongijskiego? Odpowiedzi na te pytania stanowią przedmiot badań. W artykule dokonano analizy trudności w zakresie polityki pieniężnej w kontekście szerokiej dolaryzacji systemu bankowego i słabości instytucjonalnej. Empiryczna analiza potwierdza, że Bank Centralny w Kongu jest w stanie niemalże kontrolować inflację, pomimo szybkiej reakcji na szoki inflacyjne. Po przeanalizowaniu zalet i wad różnych reżimów kursowych, można stwierdzić, że wzmocnienie obecnych ram polityki pieniężnej pozostaje najlepszym rozwiązaniem, biorąc pod uwagę, że kraj jest podatny na częste wstrząsy walutowe. Zwiększanie rezerwy obowiązkowej wydaje się sprzeczne z innymi środkami stosowanymi przez bank centralny. Stopa procentowa pozwala na regulowanie płynności w systemie finansowym oraz wpływa na rozwój działalności gospodarczej. Jest ona jednym z głównych instrumentów, którymi władza monetarna wpływa na przyznawanie kredytów i modulowanie inflacji w kraju. ; The monetary policy is the action by which the monetary authority, as a central bank influences the supply of money in order to fulfill its objective of price stability. She also task of achieving the other objectives of monetary policy, called Keynesian triangle: growth, full employment, external balance. Monetary policy differs from fiscal policy. Monetary policy can aim to maintain the exchange rate of the national currency with a currency. Fixed exchange rates may be achieved by the central bank selling and buying currency at the day to reach the target rate. The objective of monetary policy states that leads the Central Bank in the Congo is to achieve and maintain price stability through adjustment of the money supply to money demand. To implement this, the Central Bank of Congo determines the control framework through which monetary policy will be implemented during the year. From this framework, it decides the extent to which it is appropriate to reserve or ease monetary conditions. Indeed, it is apparent from analysis of the evolution of the situation in the Democratic Republic of Congo over the past three decades (1970 to 2000), the episodes of depreciation of the national currency (Zaire and New Zaire / or Congolese franc) are often at a faster pace of domestic price formation, as well as periods of heavy inflationary pressures are also characterized by speed loss of the national currency against foreign currencies. With these considerations, we ask the following questions: - Is the Congolese franc stable? - What are BCC's policies to support the stability of the Congolese Franc? The answers to these questions are the object of our investigations throughout this study. Throughout the article we analyzed the difficulties of monetary policy in the context of complete dollarization of the banking system and institutional weaknesses. The empirical analysis confirms that the Central Bank in the Democratic Republic of Congo is able to control almost inflation, despite that we could have a rapid response to inflationary shocks. After analyzing the advantages and disadvantages of different exchange rate regimes, it can be said that strengthening the current framework of monetary policy remains the best solution, given that the country is exposed to numerous exchanges of foreign currency (exchange currencies). The increase in the reserve requirement seems to contradict other measures taken by the central bank. The interest rate is designed to regulate liquidity in the financial system and affects the development of economic activity. It is one of the main tools of monetary authorities to influence lending and inflation modulation in the country.

Augmented reality (AR) can potentially change the driver's user experience in significant ways. In contrast of the AR applications on smart phones or tablets, the Head-Up-Displays (HUD) technology based on a part or all wind-shield project information directly into the field of vision, so the driver does not have to look down at the instrument which maybe causes to the time-critical event misses. Until now, the HUD designers try to show not only basic information such as speed and navigation commands but also the aids and the annotations that help the driver to see potential dangers. However, what should be displayed and when it has to be displayed are still always the questions in critical driving context. In another context, the pedestrian safety becomes a serious society problem when half of traffic accidents around the world are among pedestrians and cyclists. Several advanced Pedestrian Collision Warning Systems (PCWS) have been proposed to detect pedestrians using the on-board sensors and to inform the driver of their presences. However, most of these systems do not adapt to the driver's state and can become extremely distracting and annoying when they detect pedestrian. For those reasons, this thesis focuses on proposing a new concept for the PCWS using AR (so called the AR-PCW system). Firstly, for the «When» question, the display decision has to take into account the driver's states and the critical situations. Therefore, we investigate the modelisation of the driver's awareness of a pedestrian (DAP) and the driver's unawareness of a pedestrian (DUP). In order to do that, an experimental approach is proposed to observe and to collect the driving data that present the DAP and the DUP. Then, the feature-based algorithms, the data-driven models based on the discriminative models (e.g. Support Vector Machine) or the generative models (e.g. Hidden Markov Model) are proposed to recognize the DAP and the DUP. Secondly, for the «What» question, our proposition is inspired by the state-of-the-art on the AR in the driving context. The dynamic bounding-box surrounding the pedestrian and the static danger panel are used as the visual aids. Finally, in this thesis, we study experimentally the benefits and the costs of the proposed AR-PCW system and the effects of the aids on the driver. A fixed-based driving simulator is used. A limited display zone on screen is proposed to simulate the HUD. Twenty five healthy middle-aged licensed drivers in ambiguous driving scenarios are explored. Indeed, the heading-car following is used as the main driving task whereas twenty three pedestrians appear in the circuit at different moment and with different behaviors. The car-follow task performance and the awareness of pedestrian are then accessed through the driver actions. The objective results as well as the subjective results show that the visual aids can enhance the driver's awareness of a pedestrian which is defined with three levels: perception, vigilance and anticipation. This work has been funded by a Ministry scholarship and was carried out in the framework of the FUI18 SERA project, and the Labex MS2T which is funded by the French Government, through the program "Investments for the future" managed by the National Agency for Research (Reference ANR-11-IDEX-0004-02). ; La réalité augmentée (Augmented Reality ou AR) peut potentiellement changer significativement l'expérience utilisateur. Au contraire les applications sur Smartphone ou tablette, les technologies d'affichage tête haute (Head Up Display ouHUD) aujourd'hui sont capables de projeter localement sur une zone du pare-brise ou globalement sur tout le pare-brise. Le conducteur peut alors percevoir l'information directement dans son champ de vision. Ce ne sont pas que les informations basiques comme vitesse ou navigation, le système peut aussi afficher des aides, des indicateurs qui guident l'attention du conducteur vers les dangers possibles. Il existe alors un chalenge scientifique qui est de concevoir des visualisations d'interactions qui s'adaptent en fonction de l'observation de la scène mais aussi en fonction de l'observation du conducteur. Dans le contexte des systèmes d'alerte de collision avec les piétons (Pedestrian Collision Warning System ou PCWS), l'efficacité de la détection du piéton a atteint un niveau élevé grâce à la technologie de vision. Pourtant, les systèmes d'alerte ne s'adaptent pas au conducteur et à la situation, ils deviennent alors une source de distraction et sont souvent négligés par le conducteur. Pour ces raisons, ce travail de thèse consiste à proposer un nouveau concept de PCWS avec l'AR (nommé the AR-PCW system). Premièrement, nous nous concentrons sur l'étude de la conscience de la situation (Situation Awareness ou SA) du conducteur lorsqu'il y a un piéton présent devant le véhicule. Nous proposons une approche expérimentale pour collecter les données qui représentent l'attention du conducteur vis-à-vis du piéton (Driver Awareness of Pedestrian ou DAP) et l'inattention du conducteur vis-à-vis de celui-ci (Driver Unawareness of Pedestrian ou DUP). Ensuite, les algorithmes basées sur les charactéristiques, les modèles d'apprentissage basés sur les modèles discriminants (ex, Support Vector Machine ou SVM) ou génératifs (Hidden Markov Model ou HMM) sont proposés pour estimer le DUP et le DAP. La décision de notre AR-PCW system est effectivement basée sur ce modèle. Deuxièmement, nous proposons les aides ARs pour améliorer le DAP après une étude de l'état de l'art sur les ARs dans le contexte de la conduite automobile. La boite englobante autour du piéton et le panneau d'alerte de danger sont utilisés. Finalement, nous étudions expérimentalement notre système AR-PCW en analysant les effets des aides AR sur le conducteur. Un simulateur de conduite est utilisé et la simulation d'une zone HUD dans la scène virtuelle sont proposés. Vingt-cinq conducteurs de 2 ans de permis de conduite ont participé à l'expérimentation. Les situations ambigües sont créées dans le scénario de conduite afin d'analyser le DAP. Le conducteur doit suivre un véhicule et les piétons apparaissent à différents moments. L'effet des aides AR sur le conducteur est analysé à travers ses performances à réaliser la tâche de poursuite et ses réactions qui engendrent le DAP. Les résultats objectifs et subjectifs montrent que les aides AR sont capables d'améliorer le DAP défini en trois niveaux : perception, vigilance et anticipation. Ce travail de thèse a été financé sur une bourse ministère et a été réalisé dans le cadre des projets FUI18 SERA et Labex MS2T qui sont financé par le Gouvernement Français, à travers le programme « Investissement pour l'avenir » géré par le ANR (Référence ANR-11-IDEX-0004-02).

