On n'a pas toujours reconnu l'Autre comme « religieux ». On ne s'est pas partout servi du latin pour le comprendre, le classifier, le gouverner. Comme la race, la notion de religion n'est qu'un chapitre dans l'histoire du savoir et du pouvoir, chapitre provisoire, éphémère, embarrassant. Race et religion ? Die amerikanische Philosophin Martha C. Nussbaum legt ihrem Begründungsversuch der Menschenrechte eine essentialistische Lehre des Menschen zugrunde. Mit ihrem Ansatz ist sie nicht nur um eine Garantie von Rechten, sondern um eine umfassende Befähigung der Bürger zu einem guten Leben bemüht. Nach Nussbaums Auffassung entspringen die Menschenrechte, in Gestalt von Ansprüchen an die öffentliche Ordnung, nicht rationalen Vertragsregelungen oder moralischen Verpflichtungen zwischen Staat und Bürgern. Vielmehr ergeben sie sich aus der Bedürftigkeit von Menschen, der in einer angemessenen politischen Rahmenordnung Rechnung getragen werden soll.
