Smuggling along the Chinese coast has been a thorn in the side of many regimes. From opium and weapons concealed aboard foreign steamships in the Qing dynasty to nylon stockings and wristwatches trafficked in the People's Republic, contests between state and smuggler have exerted a surprising but crucial influence on the political economy of modern China. Seeking to consolidate domestic authority and confront foreign challenges, states introduced tighter regulations, higher taxes, and harsher enforcement. These interventions sparked widespread defiance, triggering further coercive measures. Smuggling simultaneously threatened the state's power while inviting repression that strengthened its authority.Philip Thai chronicles the vicissitudes of smuggling in modern China—its practice, suppression, and significance—to demonstrate the intimate link between illicit coastal trade and the amplification of state power. China's War on Smuggling shows that the fight against smuggling was not a simple law enforcement problem but rather an impetus to centralize authority and expand economic controls. The smuggling epidemic gave Chinese states pretext to define legal and illegal behavior, and the resulting constraints on consumption and movement remade everyday life for individuals, merchants, and communities. Drawing from varied sources such as legal cases, customs records, and popular press reports and including diverse perspectives from political leaders, frontline enforcers, organized traffickers, and petty runners, Thai uncovers how different regimes policed maritime trade and the unintended consequences their campaigns unleashed. China's War on Smuggling traces how defiance and repression redefined state power, offering new insights into modern Chinese social, legal, and economic history.

Between 1870 and 1926, anarchists criticism of the state includes criticism of law, and the themes they tackled in this area are vast. From the rejection of the social contract, to the rejection of the law, to the history of law and state, state law is, for them an enemy. Anarchists then think anarchy is in contradiction with it. The normative architecture of the anarchist society gives a large place to the free association of individuals and to the consent of each individual to the norm. However, it also relies on naturalist foundations : the reference to the natural sciences, combined with social sciences, leads militants to justify anarchy in support of the scientific truths accepted in their time. The reference to nature, natural law and morality made the anarchist society a normative order that could bring it closer to state law, which it opposed. The study of the discourse on law of anarchists during 1870 to 1926, through the study of the literature and the propaganda press, highlights this ambivalence. Although jurists often sum up anarchism as "propagande par le fait", and reduce it to anomie, the recent historiography of legal thought tends to assert the opposite. This thesis demonstrates the complexity of the presence, both implicit and explicit, of law in anarchist thought. ; Entre 1870 et 1926, la critique que les anarchistes formulent à l'égard de l'État embrasse celle du droit, et les thèmes qu'ils abordent dans ce domaine sont vastes. As the purpose of this panel is to explore the critical need for embedding international legal instruments within paradigms provided by disaster risk reduction (DRR), the area of international cultural heritage law could be a significant test-case in this regard. First, as experienced by several other branches of international law, it is possible to recognize an increasing attention paid by relevant specialized institutions, in this case the UN Educational, Scientific and Cultural Organization (UNESCO), to challenges posed by DRR, and finally permitting to: (1) integrate DRR concerns in the institutional and lawmaking agenda of this international organization, in order to inform and guide activities to be carried out by member states who face threats posed by disasters against their cultural heritage; and (2) provide an evolutionary and contextual interpretation of the existing commitments in this area in light of DRR paradigms. Second, a cross-fertilization phenomenon could also be recognized, as for the emerging recognition of cultural concerns in the same DRR system, through a process which has subsequently permitted UNESCO to additionally foster action in this area.

This article catalogues and analyzes the litigating behavior of four of the leading New Christian Right Public Interest Law Firms (NCR PILFs). Consistent with the finding from judicial politics that all PILFs seek first and foremost to have policy influence, we find that most of the litigation these PILFs invest in is either explicitly or implicitly religious or mission driven. However, we also observe a trend of increased participation in secular cases by the two largest NCR PILFs in our study. Through in‐depth, qualitative content analysis of the briefs submitted in these secular cases, we show that while some of this behavior can be attributed to organizational maintenance or coalitional goals, most of this secular participation appears motivated by a desire to influence the legal rules rather than the outcome of the particular case. In doing so, this article shows how PILFs engage with an increasingly complex legal and political landscape.