The research is originated from the concern of understanding the role of architecture in a complex social phenomenon, as is the tangibility of social abstractions through institutions. lt is studied why and how this relationship between social and physical is produced in architecture, and specifically, how it is manifested in the case of the State of Chile, in a singular political social period, marked by a republican ethical sense. This investigation is born from the need to understand the role architecture has in the materialization of social abstractions through institutions, beyond stylistic or formal considerations. lt allows to demonstrate that the recognition of the main architectural works is simultaneously a recognition of a social volition which has an ethical and value-based character that is embodied in architecture, in parallel to its own spatial and technical values. Projects therefore are a social co-construction, a specific praxis that changes the behavior of the daily social life organization. History is observed in relation to a specific project and the categories of its time and its society, because they are a product of an evolution based on a social dialogue. The sociocentrism is revalidated in the study of architecture and history in general. The investigation is divided into three parts: first, an elaboration of a theoretical framework that addresses the concepts of abstraction, dialog and identity, as parts of a social significance process. This framework is orientated to explain the existence and strengthening of social abstractions that acquire identity by means of a social dialog and that operate over certain institutions to configure them as ideological state apparatuses. Second, an elaboration of the development of the Chilean state and its actions in the 1932-1973 period, in function of a group of ideas that are key to understand the institutions which establish a modern ethos, associated to social progress ideas. Third, the focus is on specifically, how the state has materialized a certain architecture, which has played a relevant social role in the configuration ofthe nation·s identity, through 8 key buildings: the Law School of the University of Chile, the Military Academy, the Votive Church of Maipu, the Bank of the State, the Medicine School of the University of Chile, the Naval Academy in Valparaíso, the Cepal Headquarters and the Ministry of Labor. These buildings were chosen from a series of public tenders, and are the most significant in the public works of the State. Finally, two emblematic cases are analyzed in depth: the Law School of the University of Chile and the Cepal Headquarters.These cases are considered paradigmatic examples of the relationship with national social abstractions: from the national developmentalist discourse to the abstraction of structural changes, which means, the ideology-utopia with which these study cases are refigured. For the Thesis is it relevant to study the state works as a whole, by its condition of being the physical support and simultaneously the testimony of an interaction between the particular abstraction of a peripheric and open mind society as the chilean one, with the generic abstractions of the dominant world culture. The study cases can be recognized as a partial synthesis situation in that interaction, and with identity value. lt is attached, in addition, a series of theoretical, historical, political annexes, that bring specific information about the study cases, that are part of the investigation, that allow timely deepening o wider frameworks to understand the presented phenomena. ; La investigación nace de la inquietud por comprender el papel de la arquitectura en un fenómeno social complejo como lo es la tangibilización de sus abstracciones sociales a través de instituciones. Se estudia por qué y cómo se produce esta relación de puente entre lo social con lo físico en la arquitectura y específicamente cómo se ha dado en el caso del Estado de Chile, en un período político social marcado por un sentido ético republicano. La utilidad de esta investigación está en incorporar una dimensión histórico social más abstracta en los antecedentes, que permitan valorar una cierta arquitectura sobre una base identitaria, más allá de consideraciones estilísticas o formales. Permite demostrar que el reconocimiento a algunas de las más importantes obras en Chile es simultáneamente un reconocimiento a una voluntad social de carácter ético y valórico que se plasmó en la arquitectura, en paralelo a sus propios valores espaciales y técnicos. Los proyectos por lo tanto, constituyen una co-construcción social, una praxis concreta que modifica conductas de la organización social de la vida diaria. Se observa la historia en función de un proyecto y de las categorías de su época y su sociedad, pues son producto de su evolución en base a un diálogo social. Se revalida el sociocentrismo en el estudio de la arquitectura y de la historia en general. Se desarrolla en tres partes: primero se elabora un marco teórico que aborda los conceptos de abstracción,dialogía e identidad, como partes de un proceso de significación social. Este marco se orienta a explicar la existencia y consolidación de abstracciones sociales que producto del diálogo socialadquieren identidad y que operan sobre ciertas instituciones para configurarlas como aparatos ideológicos del Estado. Segundo, se desarrolla el devenir del Estado de Chile y sus acciones en el período entre 1932 y 1973, en función de un grupo de ideas que son claves para comprender las instituciones que instauran un ethos moderno, asociado a ideas de progreso social. Tercero, se desarrolla específicamente cómo el Estado ha materializado una cierta arquitectura, que ha cumplido un rol social relevante en la conformación de la identidad nacional, a través de 8 proyectos claves: la Escuela de Derecho de la Universidad de Chile, la Escuela Militar, elTemplo Votivo de Maipú, el Banco del Estado, la Escuela de Medicina de la Universidad de Chile, la Escuela Naval de Valparaíso, la sede para la Cepal y el Ministerio del Trabajo. Estos edificios son los más significativos en la obra del Estado en el período y fueron convocados mediante concurso. Finalmente se resumen dos de ellos (la Escuela de Derecho de la Universidad de Chile y la sede para la Cepal) como ejemplos paradigmáticos de relación con las abstracciones sociales nacionales: desde el discurso nacional desarrollista a la abstracción de los cambios estructurales, es decir, la ideología-utopía con que se pueden refigurar estos casos de estudio. Para la tesis es relevante estudiar la obra del Estado como conjunto por su condición de ser el soporte físico y a la vez el testimonio de una interacción entre las particulares abstracciones de una sociedad periférica y abierta como la chilena con las abstracciones genéricas de la cultura mundial dominante. Los casos en estudio pueden ser reconocidos como situaciones de síntesis parcial en dicha interacción y con valor de identidad. Dottorato di ricerca in Diritto dei contratti pubblici e privati ; La finalità principale sottesa al presente lavoro di ricerca è stata, in primo luogo, l'indagine circa le ragioni che hanno portato, già da tempo, il legislatore europeo e quello nazionale a ritenere necessaria l'istituzione di un sistema ad hoc dedicato alla vigilanza sul settore degli appalti (strutturato in Italia, come più volte evidenziato, in due sottosistemi