This article will present the evolution of alternative care provision in the Maldives. The Maldives is a small island nation located in the Indian Ocean, with a population of around 530,000. Since the signing and ratification of the UNCRC in 1991, there have been many improvements in children's lives; for example, progress has been made in school attendance, improved child literacy rates and infant mortality has been reduced significantly. However, the country still faces several challenges in terms of child welfare, including internal child trafficking, child abuse, neglect and child marriage. There are currently 187 children living apart from their families in alternative care, which accounts for 0.02% of children in the country. The predominant form of alternative care provision remains institutional, which is typified by large numbers of children cared for by relatively low numbers of care staff. The article will explain, how historically, when a child was unable to remain with their parents, informal kinship care was the predominant form of provision. Often this would result in grandmothers, aunts and the wider family/kinship groups looking after children. However, with the establishment of a large reformatory school Islaahiya in Male Atoll in 1979, residential care was created as an option for boys who were described as having behavioural issues. It remained a key alternative care provider in the country until it closed in 2013. In 2004, the state-run institution Kudakudhinge Hiya was established to care for 45 boys and girls from 0 to 9 years old. Then in 2016 with the support of the Qatar Foundation, the state built another institution Fiyavithi, which still cares for 80 children under 13 years of age. The article will conclude with an overview of the most recent developments in the Maldives' alternative care system. It will highlight how the Child Rights Protection Act (2019) has sown the seeds of care reform with primary legislation enacting regulations for family-based provision. This has formalised the previously established foster care panel that was set up in 2012. There are now 18 registered formal foster carers across the Maldives who are caring for 16 children. Furthermore, in 2020 whilst waiting for the growth in foster care, the state government started to shift from large-scale institutions by establishing nine smaller institutions, located across the atoll, each caring for no more than 25 children. The ministry has also embarked on processes of family reunification. The article will critically discuss these developments, highlight the challenges experienced during these recent reforms and provide key messages for policy and practice going forward.

Young people transitioning from out-of-home care (OOHC), often called care leavers, are known to experience mental health challenges. This article presents a scoping review of research studies completed on the mental health care needs and outcomes of care leavers in Australia from 2015 to 2021. Incorporating 17 studies consisting of six peer-reviewed papers and 11 grey literature reports, the review identified several common concerns pertaining to high levels of poor mental health and psychosocial complexity. These concerns were attributed to a number of factors including placement instability, inadequate access to specialist mental health support services, and limited workforce skills and training. Some sub-groups of care leavers such as young parents, those leaving residential care, Aboriginal and Torres Strait Islander care leavers, and an older cohort who had experience of institutional OOHC in earlier decades, were noted to be at particular risk. Nevertheless, some strategies for improving policy and practice were highlighted including more concrete transition planning that established links with support services prior to leaving care, an extension of OOHC till at least 21 years of age, provision of further supports such as trauma-informed approaches targeted towards the specific needs of this vulnerable population and culturally responsive programs for Indigenous youth. A limitation of the review was that most studies included were completed before the introduction of extended OOHC in all Australian jurisdictions, and hence do not reflect the positive influence of extended care on transition pathways including mental health. Future research should specifically examine the impact of extended care models on mental health care needs and outcomes.

This article examines the intersections of orphanage trafficking, a form of child trafficking and modern slavery, and the sale and sexual exploitation of children with reference to the Sustainable Development Goals. It outlines the contextual challenges of these intersections highlighting the special protection needs of children residing in institutions and outlines how orphanage tourism and funding undermine care reform efforts of national authorities. To address these issues, we make recommendations to address both the in-country and external causal factors that drive and enable orphanage trafficking suggesting that governments of host and sending countries should work in tandem, under the framework of international cooperation, to implement practical measures to combat orphanage trafficking.

Various studies have been published on the occurrence of orphanage trafficking in Nepal. These studies have focused on how orphanage trafficking occurs but have not investigated how orphanage trafficking is responded to from a legal perspective. This article analyses the legal framework for prosecuting orphanage trafficking in Nepal. It considers the available legislative frameworks for pursuing prosecution and makes recommendations for Nepal to reform their anti-trafficking law to include orphanage trafficking and to align with international law.

The Indian Judicial System lags in addressing child trafficking, as it does not yet have a dedicated Act or law to address the issue of either human or child trafficking. The Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill of 2018 still awaits a nod from the Upper House of the Parliament, the Rajya Sabha, to be implemented. However, a network of other laws, policies and schemes sets out measures to provide some preventive and rehabilitative services for children who are vulnerable to trafficking or have been trafficked. These include children who have lost one or both parents, live on streets, belong to low socio-economic background and have been abused, among others. Some of the laws and policies regarding safeguarding of children include the Juvenile Justice (Care and Protection of Children) Act, 2015; Mission Vatsalya, 2022 and Child and Adolescent Labour (Prohibition and Regulation) Act, 1986. The mentioned laws and policies have set up key mechanisms for child protection by the government in the Indian context. This article looks to identify such provisions across the Indian legislative and programmatic landscape that are instrumental in keeping children in the care of family as far as possible and providing them safe out-of-home care where family care cannot be provided. It also reviews how these provisions set up, or fail to set up, a safety net around children to protect them from trafficking. The article undertakes a critical analysis of child protection measures set up by the government in India to identify good practices as well as gaps in the judicial and policy landscape of child protection and trafficking. It analyses the Guidelines on Mission Vatsalya, Juvenile Justice (Care and Protection of Children) Act, 2015 and Child and Adolescent Labour (Prohibition and Regulation) Act, 1986.

Child trafficking is in fact a demand-driven problem. There are industries which run on the nimble fingers of children. The Bangle industry is one such industry among many others. Traffickers target the most vulnerable children. The offence of trafficking spans two or more two states. It makes prosecution of the traffickers difficult. The kind of energy, synergy, time and money required is hard to arrange as survivors of child trafficking belong to marginalised sections of society. The survivors do not go back to the place of rescue where they were trafficked, engaged and exploited. This results in traffickers committing the offence of child trafficking with impunity. India does not have a victim-centric comprehensive legislation on human trafficking to combat it. There is no dedicated working mechanism to combat human trafficking that works well. Anti-Human Trafficking Units across the country have remained on the papers. The Conviction rate in the crime of human trafficking is 1.5%, according to the National Crime Records Bureau 2021.

Child labour is a global problem that affects children's lives. Children engage in work that is physically, mentally, and emotionally harmful. Previous studies have found that exposure to work as a child is associated with adverse mental health outcomes, and severity is related to the intensity and type of work. India is ranked highest in terms of children in labour in South Asia, according to ILO estimates. The Kailash Satyarthi Children's Foundation (KSCF) is a non-profit organization focused on addressing the problem of child labour in India. It works to rescue children from bonded labour and return them to their families or place them in rehabilitation centres. KSCF partnered with the Harvard T. H. Chan School of Public Health and Medical Aid Films to create a consultation program that aims to support the children and the caregivers at the rehabilitation centres. The program includes a series of short animated films, a trauma training curriculum, and ongoing case consultation with the caregivers.