Seit 2003 hat sich das politische Bild des Irak stark verändert. Dadurch begann der Prozess der Neugestaltung der irakischen Rechtsordnung. Die irakische Verfassung von 2005 legt erstmalig in der Geschichte des Irak den Islam und die Demokratie als zwei nebeneinander zu beachtende Grundprinzipien bei der Gesetzgebung fest. Trotz dieser signifikanten Veränderung im irakischen Rechtssystem und erheblicher Entwicklungen im internationalen Privat- und Zivilverfahrensrecht (IPR/IZVR) im internationalen Vergleich gilt die hauptsächlich im irakischen Zivilgesetzbuch (ZGB) von 1951 enthaltene gesetzliche Regelung des IPR/IZVR im Irak weiterhin. Deshalb entstand diese Arbeit für eine Reformierung des irakischen IPR/IZVR. Die Arbeit gilt als erste umfassende wissenschaftliche Untersuchung, die sich mit dem jetzigen Inhalt und der zukünftigen Reformierung des irakischen internationalen Privatrecht- und Zivilverfahrensrechts (IPR/IZVR) beschäftigt. Die Verfasserin vermittelt einen Gesamtüberblick über das jetzt geltende irakische internationale Privat- und Zivilverfahrensrecht mit gelegentlicher punktueller und stichwortartiger Heranziehung des deutschen, islamischen, türkischen und tunesischen Rechts, zeigt dessen Schwachstellen auf und unterbreitet entsprechende Reformvorschläge. Wegen der besonderen Bedeutung des internationalen Vertragsrechts für die Wirtschaft im Irak und auch zum Teil für Deutschland gibt die Verfasserin einen genaueren Überblick über das irakische internationale Vertragsrecht und bekräftigt gleichzeitig dessen Reformbedürftigkeit. Die Darstellung der wichtigen Entwicklungen im deutsch-europäischen, im traditionellen islamischen Recht und im türkischen und tunesischen internationalen Privat- und Zivilverfahrensrecht im zweiten Kapitel dienen als Grundlage, auf die bei der Reformierung des irakischen IPR/ IZVR zurück gegriffen werden kann. Da die Kenntnisse des islamischen Rechts nicht zwingend zum Rechtsstudium gehören, wird das islamische Recht dazu in Bezug auf seine Entstehung und die Rechtsquellen dargestellt. Am Ende der Arbeit wird ein Entwurf eines föderalen Gesetzes zum internationalen Privatrecht im Irak katalogisiert, der sich im Rahmen der irakischen Verfassung gleichzeitig mit dem Islam und der Demokratie vereinbaren lässt. ; The political framework of Iraq has remarkably transformed since 2003. Hence began the process of reshaping the Iraqi legal system. For the first time in the history of Iraq, the Iraqi Constitution of 2005 determines Islam and democracy as two essential principles to be followed in legislation side by side. Despite this substantial development within the Iraqi legal system and current considerable development of international private and civil procedural law in international comparison, the legal regulation of the Iraqi international private and civil procedural law, which contained mainly in the Iraqi Civil Code of 1951 still applies. This thesis wants to sketch a possible reform of the Iraqi international private and civil procedural law. This work is considered the first comprehensive scientific work dealing with the current content and the future reform of Iraqi international private and civil procedural law The author gives a general overview of the current Iraqi international private and civil procedural law, indicates its weak points and makes appropriate reform proposals. The German, Islamic, Turkish and Tunisian international private and civil procedural law are used occasionally and in keywords in this passage. Due to the special significance of international contract law for the economy in Iraq and partly for the German economy as well, the author gives a more detailed overview of the Iraqi international contract law and at the same time reaffirms its need for reform. The outline of the main aspects of German-European law, of traditional Islamic law and of Turkish and Tunisian international private Law and civil procedure law in the second chapter serves as a basis that can be used to reform the Iraqi international private Law and civil procedure law. Because the knowledge of Islamic law is not necessarily part of the law studies, Islamic law is presented additionally in relation to its origin and the sources of law. At the end of the work, a draft of a federal law on private international law in Iraq is catalogued, which is compatible with Islam and democracy within the framework of the Iraqi constitution.

Are unilateral economic sanctions legal under public international law? How do they relate to the existing international legal principles and norms? Can unilateral economic sanctions imposed to redress grave human rights violations be subjected to the same legal contestations as other unilateral sanctions? What potential contribution can the recently formulated doctrine of Common Concern of Humankind make by introducing substantive and procedural prerequisites to legitimise unilateral human rights sanctions? Unilateral Sanctions in International Law and the Enforcement of Human Rights by Iryna Bogdanova addresses these complex questions while taking account of the burgeoning state practice of employing unilateral economic sanctions.

In Indonesia, as in many other countries of the global South, processes to formalize rights over land have been implemented with the intention to reduce deforestation, decrease poverty and increase tenure security. Literature on de jure processes of land formalization is widely available. There is a gap, however, on the discrepancy of de jure land titling procedures and de facto strategies to legitimize land claims. Led by the theoretical concepts of "law as process" and "politics of scale", this study closes this gap by analyzing the impact of national tenure formalization processes on de facto local patterns of land titling. Using empirical material from 16 villages in Jambi province, we show that the outcomes of the state-led land reforms and land tenure formalization processes are imitated and translated into locally feasible actions. We refer to these translation processes as "mimicry of the legal". The land formalization endeavors fostering mimicry of the legal allow for resource exploitation and rent-seeking behavior.