paralleli, amministrativo e giurisdizionale), nonché verificare se l'interesse pubblico generale a tutela del quale tale sistema è stato predisposto sia rimasto lo stesso nel tempo, o se le esigenze iniziali siano invece mutate alla luce delle nuove necessità proprie di un settore in cui in primis il legislatore sovranazionale ha ritenuto di dover reintervenire mediante l'emanazione delle direttive appalti e concessioni del 2014. Una volta individuata la finalità posta alla base, come detto, della creazione di un siffatto sistema di vigilanza (ossia la c.d. concorrenza nel mercato, che si persegue mediante la conformazione dell'operato degli agenti pubblici e privati del settore alle prescrizioni dell'evidenza pubblica), ci si è posti il problema di verificare se in concreto sia possibile parlare propriamente di "sistema", ossia di "modello" unitario di vigilanza, il quale presuppone non solo l'individuazione di istituzioni od organismi cui affidare specifici poteri di intervento, ma altresì il coordinamento degli stessi in maniera logica ed ordinata. Ciò innanzitutto con riferimento al nostro sistema di vigilanza sui contratti, mediante l'analisi, da un lato, delle principali questioni problematiche inerenti alla natura e alla modalità di esercizio dei poteri affidati all'autorità amministrativa nazionale preposta al controllo sul settore (nonché agli effetti prodotti dall'esercizio di tali poteri sia sulla fase che precede la stipula del contratto sia sull'esecuzione dello stesso), dall'altro, degli strumenti di intervento riconosciuti al potere giurisdizionale in generale e al giudice amministrativo nello specifico. Il periodo di ricerca svolto in Francia ha altresì consentito di verificare come un sistema giuridico, nel suo complesso, e un sistema di vigilanza sui contratti, in particolare, possa presentare peculiarità proprie profondamente diverse, nonostante la radice comune degli ordinamenti giuridici e la vicinanza stessa dei paesi in questione. Ed infatti, appare sufficiente evidenziare come l'ordinamento transalpino abbia da sempre deciso di porre al centro del proprio sistema di vigilanza sugli appalti il giudice amministrativo, ritenendo non necessario affiancare allo stesso una specifica autorità indipendente di settore (ciò non significa che sia del tutto ignorata una forma di vigilanza di tipo amministrativo) cui affidare l'esercizio di una funzione di controllo per così dire ex ante, ma al contrario riconoscendo a tale apparato del potere giurisdizionale la possibilità di intervenire in maniera sempre più incisiva sullo stesso assetto contrattuale prescelto dalle parti, mediante l'introduzione di strumenti quali il référé precontractuel, il recours de plein contentieux e il riconoscimento della legittimazione ad agire in giudizio altresì a soggetti terzi non partecipanti alla procedura ad evidenza pubblica. Alla luce dell'analisi compiuta, appare in maniera evidente come entrambi i sistemi esaminati presentino limiti ed incoerenze, mettendo altresì in alcuni casi a rischio principi costituzionali quali la divisione dei poteri (ci si riferisce al potere regolatorio attribuito in Italia all'A.N.AC., alla quale è stata da ultimo riconosciuta altresì la possibilità di emanare atti di regolazione aventi carattere vincolante, e allo stesso modo al crescente utilizzo da parte dell'esecutivo francese degli strumenti dell'ordonnance e del décret). In conclusione, si è poi evidenziato come la recentissima emanazione del nuovo Codice appalti (d.lgs. n. 50/2016) costituisca un punto di partenza per la creazione, nel nostro ordinamento, di un reale ed efficiente "sistema" di vigilanza, in un'ottica di superamento delle contraddizioni e delle lacune proprie del sistema previgente. Vengono analizzate, dunque, ulteriormente le principali problematiche connesse alla convivenza nel nostro ordinamento di un sistema di controllo amministrativo ed uno giurisdizionale, cercando allo stesso tempo di individuare i pregi di un sistema così strutturato nel suo complesso rispetto a quello prescelto dall'ordinamento francese. ; The purpose behind this research work was, first of all, to investigate the reasons why the European and Italian legislators consider the need to establish an ad hoc system dedicated to monitoring public procurement (structured in Italy, in two parallel subsystems, judicial and administrative), and verify if the general public interest for which that system was implemented remains the same over time, or if the initial requirements are changing in the light of the new needs of a sector in which the European legislator has deemed it necessary to operate by issuing the "Public procurement and concession" Directives of 2014. Once the basic objectives of the supervisory system are identified, (i.e. market competition, that is obtained when the activities of public and private agents comply with public tender requirements), the issue remains if it can be correctly defined as a "system" or unique supervisory "model", which presumes not only the identification of institutions or bodies, which confer specific powers of intervention, but also their coordination thereof in a logical and orderly manner. This, firstly, with reference to the Italian system of public procurement supervision through an analysis, on one hand, of the main issues related to the nature and procedures of the powers entrusted to the Italian administrative authorities (in addition to the results of the exercise of those powers both prior to the contract's conclusion and its execution) and, on the other hand, of the instruments acknowledged to the judge (in particular to the administrative judge). Furthermore, the period of research carried out in France highlights how a legal system, as a whole, and a system of contract supervision, in particular, can present very different peculiarities, despite the common origin of the legal systems and the nearness of the countries concerned. In fact, the French judicial system places the administrative judge at the center of its procurement system of supervision, deeming the institution of a specific independent administrative authority unnecessary (that doesn't mean it completely lacks a form of administrative supervision), but rather gives the judge the faculty of intervening in a more effective way on the contractual arrangement chosen by the parties, by introducing the référé precontractuel, the recours de plein contentieux and giving anyone not included in the public tender the possibility of taking legal action. Based on the analysis carried out, both systems investigated have limitations and inconsistencies, putting at risk, in some cases, constitutional principles such as the separation of powers (i.e. the regulatory power attributed to A.N.AC., which was finally recognized the possibility of enacting regulation acts having binding force, as well as the increasing use of ordonnance and décret by French Government). In conclusion, it pointed out that the recent adoption of the new Italian Code of Public procurement (d.lgs. n. 50/2016) constitutes a first step for creating a real and efficient supervisory system, with a view to overcoming the contradictions and shortcomings of the existing system. Therefore, further major issues, related to the coexistence in the Italian system of both (judicial and administrative) controls, are analyzed, trying at the same time to identify the qualities of this system compared to the one chosen by the French law.

