Many are familiar with the concept of a moral dilemma - a situation where a person faces a choice between two mutually exclusive actions. This publication considers whether situations of this kind could and should exist within the sphere of international law

This book examines how those with disabilities, and in particular, the Deaf and hard-of-hearing, are impacted by the influence language and culture in policing, criminal law, and corrections. Frequently left out of policy making and research, almost no resources exist that can inform and aid law enforcement, legal, and correctional officials on culturally competent interactions with the Deaf and hard-of-hearing. As a result, this group is at a distinct disadvantage when dealing with law enforcement or the courts as well as being vastly underserved, which often lead to negative outcomes for the Deaf suspect/defendant/inmate as they attempt to interact with law enforcement and navigate the legal system. In a step-by-step presentation from arrest to incarceration each chapter will discuss a specific part of the legal system. As well as providing information on the topic, this book can serve as an important resource to the myriad of issues and difficulties that may be experiences by the Deaf suspect, defendant, or inmate, as well as by law enforcement officers, attorneys, and correctional officers. To illustrate these issues, previous cases of Deaf suspects, defendants, and inmates will be presented and discussed to clarify key issues and to provide a perspective of the problem. Each chapter dealing with these issues will also provide suggestions for more culturally competent interactions between the Deaf community and the legal system.

Mediation is a law institute which enables alternative resolution of a criminal case between the subjects of law outside of court. It may be applicable except in criminal proceedings in which are adjudicated adults perpetrators of criminal offences, also in juvenile criminal proceedings. Through application of this institute is aimed to help the parties (to minor and the injured party) to achieve the resolution of a criminal case in the most functional manner and in accordance with their best interests. The importance of mediation is diverse. It effects in reducing the number of court cases awaiting resolution, reducing public expenditures, raising the level of social responsibility, educating citizens with the feeling of seeking forgiveness and compensation of damage, as well as cooperation with criminal procedure bodies, eliminating cases of vigilantism etc. Mediation is constituted of numerous characteristics which make it a "sui generis" institute in criminal case resolution alternatives.Modest results of this scientific paper indicate that this institute in Kosovo courts and prosecutions concerning juvenile criminal proceedings is applicable in a very few cases. Causes of this situation may refer to the fact of not knowing the advantages of applying this institution by juvenile judges and prosecutors, but also due to the fact this institute has similarities with diversity measures, which are more preferred to be imposed against juveniles.
The problem of criminal responsibility for human rights atrocities committed in internal conflict provides an appropriate vehicle for examining various theoretical and methodological approaches to international law. The issues raised include the following: Does international law provide for individual criminal responsibility for such acts? How best can these atrocities be prevented? Should international law address these matters or are they better left to domestic law? Why does international legal doctrine distinguish between human rights violations committed in international conflict and the identical acts committed in internal conflict?

South Africa has a long tradition of law journal publishing. The Cape Law Journal was founded in 1884. Its name was changed to the South African Law Journal in 1901 and it has continued to appear ever since. Certain other journals commenced in the past, then either disappeared or now appear in another guise. For instance the South African Law Times was published for a few years in the 1930's only. Similarly Butterworths South African Law Review was the precursor to the current Acta Juridica. However, today a wide range of titles are published. Juta and Company Limited (P.O. Box 123, Kenwyn, Cape Province 7790) publishes the South African Law Journal and several other law and law-related periodicals and law reports. Another regular publisher of legal journals is Butterworths and Co. (S.A.) (Pty) Limited, (P.O. Box 792, Durban 4000).
The analysis is focused on the results arising from the use of nationality as connecting factor in questions of applicable law to personal relations between spouses who are citizens of States having a non-unified legal system, characterized by the coexistence of different sub-systems of personal law referred to members belonging to diverse religious and ethnic communities, as several States in Africa and Asia regions. The issue will become more and more relevant in a close future before the Italian courts, giving the increasing migrations and the consequently growing number of marriages and divorces to which such composite systems of law should be applied. The Italian and foreign case-law show that the religious and customary laws are often based on principles that may infringe the very concept of international public order. Nevertheless, there are circumstances where the sole diversity of values and cultures should not constitute per se an obstacle for the application of foreign laws in Italy. This result could be aimed by applying a flexible judicial approach on a case by case analysis, maybe giving a special relevance to other connecting factors, instead of citizenship, already used in EU law and in international multilateral treaties in matrimonial matters (such as the closest connection and habitual residence).
