The term 'local Islam' has been coined to describe local responses to the effects of globalisation in the Islamic world. All contributions to this volume present cases of 'local Islam' as well as discussing the term itself. But what all of this group of anthropologists and historians convey is a feeling of dissatisfaction with the very term. Their uneasiness relates to the conceptual problems arising from seeing Islam as either local or global. Rather, the authors argue in favour of a focus not on Islam but on the lives of Muslims, putting their lives into the context of complex historical.
Based on research conducted in Nigeria and other parts of sub-Saharan Africa, Christianity, Islam, and Liberal Democracy argues that Christian and Islamic religious communities become more conducive to actions and attitudes conducive to and compatible with liberal democracy in religiously diverse and integrated settings than in religiously homogeneous or diverse but segregated settings.
AbstrakRemisi merupakan salah satu hak narapidana yang telah diatur dalam undangundang. Namun faktanya syariat Islam memiliki beberapa ketentuan dan aturan yangberbeda mengenai pemberian remisi, terutama bagi pelaku tindak pidana korupsi.Artikel ini berusaha untuk mengidentifkasi salah satu masalah fundamental dalampemberian remisi bagi pelaku tindak pidana korupsi. Melalui penelitian ini diharapkanmampu mengetahui bagaimana syariat Islam memandang tindak pidana korupsi sertabagaimana pemberian remisi bagi pelaku tindak pidana korupsi. Peneliatian kualitatifini menggunakan metode analisis isi (content analysis), sehingga sejumlah hasil dapatditemukan. Pertama, pemberian remisi bagi koruptor tidak sesuai dengan teori keadilandalam Islam. Kedua, pemberian remisi bagi koruptor tidak memberikan kemaslahatanapapun bagi ummat, namun hanya sebatas kemaslahatan pribadi pelaku kejahatan korupsi.Ketiga, akibat yang ditimbulkan dari kejahatan korupsi sangat merusak dan membahayakan,terlebih dalam aspek perekonomian masyarakat, pembangunan, kesejahteraan rakyat,politik, dan hukum. Sehingga penulis menyimpulkan bahwa pemberian remisi baginarapidana tindak pidana korupsi tidak sesuai dengan syariat Islam.Kata Kunci: Remisi, Korupsi, Syariat Islam

Der Begriff der Religionsgesellschaft ist ein zentraler Begriff des institutionellen Staatskirchenrechts. Er ist unter anderem tatbestandliche Voraussetzung für die Anerkennung als Körperschaft des öffentlichen Rechts sowie für die Erteilung von Religionsunterricht als ordentliches Schulfach. Die noch heute gebräuchliche Definition geht zurück auf einen Kommentar von Gerhard Anschütz zur Weimarer Reichsverfassung und wurde hauptsächlich vor dem Hintergrund der christlichen Kirchen entwickelt. Für die Sicherung der negativen Religionsfreiheit spielt der Begriff der Religionsgesellschaft eine bedeutsame Rolle, indem er eine mitgliedschaftliche Zuordnung ermöglicht. Hier bestehen auch die größten Probleme bei der Anwendung auf islamische Vereinigungen. Da dem Islam eine mitgliedschaftliche Organisation fremd ist, stellen islamische Vereinigungen größtenteils noch keine Religionsgesellschaft im Sinne des Grundgesetzes dar.