No atual sistema internacional, as migrações internacionais têm que ser reguladas e geridas pelos Estados, de modo a garantir o impacto positivo destes nos países de acolhimento e a sua integração, bem como assegurar que os migrantes que entram sejam tratados com dignidade e vejam reconhecidos os seus direitos. No entanto, a experiência indica que este ideal nem sempre se produz e os Estados podem ver os fluxos migratórios, principalmente os irregulares, como uma ameaça. É neste sentido que focamos o nosso estudo na gestão dos fluxos migratórios no Mediterrâneo, na perspetiva da segurança internacional. A gestão das migrações no Mediterrâneo é um dos principais desafios que a União Europeia (UE) enfrenta na atualidade. Os intensos fluxos migratórios que se registaram durante o ano de 2015 e as tragédias no mar Mediterrâneo puseram à prova os mecanismos das políticas de imigração e asilo da União e a sua capacidade de responder a crises humanitárias. Para além disso, estes fluxos de intensidades e geografias variadas representam uma ameaça para a segurança interna da União Europeia e dos seus Estados Membros. Ora, com o objetivo de garantir a segurança das suas fronteiras externas, a abordagem da UE centra-se na dimensão da segurança na definição de estratégias de gestão das migrações irregulares. Assim, no âmbito da gestão das migrações no Mediterrâneo tomamos como estudo de caso três países: Espanha, Itália e Portugal, que nos oferecem um estudo comparativo entre a gestão das rotas da África ocidental e do Mediterrâneo ocidental e central. O caso português, de modo particular, permite a análise de uma realidade distinta no âmbito europeu, bem como a realização de um trabalho sobre a gestão de fronteiras em Portugal, tema muito pouco trabalhado a nível académico. Constatamos que o sucesso do modelo de governança das migrações no Mediterrâneo resulta da interdependência entre diferentes níveis de ação (bilateral, multilateral e regional) e atores e que, na atualidade, prevalece a dimensão de deterrence (dissuasão), através da gestão das fronteiras externas e cooperação com países terceiros, incluindo a externalização da fronteira. Assim, partimos da hipótese de que a UE, dada a sua incapacidade para adotar e implementar uma política comum capaz de gerir com eficácia os fluxos migratórios na sua fronteira sul recorre a uma estratégia dissuasória, baseada em denominadores mínimos comuns. ; In today's international system, international migrations should be regulated and managed by States, in order to ensure their positive impact in host countries and migrants' integration. Furthermore, they should also guarantee a fair treatment of migrants and the recognition of their rights. However, experience has showed that this ideal does not always become a reality and States may conceive migratory flows, particularly irregular ones, as a threat. With this in mind, we have focused our study in the management of migratory flows in the Mediterranean, within an international security perspective. The management of migrations in the Mediterranean is one of the greatest challenges that the EU (European Union) currently faces. The intense migratory flows registered during the year 2015 and the tragedies in the Mediterranean Sea have tested the mechanisms of the Union's immigration and asylum policies and its ability to respond to humanitarian crises. Moreover, these flows of varying intensities and geographies represent a threat to the internal security of the EU and its Member States. Therefore, in order to guarantee the safety of the external borders, the EU's approach focuses on the security dimension in the definition of strategies to manage irregular migrations. In the context of the management of migrations in the Mediterranean we have taken the study of three Southern European countries: Spain, Italy and Portugal, given that those countries offer us a comparative study of the management of the Western Africa and Western and Central Mediterranean routes. Furthermore, the Portuguese case allows for the analysis of a different reality at the European level, as well as a thorough research on border management in Portugal, an understudied topic within the academia. We found that the success of a model of migrations' governance of in the Mediterranean results from the interdependency of different levels of action (bilateral, multilateral and regional) and actors; and presently the dimension of deterrence through the management of the external borders and cooperation with third countries, including the externalisation of the border, prevails. Therefore, we assume that the EU, given its inability to adopt and implement a common policy to effectively manage migratory flows on its Southern border uses a deterrence strategy based on minimum common denominators. ; En el sistema internacional, las migraciones internacionales tienen que ser reguladas y gestionadas por los Estados, con el fin de garantizar el impacto positivo de los migrantes en los países de acogida y su integración, así como asegurar que los migrantes que entran sean tratados con dignidad y vean reconocidos sus derechos. Sin embargo, la experiencia indica que este ideal no siempre se produce y los Estados pueden ver como una amenaza los flujos migratorios, en particular los irregulares. Es en este sentido en el que enfocamos nuestro estudio sobre la gestión de los flujos migratorios en el Mediterráneo, desde la perspectiva de la seguridad internacional. La gestión de las migraciones en el Mediterráneo es uno de los principales retos que la Unión Europea (UE) enfrenta en la actualidad. Los intensos flujos migratorios que se han registrado durante el año 2015 y las tragedias en el mar Mediterráneo han puesto a prueba los mecanismos de las políticas de inmigración y asilo de la Unión y su capacidad de responder a las crisis humanitarias. Además, estos flujos de intensidades y geografías variadas pueden representar una amenaza para la seguridad interna de la Unión Europea y de sus Estados miembros. Asimismo, con el objetivo de garantizar la seguridad de sus fronteras externas, el enfoque de la UE se ha centrado en la dimensión de la seguridad con un énfasis en la definición de estrategias de gestión de las migraciones irregulares. En el contexto de la gestión de las migraciones en el Mediterráneo hemos elegido como estudio de caso tres países: España, Italia y Portugal, que nos permiten realizar un análisis comparativo entre la gestión de las rutas del África occidental y del Mediterráneo occidental y central. En particular, el caso portugués permite la observación de una realidad distinta en el ámbito europeo, por lo que resulta muy pertinente la realización de un trabajo sobre la gestión de fronteras en Portugal, tema muy poco trabajado a nivel académico. Constatamos que el éxito del modelo de gobernanza de las migraciones en el Mediterráneo resulta de la interdependencia entre los diferentes niveles de acción (bilateral, multilateral y regional) y los distintos actores y que, en la actualidad, prevalece la dimensión de deterrence (disuasión), a través de la gestión de las fronteras externas y la cooperación con países terceros, incluyendo la externalización de la frontera. Asimismo, partimos de la hipótesis de que la UE, por su incapacidad para adoptar e implementar una política común capaz de gestionar con eficacia los flujos migratorios en su frontera sur utiliza una estrategia disuasoria, basada en mínimos comunes denominadores.

