Die rügelose Einlassung ermöglicht den Beklagten, ein Verfahren vor einem an sich unzuständigen Gericht zu führen und somit die Heilung der Unzuständigkeit des angerufenen Gerichts zu erreichen. Ist der Beklagte aber der Meinung, dass das angerufene Gericht unzuständig ist, so hat er eine Zuständigkeitsrüge zu erheben. Ob sich der Beklagte nun rügelos auf das Verfahren einlässt oder, ob er doch lieber die Zuständigkeitsrüge erhebt, kann von vielen Faktoren, wie etwa der Verfahrenskosten oder der Verfahrenssprache abhängen. Um den Beklagen als typischerweise schwächere Partei zu schützen, besteht deswegen nach Art 26 Abs 2 EuGVVO und Art 8 Abs 2 EuEheGütVO/EuPartGütVO außerdem eine Belehrungspflicht, welche die Aufklärung über Vor- und Nachteile einer rügelosen Einlassung oder der Erhebung einer Zuständigkeitsrüge beinhaltet.Nicht nur ist die rügelose Einlassung Bestandteil des Europäischen Zivilverfahrensrechts, sie wird auch in Österreich durch die Rechtsvorschrift des § 104 Abs 3 JN geregelt. Dadurch, dass europäische Verordnungen ab Inkrafttreten automatisch in den Mitgliedstaaten gelten, gehen die Regelungen der Verordnungen aber nationalem Recht vor.Durch die Darstellung der rügelosen Einlassung im Europäischen Zivilverfahrensrecht sollen die Unterschiede und Gemeinsamkeiten der jeweiligen Regelungen in den europäischen Verordnungen aufgezeigt werden. Zuerst wird die Regelung der rügelosen Einlassung nach der EuGVVO, die gewissermaßen Vorbild für die nachfolgenden Regelungen zur rügelosen Einlassung in den europäischen Verordnungen war, und insb auch das Wesen der rügelosen Einlassung behandelt. Danach folgt die Betrachtung der rügelosen Einlassung nach der EuUntVO, der EuErbVO und schlussendlich nach den Güterrechtsverordnungen. Am Ende dieser Diplomarbeit werden im Resümee die wichtigsten Erkenntnisse nochmals zusammenfassend dargestellt. ; The institute of entering an appearance without raising an objection provides the defendant the opportunity, to dispute before a court which has no jurisdiction. As a result, international jurisdiction is conferred to the court. The defendant may also contest the courts jurisdiction. The defendants action can depend on many factors, such as the procedural costs or the procedural language. To protect the defendant as a weaker party, the court has, according to Art 26 (2) Brussels Ibis Regulation and Art 8 (2) of the Council Regulations (EU) 2016/1103 and 2016/1104, the duty of informing of the right to contest the jurisdiction of the court, of the consequences of entering or not entering an appearance and of the advantages and disadvantages about it.Not only is the institute of entering an appearance a feature of the European Civil Procedure Law, but it is also regulated in Austria by § 104 (3) JN. Since European Regulations automatically apply in the Member States as soon as they enter into force, the Regulations have precedence over national law.Through the representation of the institute of entering an appearance in the European Civil Procedure Law, the differences and similarities between particular provisions of the European Regulations shall be illustrated. In the first part of this thesis, the provision of entering an appearance of the Brussels Ibis Regulation, which was, in a way, a prototype for the following provisions of entering an appearance in the European Regulations, and particularly also the nature of the institute of entering an appearance will be dealt with. The following parts of this thesis are dealing with the institute of entering an appearance according to the Council Regulation (EC) 4/2009, the Regulation (EU) 650/2012 and finally according to the Council Regulations (EU) 2016/1103 and 2016/1104.
