2016 wurden in einem 9-monatigen Erhebungszeitraum mittels eines Erhebungsbogens Daten zum Vorkommen und den Ursachen des Schlachtens trächtiger Tiere ermittelt. Unter freiwilliger Teilnahme konnten Informationen von 155 Tierärzten und 601 Rinderhaltern gesammelt und ausgewertet werden. Die Datensätze der Halter wurden weiterhin hinsichtlich Region, Nutzungsart, Haltungsform, genutzter Reproduktionstechnik, Tierzahl, Remontierungsrate und der zusätzlichen Haltung von männlichen Rindern gruppiert ausgewertet, um eventuelle Unterschiede innerhalb der genannten Aspekte herauszustellen. El trabajo indaga en la figura del beneficio de gratuidad que se les ha reconocido a los trabajadores y trabajadoras, desde ya hace muchos años en la legislación nacional (art. 20 de la Ley Nac. 20.774 y 41 de la LO) y en el ámbito de la Provincia de Buenos Aires (art. 22 de la Ley 11.653 de Procedimiento Laboral), ello en clave de vislumbrar los matices que lo constituyen como un mecanismo hábil e idóneo para garantizar la añorada tutela judicial efectiva. El trabajador por su condición débil en la relación laboral, se encuentra en una situación asimétrica con respecto a su empleador, tal motivo es que ha propiciado en los ordenamientos sustanciales y procesales, el diseño de mecanismos que consagran una tutela preferente en virtud de la clase trabajadora, enraizada principalmente en el principio protectorio que ilumina el Derecho del Trabajo. ; The work explores the figure of the benefit of gratuity that has been recognized to workers, since many years ago in the national legislation (Article 20 of National Law 20.774 and 41 of the LO) and in the field of the Province of Buenos Aires (Article 22 of Law 11.653 of Labor Procedure), this in order to envision the nuances that constitute it as a skillful and suitable mechanism to guarantee the longed for effective judicial protection.