La tesis doctoral analiza el funcionamiento de la audiencia de Lima en la segunda mitad del siglo XVIII, destacando que en el referido siglo fue un organismo de desacreditada actuación y en el que la justicia se inclinó primando las conexiones familiares y de negocios. En la época mencionada, el nepotismo y las innumerables quejas que llegaban al Consejo de Indias sobre el desempeño de los oidores eran las quejas recurrentes. Formando parte de las reformas implementadas por Carlos III, y con el objetivo de reformar la audiencia peruana se constituyó una visita general liderada por José Antonio de Areche. Este encargo se vio ampliado a la reforma de la hacienda, del consulado, así como proveer los primeros pasos para el establecimiento de la nueva organización territorial: las Intendencias. Estas medidas reformadoras venían precedidas por los resultados alcanzados por Gálvez en el virreinato de Nueva España, y en la que Areche también había colaborado La investigación se ha centrado también en analizar la importante red de alianzas que tejió la elite limeña que gobernaba junto al virrey Guirior, que se convirtió en su principal valedor. El propósito de la aristocracia fue que la visita fuera considerada un fracaso, aspirando a que Madrid la suspendiera sin la aplicación de las medidas reformadoras; pero además lograr el desprestigio del visitador, de manera que sus propuestas fueran descartadas. La novedad del tema radicó en realizar un estudio lo más objetivo e imparcial posible de lo que aconteció en la audiencia de Lima durante la visita general durante los años de 1776 a 1783. La investigación aporta información relevante sobre José Antonio de Areche, que continuaba guardada en los archivos, y que consideramos fundamental para entender la visita y para juzgar la conocida rivalidad con Guirior. En este aspecto, se ha investigado la relación desde las dos visiones: la del virrey y la del visitador. En definitiva, la tesis doctoral ha conseguido llenar vacíos de información que se hacían necesarios solventar para realizar un estudio objetivo tanto de la institución judicial limeña como de la personalidad del visitador vizcaíno. Los objetivos se orientaron a reconstruir la organización del tribunal de justicia durante las décadas de 1770 a 1790. Asimismo, identificar y analizar la actuación de los ministros y su reacción frente a las reformas borbónicas, destacando la relación que mantuvieron con el visitador Areche. La tesis doctoral es una investigación cualitativa e interpretativa, en la que el soporte principal es la documentación de archivos americanos y españoles. Por tanto, los métodos, técnicas e instrumentos se han orientado a la línea marcada por la investigación cualitativa. Se realizaron registros de observación para identificar al cuerpo de oidores y su desempeño durante la visita general. El método de registro nos permitió entender la estructura organizativa del tribunal de justicia limeño, las funciones específicas de cada sala: civil y judicial, así como las ocupaciones de los empleos menores. En cuanto al funcionario escogido para realizar la visita al Perú, y contrario a lo estudiado, Areche no era un advenedizo, sino que llegaba al virreinato con amplia experiencia en el gobierno de las Indias. Asimismo, le respaldaba un respetable expediente académico, así como su lealtad a la corona y al ministro de Indias. Además, llegaba convencido de que las reformas eran necesarias para mejorar el gobierno de los peruanos y no para "esquilmarlo" con impuestos. En este sentido, la investigación realizada aporta nueva información respecto a la vida y personalidad del que fuera visitador del Perú. José Antonio de Areche and overall visit to the Audiencia of Lima The dissertation analyzes the operation of the hearing of Lima in the late eighteenth century, noting that in the aforementioned century was a discredited agency action and justice in which leaned giving priority to family and business connections. In the period mentioned, nepotism and countless complaints reached the Council of the Indies on the performance of the judges were recurrent complaints. As part of the reforms implemented by Carlos III, and with the aim of reforming the Peruvian audience a general tour led by José Antonio de Areche was established. This custom was extended to the reform of the hacienda, the consulate, as well as providing the first steps towards the establishment of the new territorial organization: the Municipalities. In this regard, we have investigated the relationship since the two visions: the Viceroy and the visitor. In short, the thesis has managed to fill information gaps that became necessary resolve to conduct an objective study of both Lima's judicial institution and the personality of Biscay visitor. The objectives were aimed at rebuilding the organization of the Court during the 1770s to 1790. Also, identify and analyze the performance of ministers and their reaction to the Bourbon reforms, emphasizing the relationship they had with the visitor Areche. The dissertation is a qualitative and interpretive research, which is the mainstay of American and Spanish documentation files. Therefore, methods, techniques and tools have been oriented to the line marked by qualitative research. observation records were performed to identify the body of judges and their performance during the whole visit. The recording method allowed us to understand the organizational structure of the Court of Justice of Lima, the specific functions of each room: civil and judicial, as well as minor employment occupations. As the officer chosen for the visit to Peru, and contrary to what has been studied, Areche was not an upstart, but reached the viceroy with extensive experience in the government of India. Also, we supported a respectable academic record as well as their loyalty to the crown and the colonial secretary. It also came convinced that reforms were needed to improve the Peruvian government and not for "esquilmarlo" taxes. In this sense, the research provides new information about the life and personality of the former Visitor of Peru. The work for this thesis was done during the period 2010 to 2016, after the worst financial crisis since the Great Depression, and in the immediate wake of the Eurozone debt crisis that has casted doubts on European integration. With the crisis largely blamed on bank excessive risk-taking and supervisors' inability to contain it, and with the aim to prevent similar crises in the future, much of the policy discussions and regulatory actions have focused on ways to address both of these failures of market economies. One way concerns the strengthening of market discipline, i.e., strengthening the incentives and capacity of external stakeholders (depositors, shareholders and other holders of bank liabilities) to induce more prudent risktaking behavior by bank managers. Thus motivated, this thesis focuses on the channels and effectiveness of market discipline. Said differently, it explores whether, and how, market forces could be trusted to do a better job in containing risk-taking behavior by banks and thus effectively support and supplement supervisors' efforts. From a policy-making point of view, the thesis explores whether market discipline can promote financial stability. The thesis comprises of three empirical papers. The first explores whether the expected government support of banks, implicit or explicit, weakens market discipline. The second explores whether the intrusive external monitoring by knowledgeable and influential external stakeholders fosters more prudent loan-loss provisions and, hence, more prudent accounting practices by banks. The third paper extends the second, taking into account the role of the institutional and social environment in an international setting. The results from all three papers are supportive of the notion that market discipline can promote financial stability. Details follow. The first paper explores whether expected government support weakens market discipline by bank shareholders, especially after the eruption of the global financial crisis in 2008. Two counter-veiling forces are at work. On the one hand, as it is suggested by the related literature, the expected support may give banks greater leeway to undertake risks, for it reduces the monitoring incentives of depositors and other bank creditors. Shareholders, recognizing the resultant higher probability of default as well as the possibility that they might be wiped out in case of bank default, have an incentive to intensify monitoring and exercise stronger market discipline. On the other hand, the expected support may also reduce the possibility of a bank run, weakening as a result the need for monitoring by bank shareholders and, hence, market discipline on their part. Expected support is measured as the difference of two bank credit ratings from Moody's: an all-in rating, which encompasses expected support, and a stand-alone rating, which does not. We estimate a model in which a forward-looking measure of shareholder value, the market-to-book ratio, is the dependent variable and the measure of expected support is one of the explanatory variables. A negative coefficient of the expected support would be consistent with market discipline for it would indicate that shareholders are willing to pay less for banks with higher expected support The results, from a sample of about 250 banks worldwide, indicate that, far from weakening market discipline by shareholders, the expected support strengthens it, and more so for the riskier banks – i.e., those with lower stand-alone rating. The results also highlight the two counter-veiling effects of the expected support on market discipline. Specifically, as the size of the expected support increases, its negative effect on the market-to-book ratio decreases. The second paper sheds light on earnings management via loan-loss provisions (LLPs) and the associated trade-off between financial-statement transparency and financial stability, by exploiting time and cross-sectional variation. The time variation pertains to the welldocumented shift towards more forward-looking LLPs after the crisis of 2008. The working hypothesis is that the rules concerning LLPs effectively shifted in favor of forward-looking provisions. This shift is expected to be associated with stronger income smoothing and signaling, and more so for banks subject to weaker market discipline. The cross sectional variation pertains to the intrusive external monitoring by funds that are members of the US Sustainability Investment Forum (USSIF). The working hypothesis is that this process amounts to stronger monitoring and, hence, stronger market discipline. Thus, it is expected that income smoothing and signaling will be weaker for the banks in which USSIF funds invest relative to the remaining banks. Moreover, after the said shift in supervisory and regulatory preferences, income smoothing and signaling will increase by less for banks in which USSIF funds invest. The results, from a sample of more than 300 publicly-held US bank holding companies, over the period 1999 – 2014, confirm that the banks under the intrusive monitoring exhibit less earnings management. Since, however, this differential behavior got more pronounced after the regulatory shift, the results further suggest that USSIF funds induce provisioning behavior that goes well beyond the stricter application of the existing accounting and supervisory rules, thus ameliorating the aforementioned trade-off. The third paper explores whether the inclusion of a bank in the Dow Jones Sustainability Index (DJSI) reduces bank managers' incentives for earnings management through loan-loss provisions. The inclusion in the DJSI depends on a rigorous bank assessment, conducted each year. The working hypothesis is that being included in the DJSI constitutes a credible signal to outside stakeholders of prudent behavior. An aspect of such behavior is less earnings management through loan-loss provisions. The results from a sample of 297 banks around the globe, over the period 2004 – 2010, indicate that banks included in the DJSI engage in less earnings management relative to the banks that were assessed but not included. This more prudent provisioning behavior persists when we control for the strength of private sector monitoring with country-level indices for private sector monitoring and the quality of external audits. Yet, it largely diminishes when we control for the strength of supervisory power and capital regulation. The last result poses an interesting question: Is stronger supervision a substitute of market discipline? Or, is the DJSI assessment process geared towards accepting more banks from countries with stronger supervision; All in all, the papers in this thesis highlight the important and decisive role market discipline plays in the financial system. They suggest that shareholders, probably driven by the objective difficulty of accurately assessing banks' true condition and prospects, appreciate credible signals of prudent behavior. The results are also supportive of the power of external monitoring as a restraining factor in bank-managers' risk-taking.

