Discussions of international law often focus on questions of constraint and prohibition. This year's Annual Meeting considered the role of international law as an instrument. Actors on the international stage use a variety of tools to address their concerns, from climate change to economic development; from humanitarian crises to cross-border disputes; from commercial regulation to global trade. Governments and international organizations employ diplomacy and coercion, corporations use negotiation and persuasion, and non-governmental organizations engage in fact-finding and advocacy. And all of these actors affect and are affected by international law and use the international legal system to effectuate change and solve problems.

In der deutschen Politikwissenschaft lassen sich drei Positionen zum Stellenwert und zur Rolle der Kritik finden: (1) Immanenz von Politik und Wissenschaft, (2) Arbeitsteilung von Politik und Wissenschaft, (3) Kritik der Politik durch die Wissenschaft. Keine dieser drei Positionen kann die Frage nach der Kritik jedoch zufriedenstellend beantworten. Der Begriff der Kritik entwickelt sich aus der Krise des ancien régime und ist für weite Teile der Sozialwissenschaften bis in die Gegenwart maßgebend gewesen. Durchlaufende Referenz ist der Kantische Aufklärungsbegriff. Auf Kant folgen Marx, Nietzsche, Weber, Horkheimer und Foucault. Die Rezeption dieser klassischen Positionen führt zu drei Forderungen an eine kritische Wissenschaft: Sie muss ihre Autonomie gegenüber dem politischen Feld herstellen und bewahren, sie muss öffentlich sein und sie muss ihre gesellschaftliche Bedingtheit und ihre eigene Politizität erkennen. When The Berlin Wall Came Down, on 10 November 1989, and communist regimes crumbled first in Central Europe, then in the Balkans, finally in the Soviet Union, we all hoped that a new era of peace and prosperity would begin. We knew it would be hard and painful for working democracies and effective market economies to be established in the former Warsaw Pact countries. But we believed that this could be achieved: and that we in the West could provide not only material help, but also the valuable example of the successful economic system practised by the members of the Organization for Economic Cooperation and Development (OECD). This system had finally triumphed over the rival, centrally-planned approach. Moreover, it was not just in Central and Eastern Europe that the open market economic system was prevailing, but all over the world. China was transforming its economy, with conspicuous success. The little dragons of East Asia were reaching economic standards close to those of OECD and their neighbours in the Association of South East Asian Nations (ASEAN) were following in their wake. In Latin America new, open economic and trade policies were being brought in, notably in Mexico. The world-wide prospects had never looked better.
