Das Werk befasst sich aus nationaler und internationaler Perspektive mit der Vertraulichkeit im Bereich der Schiedsgerichtsbarkeit. Ausgangspunkt ist der Grundsatz der Nichtöffentlichkeit von Schiedsverfahren, der allgemein anerkannt ist. Die Frage nach dem Bestand und Umfang einer Vertraulichkeitspflicht der Beteiligten eines Schiedsverfahrens ist insbesondere im Hinblick auf die Schiedsparteien relevant. Je nachdem, welche Schiedsordnung oder nationale Rechtsordnung anwendbar ist und in welcher Situation eine Offenlegung erfolgt, ergeben sich unterschiedliche Antworten auf die Frage nach dem Bestehen und dem Umfang einer Pflicht zur Vertraulichkeit. Zudem werden Fälle betrachtet, bei denen eine Partei ein Staat oder ein staatlich beherrschtes Unternehmen ist. Hierbei wird untersucht, inwieweit der Umstand einer staatlichen Beteiligung bei der Frage nach einer Vertraulichkeitspflicht zu berücksichtigen ist. Die Arbeit begründet eine Pflicht zur Vertraulichkeit der Schiedsparteien auf einer Nebenpflicht der Schiedsvereinbarung und widmet sich auch dem Umfang einer solchen Verpflichtung. Der Autor betrachtet ebenfalls die zahlreichen Ausnahmen von der Vertraulichkeitspflicht und stellt hierzu die gesetzlichen und durch die Rechtsprechung anerkannten Fallkonstellationen dar. Schließlich wird untersucht, wer für Fragen der Vertraulichkeit zuständig ist und welche Rechtsfolgen sich aus einer Verletzung dieser Verpflichtung ergeben können

The International African Institute (IAI) is concerned with the study of African cultures and social systems-both the traditional structures, with the beliefs and attitudes which underlie them, and the changes and tensions to which they are presently subjected. The IAI's work has 3 aspects: research, information services, and publications. Extensive research has been carried out in linguistic, ethnographic, and sociological areas. The research was interrupted by the war and since, has been resumed on a wider scale than before. The principle aim in post-war research has been to describe and understand the changes which are taking place in the lives of the African people. The IAI's information services have been expanded and now provide a unique tool for research workers, students, administrators, and those concerned with African problems. A series of monographs has been published. 2 quarterly reviews: Africa and African Abstracts are published. Membership in the institute is open to all persons with interests in the fields of African ethnology, sociology, and linguistics. J. E. Hughes.

The paper discussed the economic theory of international antitrust institutions. Economic theory shows that non-coordinated competition policies of regimes that are territorially smaller than the international markets on which business companies compete violate cross-border allocative efficiency and are deficient with respect to global welfare. At the same time, some diversity of antitrust institutions and policies promotes dynamic and evolutionary efficiency so that globally binding, worldwide homogenous competition rules do not represent a first-best solution either. After reviewing the existing international antitrust institutions and their prospects and limits from an economic perspective (with a focus on the International Competition Network, ICN), the paper discusses reform proposals from economic literature. -- international competition policy ; international antitrust ; International ; Competition Network ; global governance ; WTO ; institutions ; international organizations