This thesis, as part of a movement towards the degree of PhD (a becoming Doctor of Philosophy), is constructed and approached as a philosophical situation, which is always about an encounter between terms that are foreign to each other. In this case, through the exploration of the interplays of space, film and politics, a multiplicity of foreign terms and such encounters will emerge and take us along a journey through places, movies and architectures, to discuss the ways in which architecture and other spatial practices think, imagine and produce the worlds we live in and the ways in which we live together. Quite differently from what has usually been the focus of explorations of the relationships between film and architecture -namely an approach to their connections as formal constructions and compositional techniques- I will approach cinema as a form that thinks, as an apparatus of spatial critique and as a material that is capable of activating a time and a space of encounter: one in which people are enabled to meet reality at a distance from that in which they are presently becoming. Film is here an encounter with otherness, and allows thinking in and through the distance that separates the viewer from the screen and from the spaces and realities presented on it. lt does so by means of its form. lt is a form that thinks. Through its thinking, cinema can change the ways in which we conceive of territories and places; it can change the ways in which we conceive of architecture, helping us move from understanding it as a discipline or an 'it' to seeing it as an action or a verb: to architect. Cinema can help us gain the critical, social, political and utopian impetus we are missing in our 'movement' towards the establishment of the common. Philosophy has, according to Badiou, three tasks in relationship with situations: first, it has to help us clarify the basic choices of our thinking; second, it has to help us clarify the distance between that thinking (truths as creation) and power; and third,it has to help us clarify the importance of the exception, the rupture, the event. Choice, distance, exception. One could also see in that sequence a relationship to the main three parts of this research, the first part is about choices: an archaeology of the present that forces us to choose between different things in order to approach what I will call 'pragmatic dissent'; the second part is about distances: a filmic, spatial and affective journey in which we take a distance from that present in order to encounter reality, and we do so by exploring and developing an 'aesthetics of encounter'; and the third part is about exceptions: an exploration of other images and other spaces, alternatives and events in the conception, thinking and production of spaces and images, a journey through these exceptions that will become a discussion of two interrelated notions: anarchic metapolitics and what I will provisionally call 'ethics of encounter'. Gaia is a cornerstone mission in the science programme of the EuropeanSpace Agency (ESA). The spacecraft construction was approved in 2006, following a study in which the original interferometric concept was changed to a direct-imaging approach. Both the spacecraft and the payload were built by European industry. The involvement of the scientific community focusses on data processing for which the international Gaia Data Processing and Analysis Consortium (DPAC) was selected in 2007. Gaia was launched on 19 December 2013 and arrived at its operating point, the second Lagrange point of the Sun-Earth-Moon system, a few weeks later. The commissioning of the spacecraft and payload was completed on 19 July 2014. The nominal five-year mission started with four weeks of special, ecliptic-pole scanning and subsequently transferred into full-sky scanning mode. We recall the scientific goals of Gaia and give a description of the as-built spacecraft that is currently (mid-2016) being operated to achieve these goals. We pay special attention to the payload module, the performance of which is closely related to the scientific performance of the mission. We provide a summary of the commissioning activities and findings, followed by a description of the routine operational mode. We summarise scientific performance estimates on the basis of in-orbit operations. The research is originated from the concern of understanding the role of architecture in a complex social phenomenon, as is the tangibility of social abstractions through institutions. lt is studied why and how this relationship between social and physical is produced in architecture, and specifically, how it is manifested in the case of the State of Chile, in a singular political social period, marked by a republican ethical sense. This investigation is born from the need to understand the role architecture has in the materialization of social abstractions through institutions, beyond stylistic or formal considerations. lt allows to demonstrate that the recognition of the main architectural works is simultaneously a recognition of a social volition which has an ethical and value-based character that is embodied in architecture, in parallel to its own spatial and technical values. Projects therefore are a social co-construction, a specific praxis that changes the behavior of the daily social life organization. History is observed in relation to a specific project and the categories of its time and its society, because they are a product of an evolution based on a social dialogue. The sociocentrism is revalidated in the study of architecture and history in general. The investigation is divided into three parts: first, an elaboration of a theoretical framework that addresses the concepts of abstraction, dialog and identity, as parts of a social significance process. This framework is orientated to explain the existence and strengthening of social abstractions that acquire identity by means of a social dialog and that operate over certain institutions to configure them as ideological state apparatuses. Second, an elaboration of the development of the Chilean state and its actions in the 1932-1973 period, in function of a group of ideas that are key to understand the institutions which establish a modern ethos, associated to social progress ideas. Third, the focus is on specifically, how the state has materialized a certain architecture, which has played a relevant social role in the configuration ofthe nation·s identity, through 8 key buildings: the Law School of the University of Chile, the Military Academy, the Votive Church of Maipu, the Bank of the State, the Medicine School of the University of Chile, the Naval Academy in Valparaíso, the Cepal Headquarters and the Ministry of Labor. These buildings were chosen from a series of public tenders, and are the most significant in the public works of the State. Finally, two emblematic cases are analyzed in depth: the Law School of the University of Chile and the Cepal Headquarters.These cases are considered paradigmatic examples of the relationship with national social abstractions: from the national developmentalist discourse to the abstraction of structural changes, which means, the ideology-utopia with which these study cases are refigured. For the Thesis is it relevant to study the state works as a whole, by its condition of being the physical support and simultaneously the testimony of an interaction between the particular abstraction of a peripheric and open mind society as the chilean one, with the generic abstractions of the dominant world culture. The study cases can be recognized as a