Als Völkerrechtssubjekt und wichtiger internationaler Akteur schließt die Europäische Union in zunehmendem Maße internationale Übereinkünfte mit Drittstaaten. Fraglich ist allerdings, in welchem Umfang sie sich durch derartige Übereinkünfte an internationalen Gerichtssystemen beteiligen darf. Der EuGH beurteilt die Unionsrechtskonformität diesbezüglicher Übereinkünfte vorrangig am Prinzip der Autonomie der Union, das er als ungeschriebenes Verfassungsprinzip versteht. Der Grundsatz der Völkerrechtsfreundlichkeit der Union, der sich ebenfalls aus der Unionsverfassung ableiten lässt, spielt für den Gerichtshof dabei augenscheinlich eine geringere Rolle. Der vorliegende Beitrag zeigt Hintergründe, Motive, Inhalte und Probleme des richterlich kreierten Autonomieschutzes auf. Er zeigt, welche Anforderungen internationale Gerichtssysteme, an denen sich die Union beteiligen will, erfüllen müssen, um als autonomiekonform zu gelten, fragt aber auch nach den Grenzen des unionalen Autonomieschutzes und fordert, einen Ermessensspielraum der Unionsorgane beim auswärtigen Handeln der Union zu respektieren. ; As a subject of international law and a major international actor, the European Union is increasingly concluding international agreements with third countries. However, it is questionable to what extent it may participate in international court systems through such agreements. The ECJ assesses the conformity of relevant agreements with Union law primarily on the basis of the principle of the Union's autonomy, which it understands as an unwritten constitutional principle. The article discusses issues related to the settlement of disputes within the framework of the World Trade Organization, as well as assesses the advantages and disadvantages of this system. The specific problems of the dispute settlement system functioning today are considered, and options for optimizing the dispute resolution mechanism and various ways to improve the effectiveness of legal remedies in cases of non-compliance with decisions are proposed. Special attention is paid to the latest topical disputes involving the Russian Federation, the European Union, Ukraine, China and USA resolved within the framework of the World Tr ade Organization, as well as to the crisis faced by the organization due to the absence of a permanent appeals body.

Der Beitrag beschäftigt sich mit Ursachen und internationalen Entwicklungstrends dieser zunehmenden Verbreitung und analysiert Steuerungsoptionen und -strategien in international vergleichender Perspektive, um so Kriterien einer sozial verträglichen Gestaltung der zu beobachtenden Veränderungen näher zu benennen. Der Beitrag kommt zu dem Schluss, dass vor dem Hintergrund einer nur bedingten direkten Steuerbarkeit der Verbreitung atypischer Beschäftigungsverhältnisse wie auch einer nur begrenzt umsetzbaren arbeitsrechtlichen Qualitätssicherung der sozialrechtlichen Absicherung solcher Beschäftigungsverhältnisse und einer darüber hinausgehenden Kontextsteuerung wesentliche Bedeutung zukommt."
