Neste trabalho, adotando a perspectiva da Análise do Discurso de linha francesa, com ênfase nas reflexões de Maingueneau sobre a noção de discurso constituinte, tratamos de algumas particularidades da constituição do discurso espírita kardecista. Mais exatamente, tratamos de demonstrar que, constituindo-se a partir de outros discursos constituintes (o discurso religioso, do científico e do filosófico), o discurso espírita kardecista assume uma posição paratópica para se legitimar, simulando superar os limites desses discursos a partir dos quais se constitui, o que o legitima de um modo especial e lhe reveste de autoridade. Além disso, analisamos a figura do "médium espírita", considerando-a como um caso de paratopia de identidade, o que também reforça a condição paratópica do discurso espírita kardecista na qualidade de discurso constituinte.

Rare diseases impact all socio-economic, geographic, and racial groups indiscriminately. Newborn screening (NBS) is an exemplary international public health initiative that identifies infants with rare conditions early in life to reduce morbidity and mortality. NBS theoretically promotes equity through universal access, regardless of financial ability. There is however heterogeneity in access to newborn screening and conditions that are screened throughout the world. In the United States and some other developed countries, NBS is provided to all babies, subsidized by the local or federal government. Although NBS is an equitable test, infants admitted to neonatal intensive care units (NICUs) may not receive similar benefits to healthier infants. Newborns in the NICU may receive delayed and/or multiple newborn screens due to known limitations in interpreting the results with prematurity, total parenteral nutrition, blood transfusions, infection, and life support. Thus, genomic technologies might be needed in addition to NBS for equitable care of this vulnerable population. Whole exome (WES) and genome sequencing (WGS) have been recently studied in critically ill newborns across the world and have shown promising results in shortening diagnostic odysseys and providing clinical utility. However, in certain circumstances several barriers might limit access to these tests. Here, we discuss some of the existing barriers to genomic sequencing in NICUs in the United States, explore the ethical implications related to low access, consider ways to increase access to genomic testing, and offer some suggestions for future research in these areas.

Neste artigo, a partir de estudos foucaultianos, discutem-se as noções de masturbação, anomalia e práticas de confissão, associadas a investigações voltadas para as subjetividades femininas veiculadas pela mídia, cujas imagens apresentam modelos para a construção de novos sujeitos. Utilizam-se também como dispositivos analíticos os estudos de Zygmunt Bauman, apoiados em Thomas Mathiesen, acerca do sinóptico como novo mecanismo de poder em funcionamento na mídia, e alguns assinalados por Rosa Maria Bueno Fischer. O que se pretende é discutir a materialidade lingüístico-discursiva do depoimento-confissão de uma mulher negra, pobre e idosa, selecionado da novela Páginas da vida, exibida pela TV Globo, em 2006, a fim de se apreenderem os efeitos de sentido que poderiam construir um dos primeiros sinais de sua "anormalidade". Tal discussão aponta para a reinvenção de uma outra figura do "anormal", com implicações éticas, uma vez que a mulher subverte práticas discursivas advindas de certos saberes e poderes.

ObjectivesWhen adverse events (AE) occur, there are different consequences for healthcare professionals. The environment in which professionals work can influence the experience. This study aims to explore the experiences of second victims (SV) among health professionals in Argentina.MethodsA phenomenological study was used with in-depth interviews with healthcare professionals. Audio recordings and verbatim transcriptions were analyzed independently for themes, subthemes, and codes.ResultsThree main themes emerged from the analysis: navigating the experience, the environment, and the turning point. Subthemes were identified for navigating the experience to describe the process: receiving the impact, transition, and taking action.ConclusionSVs undergo a process after an AE. The environment is part of this experience. It is a turning point in SVs' professional and personal lives. Improving the psychological safety (PS) environment is essential for ensuring the safety of SVs.

623The traditional view on regulatory capture focuses on capture as a distortion of public purpose through a malicious relationship, corruption and possible collusion between the regulator and the industry (hard capture). This paper argues that regulatory capture can arise from political and institutional conditions which do not allow or favour the supervisory independence of authorities from both the industry and the government (soft capture). This paper's argument is illustrated through a case-study on the German Federal Financial Supervisory Authority's (BaFin) handlining of the Wirecard AG case. The basis for the analysis are the findings from the Committee of Inquiry of the German Bundestag and the European Securities and Markets Authority (ESMA) Fast Track Peer Review (FTPR) through three lines of inquiry: (1) lack of balance sheet control; (2) the short selling ban; and (3) Wirecard AG's stock trading by BaFin's employees. This paper concludes that BaFin was not hard captured in the Wirecard AG case as de facto influence cannot be proven. Instead, its de jure dependency vis-à-vis the MoF (as implicitly endorsed by German law) might have contributed to a case of soft regulatory capture – especially in the aspect of the short selling ban. The paper then analyses the reforms enacted by Germany and promoted by Europe in post-Wirecard case.