partial synthesis situation in that interaction, and with identity value. lt is attached, in addition, a series of theoretical, historical, political annexes, that bring specific information about the study cases, that are part of the investigation, that allow timely deepening o wider frameworks to understand the presented phenomena. ; La investigación nace de la inquietud por comprender el papel de la arquitectura en un fenómeno social complejo como lo es la tangibilización de sus abstracciones sociales a través de instituciones. Se estudia por qué y cómo se produce esta relación de puente entre lo social con lo físico en la arquitectura y específicamente cómo se ha dado en el caso del Estado de Chile, en un período político social marcado por un sentido ético republicano. La utilidad de esta investigación está en incorporar una dimensión histórico social más abstracta en los antecedentes, que permitan valorar una cierta arquitectura sobre una base identitaria, más allá de consideraciones estilísticas o formales. Permite demostrar que el reconocimiento a algunas de las más importantes obras en Chile es simultáneamente un reconocimiento a una voluntad social de carácter ético y valórico que se plasmó en la arquitectura, en paralelo a sus propios valores espaciales y técnicos. Los proyectos por lo tanto, constituyen una co-construcción social, una praxis concreta que modifica conductas de la organización social de la vida diaria. Se observa la historia en función de un proyecto y de las categorías de su época y su sociedad, pues son producto de su evolución en base a un diálogo social. Se revalida el sociocentrismo en el estudio de la arquitectura y de la historia en general. Se desarrolla en tres partes: primero se elabora un marco teórico que aborda los conceptos de abstracción,dialogía e identidad, como partes de un proceso de significación social. Este marco se orienta a explicar la existencia y consolidación de abstracciones sociales que producto del diálogo socialadquieren identidad y que operan sobre ciertas instituciones para configurarlas como aparatos ideológicos del Estado. Segundo, se desarrolla el devenir del Estado de Chile y sus acciones en el período entre 1932 y 1973, en función de un grupo de ideas que son claves para comprender las instituciones que instauran un ethos moderno, asociado a ideas de progreso social. Tercero, se desarrolla específicamente cómo el Estado ha materializado una cierta arquitectura, que ha cumplido un rol social relevante en la conformación de la identidad nacional, a través de 8 proyectos claves: la Escuela de Derecho de la Universidad de Chile, la Escuela Militar, elTemplo Votivo de Maipú, el Banco del Estado, la Escuela de Medicina de la Universidad de Chile, la Escuela Naval de Valparaíso, la sede para la Cepal y el Ministerio del Trabajo. Estos edificios son los más significativos en la obra del Estado en el período y fueron convocados mediante concurso. Finalmente se resumen dos de ellos (la Escuela de Derecho de la Universidad de Chile y la sede para la Cepal) como ejemplos paradigmáticos de relación con las abstracciones sociales nacionales: desde el discurso nacional desarrollista a la abstracción de los cambios estructurales, es decir, la ideología-utopía con que se pueden refigurar estos casos de estudio. Para la tesis es relevante estudiar la obra del Estado como conjunto por su condición de ser el soporte físico y a la vez el testimonio de una interacción entre las particulares abstracciones de una sociedad periférica y abierta como la chilena con las abstracciones genéricas de la cultura mundial dominante. Los casos en estudio pueden ser reconocidos como situaciones de síntesis parcial en dicha interacción y con valor de identidad. ABSTRACTThis thesis focuses on the influence of political parties in the internal conflict of the nomination of the leadership of Parliament for the regional administration. From the study authors using normative juridical research method, the conclusion: that 1). Konstruksi yang terdapat dalam pasal 164 dan pasal 165 Undang Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah hanya bersifat administratif aja. Dalam arti pasal-pasal tersebut hanya mengatur bagaimana menentukan calon pimpinan DPRD dengan syarat perolehan suara hasil pemilhan umum yang diperoleh oleh masing-masing partai politik. Suara terbanyak secara bertingkat menjadi penentu untuk menduduki pimpinan DPRD. Kemudian solusi yang diatur dalam Undang Undang No 2 Tahun 2008 Tentang Partai Politik sebagaimana telah di ubah dengan Undang Undang Nomor 2 Tahun 2011 jika terjadi konflik dalam internal partai politik yakni diselesaikan oleh partai politik itu sendiri dengan mendasarkan pada Anggaran Dasar dan Anggaran Rumah Tangga dan sebagai lembaga pemutus atas sengketa konflik internal partai politik tersebut diserahkan pada Mahkamah Partai yang dibentuk oleh partai politik itu sendiri. Jika pun tidak terselesaikan oleh Mahkamah Partai, maka Lembaga Pengadilan menjadi pintu keluar untuk menyelesaikan konflik internal partai politik tersebut. 2).konflik internal partai politik khususnya untuk mengusulkan dan menentukan pimpinan DPRD secara langsung atau tidak langsung berpengaruh dalam penyelenggaraan pemerintahan daerah. Hal ini disebabkan DPRD merupakan mitra kerja dari pemerintah daerah dan sama sama sebagai penyelenggara pemerintahan daerah. Selanjutnya dari hak-hak serta tugas dan wewenang yang dimiliki oleh DPRD dan kemudian diakselerasikan dengan hak-hak serta tugas dan wewenang kepala daerah, maka terdapat hubungan kerja yang sangat erat dalam penyelenggaraan pemerintahan di daerah. Setiap tindakan dan kewenangan yang dimiliki oleh kepala daerah selalu terkait juga dengan DPRD, baik dalam rangka memberikan pertimbangan maupun persetujuan. Keeratan hubungan kerja dan sekaligus mitra kerja, maka kelembagaan DPRD menyangkut status anggota dan pimpinan harus mempunyai legal standing atau kedudukan yang telah di sahkan. Apabila pimpinan DPRD belum bersifat definif, maka segala penyelenggaraan pemerintahan daerah akan stagnan karena secara kelembagaan, DPRD belum mempunyai pimpinan. Pimpinan sementara DPRD secara umum hanya berfungsi untuk mengatur dan melaksanakan dalam rangka penetapan pimpinan DPRD definitif. 3). Di dalam undang undang partai politik nomor 2 tahun 2008 sebagaimana telah diubah dengan Undang Undang Nomor 2 Tahun 2011 bahwa mekanisme penyelesaian konflik partai politik dapat diselesaikan dengan 2 (dua) cara yakni melalui Mahkamah Partai atau sebutan lain yang dibentuk oleh partai politik yang bersangkutan serta lembaga pengadilan.Di luar dari peraturan perundang-undangan yang mengatur dalam penyelesaian konflik partai politik, Nasikun memberikan model terhadap penyelesaian konflik. Ada pun tawaran dari Nasikun dalam penyelesaian konflik adalah : konsiliasi, mediasi,abitrase dan perwasian. Akan tetapi penulis berpendapat hanya terdapat 2 (dua) model saja yang dapat dipergunakan untuk menyelesaikan konflik internal partai politik yakni konsiliasi dan mediasi. Saran-saran adalah : 1). partai politik dalam menentukan pimpinan DPRD jangan mementingkan kepentingan perorangan atau golongan karena semakin lama partai lama partai politik mengusulkan dan menentukan pimpinan DPRD maka dapat berpengaruh kepala penyelenggaraan pemerintahan darah. 2).harus ada revisi kembali terhadap undang-undang partai politik dengan memasukkan model atau bentuk atau cara lain selain diselesaikan oleh Mahkamah Partai dan Lembaga Pengadilan, agar penyelesaian konflik internal partai politik dapat diselesaikan dengan cara yang mudah serta tidak memakan waktu yang cukup lama.

