In October 1989, Uzbekistan's Supreme Soviet adopted the law "On the State Language of the Uzbek SSR." At that time, Uzbekistan was still one of the 15 constituent republics of the USSR. The law was an important symbol of Uzbekistan's changing relation to Russia and the assertion of the preeminence of Uzbek culture in Uzbekistan.
I present two U.S. court cases in which I participated as a linguistic anthropological "expert" to show how language ideologies of the law both influence legal outcomes and conflict with "scientific" ideas about language. One case was the murder trial of a young Mixtec‐speaking Indian from Oaxaca; the other was a civil suit brought by four Hispanic women dismissed from an elder‐care center for speaking Spanish on the job. I identify in the linguistic ideologies of both cases a principle of "referential transparency" that takes the essential business of words, regardless of the linguistic code, to be communicating propositional information. In the second case, 1 describe a further notion of "linguistic paranoia" in which speaking a language other than English is taken as inherently insulting or threatening. I relate these implicit ideological threads to the legal outcomes, to the restricted notions of potential "language rights" that might emerge from such ideologies, and to the clash between theoretical and judicial perspectives on language. W XVII w. syntagmy z czasownikami funkcjonalnymi (FVG) były uznawane za cechę niemieckiego języka specjalistycznego. Konstrukcje te są wciąż obecne w niemieckim języku prawnym. Choć język administracji uważany jest za część jezyka prawnego, w ramach poszczególnych (pod)języków w dziedzinie prawa występują pewne różnice. Można mówić o dyskursie wymiaru sprawiedliwości, prawa karnego, prawa międzynarodowego itd. Obywatele najczęściej stykają się z dyskursem prawa administracyjnego i to on jest najczęściej krytykowany jako "język biurokratyczny" lub "żargon urzędniczy". Celem tego artykułu jest zbadanie syntagm z czasownikami funkcjonalnymi często występujacymi w języku niemieckiego prawa administracyjnego i porównanie ich z tymi występującymi w języku niemieckiego prawa karnego procesowego. ; Back in the 18thcentury, structures with phrasal verbs (FVG) were determined as a featureof German technical language. These constructs are still present in the language of law. Although the administrative language is considered a part of the legal language, there are discursive differences between specific(sub)languages in the field of law. One can speak of the discourses of justice, of criminal law, of international law, etc. It is the language of administrative law that citizens as lay people are most often confronted with, and it is often criticized as "a bureaucracy language", or "the paper style". The aim of this paper is to examine the structures with phrasal verbs frequently occurring in the language of German administrative law and compare them with those in German criminal procedure law. First partofthecorpusisbuiltbyphrasalverbstructuresexcerptedfromfollowing German laws: Verwaltungsverfahrensgesetz, Verwaltungsvollstreckungsgesetz, Verwaltungskostengesetz. In order to explore potential discursive differences between specific languages in the field of law, the collected examples are compared with the most frequent phrasal verb structures of the German criminal procedure law. For that purpose, the Criminal Procedure Code (StPO) of 1987 (last amended in 2015) is used as the second part of the researched corpus. In the concluding part of the paper, the authors draw conclusions based on the analysis carried out. The results of this study can be of assistance to law students in mastering German legal terminology, to all linguists dealing with German language of law and especially to all translators and interpreters from the German and into the German language. ; Die Funktionsverbgefüge (FVG) sind schon im 18. Jh. als ein Merkmal deutscher Fachsprachen gekennzeichnet. Besonders intensiv sind diese Konstrukte in der Rechtssprache präsent. Obwohl die Verwaltungssprache als ein Bestandteil der Rechtssprache betrachtet wird, gibt es innerhalb der Rechtssprache diskursive Unterschiede zwischen den Sondersprachen im Bereich Jura. So spricht man oft vom Diskurs der Rechtspflege, Diskurs des Strafrechts, Diskurs des Völkerrechts, usw. Bürger als Laien kommen am häufigsten mit der Verwaltungssprache in Kontakt, und deswegen ist diese Sondersprache oft kritisiert und mit Attributen wie "die Bürokratiesprache", "der papierene Stil" usw. versehen. Das Ziel dieses Beitrags ist, die in der Verwaltungssprache vorkommenden FVG in deutschen Gesetzestexten zu untersuchen und mit denen der Strafverfahrensrechtssprache zu vergleichen. Den ersten Teil des Korpus bilden die FVG, die folgenden Gesetzen entnommen sind: Verwaltungsverfahrensgesetz, Verwaltungs-vollstreckungsgesetz und Ljubica Kordić Und Borislav Marušić: Funktionsverbgefüge… 10 Verwaltungskostengesetz. Zum Zweck der Überprüfung der diskursiven Unterschiede zwischen Sondersprachen im Bereich Jura werden im mittleren Teil des Beitrags die gesammelten Belege ihrer Struktur und Frequenz nach mit den im Bereich des Strafverfahrensrechts vorkommenden FVG verglichen und analysiert, wobei als Quelle der Untersuchung die Strafprozessordnung (StPO) vom Jahr 1987 (zuletzt geändert in 2015) benutzt wird. Am Ende ziehen wir Schlussfolgerungen aufgrund der durchgeführten Analyse. Die Resultate dieser Studie können den Jura- und Germanistikstudenten, den sich mit der Rechtssprache befassenden Linguisten und vor allem den Übersetzern von Nutzen sein.
