Aspectos de Derecho orgánico judicial en la nueva legislación concursal
En el presente artículo se aborda un aspecto puntual de la nueva legislación concursal, cual es el referido a sus aspectos de derecho orgánico judicial. En este sentido pretendemos estudiar el régimen jurídico de los nuevos Juzgados Mercantiles, abordando para ello las reformas operadas tanto en nuestra Ley Orgánica del Poder Judicial, como en el estudio de los aspectos procesales relativos a la competencia judicial, contenidos en la nueva Ley Concursal. Se estudian así tanto la LO 8/2003, de 9 de julio, como la Ley 22/2003, de 9 de julio. Finalmente, también se hace una breve referencia al nuevo sistema de provisión de plazas en los Juzgados Mercantiles y de las necesidades de especialización de los Magistrados que ocupen dichos órganos jurisdiccionales. ; In the present work an precise aspect of the new concursal legislation is approached, as he is the referred one to his aspects of judicial organic right. In this sense we try to study the legal regime of the new Mercantile Courts, approaching for it the operated reforms so much in our Statutory law of the Judicial Power, as in the study of the procedural aspects relative to the judicial competence, contents in the new Ley Concursal. The Ley Orgánica 8/ 2003 study thus as much, of 9 of July, like Law 22/2003, of 9 of July. Finally, also a brief reference to the new system is made of provision of seats in the Mercantile Courts and the necessities of specialization of the Magistrates who occupy these jurisdictional organs.