Here are considered the historical roots of formation and genesis of bunchuks as a part of the whole kleinod complex of Kosh Otamans and Hetmans of the Ukrainian Cossacks. Turkic lexeme «bunchuk» over time has transformed into modern term that is common in Ukrainian culture. Traditionally, the first recorded case of bunchuks' use by military is associated with the name of the Arab Caliph Abu Bakr and his military battles on the territory of Syria in the 7th century. During the active cross-cultural contacts in the early 13th century, firstly bunchuks became known among the Mongols and later among the Turks. Early Ottomans used them not only as a military sign, but also as a ranking marker of the court official, status present, which raised the social status of a person. From Turks bunchuks were taken by the representatives of the Commonwealth of Poland and at the beginning gave them a meaning of the important symbol of Quarter Army Hetman military power and later, from the middle of the XVII century, of the Polish king. Historical tradition linked the use of bunchuks by Ukrainian Cossacks with the military reforms of Polish monarch Stefan Batory. But modern scientists, studying military history of the Cossacks in the first quarter of the XVII century and using the materials of Polish archives denied this statement and stressed the attention of the Turkish-Tatar vector. For Zaporozhian Cossacks bunchuks were among the attributes of legitimacy or legality of certain actions. In the external design dominated red and black color schemes. National Symbols of early modern Ukrainian state in the middle of the 17th – 18th c., which basis was formed of the attributes of power Zaporozhian Cossacks, recorded bunchuks as personal banners of Hetmans. Для розрізнення із запорожцями, гетьмани почали використовувати білі бунчуки. [spa] El VIH es un reto de salud global que impacta en salud de las poblaciones y cuyas consecuencias socioeconómicas presentan un desafío para la continuidad de cuidados de las personas que viven con VIH. A finales de 2014 había 36,9 millones de personas infectadas por el VIH en todo el mundo, dos millones de las cuales se habían infectado ese mismo año. El abordaje de la epidemia de VIH desde la Salud Global implica la investigación transnacional cooperativa y la acción para la promoción de la salud para todos. La hipótesis establecida en esta tesis es que a través de la epidemiología y salud pública se puede describir la imagen global de la epidemia de VIH/SIDA actual, mediante el estudio de este problema sociosanitario desde múltiples enfoques, incluyendo la perspectiva de la población vulnerable, la sostenibilidad de los sistemas sanitarios y la epidemiología local, nacional e internacional. El objetivo principal es describir las distintas perspectivas y visiones de estudio del VIH en el marco de la salud global. Los objetivos específicos se desarrollan en cada una de las publicaciones científicas que comprenden esta tesis y se estructuran en el marco de la Estrategia Mundial del Sector de la Salud contra el VIH/SIDA para 2016-2021. La metodología de cada uno de los estudios está dirigida a un objetivo específico orientado a generar evidencias en los campos organizativos que establece la estrategia de la OMS: cobertura sanitaria universal; continuidad de los servicios de salud; y el enfoque de salud pública. El abordaje del VIH realizado desde el campo de la salud global incluye modelos predictivos, estudios de investigación clínica, estudios observacionales, encuestas de implementación de programas, evaluaciones de las necesidades formativas en prevención y control de la infección y análisis de la evidencia científica disponible mediante revisiones sistemáticas. Los resultados presentados constan de un primer estudio de análisis del coste de la terapia antirretroviral y su asociación con la complejidad clínica de los pacientes en tratamiento. El estudio presenta un índice que predice el consumo elevado en terapia antirretroviral según factores clínicos. Este índice aporta una herramienta de mejora en el proceso de financiación de los fármacos antirretrovirales. Un segundo estudio aporta datos sobre la evolución de la infección por VIH de curso rápidamente progresivo en un paciente en seguimiento en un estudio de cohortes para la identificación de nuevas dianas diagnósticas. Un tercer estudio analiza las interacciones del tratamiento antirretroviral y drogas de uso recreacional desde el punto de vista de la epidemiologia de consumo de drogas en Europa y la evaluación de la especificidad con la que las guías de tratamiento del VIH abordan los problemas relacionados con el uso de drogas recreativas en personas que viven con VIH. El cuarto estudio incluido en la tesis propone un marco conceptual de vigilancia epidemiológica de factores de riesgo de enfermedades infecciosas en poblaciones migrantes. Este sistema validado con la evidencia científica disponible, plantea una mejora en la recogida de información sobre los factores asociados con un mayor riesgo de enfermedades infecciosas incluyendo el VIH en la población inmigrante en la Unión Europea y el Área Económica Europea. A, una serie de seis informes europeos analizan la epidemia de VIH desde el seguimiento de la Declaración de Dublín. Estos informes presentan evidencias sobre el estado actual de la continuidad de cuidados en los países europeos así como un análisis exhaustivo de los grupos vulnerables: migrantes, trabajadores del sexo, hombres que tienen sexo con hombres, personas institucionalizadas en prisiones y personas usuarias de drogas por vía parenteral. Un último estudio establece la necesidad de armonizar las necesidades formativas en prevención y control de las infecciones en Europa mediante una estrategia de definición de competencias y de innovación docente. Las evidencias aportadas apoyan la implementación de la Estrategia Mundial del Sector de la Salud contra el VIH/SIDA para 2016-2021 y se suman a la respuesta de la comunidad científica a la llamada a la acción que realiza la Organización Mundial de la Salud a través de dicha estrategia. ; [eng] HIV is a Global Health challenge affecting population health. The socioeconomic consequences of the epidemic present a challenge for the continuum of care of people living with HIV. At the end of 2014 there were 36.9 million people living with HIV worldwide, two million people were newly infected on the same year. Addressing HIV epidemic from a Global Health perspective requires collaborative trans-national research and action for promoting health for all. Our hypothesis is that a multiple approach from epidemiology and public health could describe the overall picture of HIV/AIDS epidemic state of play. Such an approach should include a vulnerable population perspective, a health systems sustainability analysis, and an overview of national and international epidemiology. Thus, the main objective of this thesis is to describe the different perspectives and visions of HIV using a global health framework. The specific objectives are developed in each of the scientific publications included in this thesis. Those studies are structured within the framework of the Global Health sector strategy on HIV/AIDS, 2011-2015. Each study targets a specific objective to generate evidence in the different fields established by the WHO strategy: universal health coverage; continuum of care; and the public health approach. The methodology selected to perform those studies was broad, including: predictive models, clinical research studies, observational studies, implementation evaluation surveys, training needs assessments regarding infection prevention and control and systematic reviews of the literature. The results presented include a first study that analyzes the cost of antiretroviral therapy and its association with the clinical complexity of patients under treatment. This study established a score based on clinical and sociodemographic factors that predict high cost of antiretroviral therapy. Thanks to this score the funding process of antiretroviral drugs can be improved. A second study provides data on the evolution of rapid HIV infection in a patient during a cohort study to identify new diagnostic targets. A third study analyzes the interactions between antiretroviral treatment and recreational drugs. This study approaches the epidemiology of drug consumption in Europe and evaluates how HIV treatment guidelines address the use recreational drugs in people living with HIV. The fourth study included in this thesis establishes a conceptual framework for epidemiological surveillance of risk factors for infectious diseases in migrant populations. This framework was validated with the available scientific evidence and may improve data collection of risk factors associated with infectious diseases including HIV in migrants arriving to the European Union and the European Economic Area. Subsequently, we present a series of six European reports monitoring Dublin Declaration. Those reports enclose data on the continuum of care in Europe as well as a thorough assessment of vulnerable groups: migrants, sex workers, men who have sex with men, prisoners and people who inject drugs. The last study establishes the need to harmonize prevention and control of infectious diseases in Europe by competencies definition and training innovation.
