This report is provided in the scope of the project "Advancing REACH", funded by the research plan of the German Ministry of the Environment. The project aims to develop options to improve (the implementation of) the REACH regulation by analysing various REACH processes and related issues, including substitution, sustainable chemistry, precautionary principle, articles, cost-benefit analyses, socio-economic analyses and financing ECHA. The study analyses, under the perspective of the aims of the REACH Regulation, how the quality of registration dossiers could be improved. Starting point are empirical data, including those provided by ECHA, indicating that a relevant part of the registration dossiers does not meet the requirements set out in REACH. The study examines the requirements of the relevant legal mechanisms completeness check and dossier evaluation, as well as their practical implementation and, based on available data, the measurable effects of these. The report then develops "policy options" that can contribute to an improvement. An in-depth impact assessment of the presented options is not part of the study. Nevertheless, the results suggest that the legal context requires clarification. This applies to each of the analysed problem areas.
"Ziel der Tagung ist es, Beiträge zur interdisziplinären Verständigung zu leisten und eine Klärung
darüber herbeizuführen, welche Anforderungen an Verhaltensmodelle in der interdisziplinären
wissenschaftlichen Politikberatung zu stellen sind. Die Verknüpfung der theoretischen Ansätze
aus Ökonomik, Politologie und Rechtswissenschaften zu einem heuristischen Verhaltensmodell
soll offen legen, welche Annahmen auf dem Weg zu einer aussagefähigen Prognose über das
Verhalten von Normadressaten in einem politischen Handlungsfeld zu treffen sind.
Die Tagung soll zum einen die theoretischen Modellannahmen kritisch hinterfragen und zum
anderen die Leistungsfähigkeit der Modelle aus den einzelnen Disziplinen sowie des

The Sustainable Development Goals (SDGs) adopted by the United Nations provide normative orientation for many national and regional governments as well as actors from industry and other parts of the civil society. There is growing consensus that the corresponding transformation processes needed - e.g. in the field of production and consumption patterns (SDG 12) - have to be fostered by a corresponding institutional framework. Properly designed regulatory experiments that generate a learning system for all actors involved may be an important building block. Based on an interdisciplinary approach, we develop an overview of the various terminologies for regulatory experimentation currently discussed in the social sciences, derive common criteria for regulatory experimentation in reflexive governance structures and conclude in presenting a conceptual framework for analysing empirical studies of regulatory experiments.

"Forschungsvorhaben im Rahmen von FONA zielen darauf ab, Empfehlungen für das Verhalten von Akteuren oder für die Gestaltung von Rahmenbedingungen zu entwickeln. Dabei geht jeder Forschungsantrag – zumindest implizit – von Annahmen darüber aus, welche Faktoren das Verhalten der Akteure bestimmen, die Gegenstand des jeweiligen Forschungsvorhabens sind. Welche Verhaltensannahmen dies sind, ist für das Forschungsergebnis und daraus resultierende Handlungsempfehlungen oftmals von ausschlaggebender Bedeutung, wie sich etwa anhand der Studien in den Förderschwerpunkten Ina und :[riw] deutlich machen lässt. Voneinander abweichende Gestaltungsempfehlungen in verschiedenen Gutachten haben nicht selten ihre Ursache in divergierenden Verhaltensannahmen. Die 'Abnehmer' der Forschungsvorhaben – und dies gilt für private Akteure (etwa in Unternehmen) ebenso wie für die öffentliche Hand – stehen vor dem Problem, die erzielten Ergebnisse einzuordnen. Dafür ist es notwendig, die Verhaltensannahmen nachvollziehen zu können, die dem Projekt zugrunde lagen. Dies zu ermöglichen, ist eine Bringschuld der Wissenschaftler. Indem sie Verhaltensannahmen nachvollziehbar machen, leisten sie einen Beitrag zur wissenschaftlichen Qualitätssicherung und erhöhen damit zugleich die Prognosefähigkeit ihrer Aussagen. Insgesamt steigt damit die Überzeugungskraft wissenschaftlicher Aussagen." (Autorenreferat)

"Der Bericht dient der Darstellung der Ergebnisse zum Projekt 'Lebensmittelwerbung für Kinderprodukte - Strategieentwürfe für den vorbeugenden Verbraucherschutz'. Das Vorhaben stellt den rechtlichen Rahmen für Lebensmittelwerbung vor Kindern, die aktuellen Erkenntnisse der Ernährungswissenschaft und die werbepsychologischen bzw. sozialpsychologischen Grundlagen dar und vergleicht diese exemplarisch mit der aktuellen Lebensmittelwerbung für die Zielgruppe Kinder. Die Datenbank erfasst die Art der Darstellung und Aussagen, eine Beurteilung der beworbenen Produkte aufgrund der Energiedichte und der glykämischen Last in Verbindung mit dem Sättigungswert und die Verstöße der Hersteller gegen Regeln, die aus gesetzlichen Vorschriften abgeleitet werden können und Regeln des deutschen Werberates. Die daraus entstehende empirische Basis belegt das Ausmaß und die Qualität der Lebensmittelwerbung für Kinderprodukte und stellt somit das Maß für die Verantwortung der Werbetreibenden und den Regelungsbedarf dar. Ausgehend davon dient die anschließende Institutionenanalyse einer geeigneten Strategieentwicklung in diesem Politikfeld. Dabei geht es darum, dass das erforderliche Schutzniveau durch möglichst eingriffsarme Instrumente zu gewährleisten ist. Die Art der in dieser Hinsicht optimalen Eingriffsinstrumente (Verbote, Auflagen, Abgabenlösungen, Informationspflichten, etc.) hängt ab von der Größe der Akteursgruppen, dem zu behebenden Regulierungsproblem sowie den instrumentellen Rahmenbedingungen.(...)" This report is provided in the scope of the project "Advancing REACH", funded by the research plan of the German Ministry for the Environment. The project aims to develop options to improve the (implementation of) the REACH regulation by analysing various REACH processes and related issues, including substitution, sustainable chemistry, precautionary principle, articles, cost-benefit analyses, socio-economic analyses and financing ECHA. This report discusses the question, which policy options are available to improve the efficiency of the appeal procedure under REACH and the impacts on the objectives laid down in Art. 1 REACH. It discusses three policy options with regard to streamlining the ECHA procedure. The first option consists of streamlining deadlines, the second option grants the Board of Appeal the discretion to issue an interim order, and the third option includes legislative options to limit the scope and intensity of the review. In light of the overall objectives of REACH and a legal systemic consideration, the second option appears most favourable.

This report is provided in the scope of the project "Advancing REACH", funded by the research plan of the German Ministry of the Environment. The project aims to develop options to improve the implementation of REACH by analysing various REACH processes and related issues, including substitution, sustainable chemistry, precautionary principle, cost-benefit analyses, socio-economic analyses and financing ECHA. The study analyses, under the perspective of the aims of the REACH Regulation and the requirements formulated in the context of the "circular economy package", the current legal framework of instruments governing the risk management and related notification and communication obligations concerning "substances in articles" (SiA). The study discusses the definition of the term "article" and its interplay with chemical substances contained in the article or that are an integral element thereof. The subsequent sections analyse the communication obligations in the professional supply chain and towards consumers, the provisions on the registration and notification of SiA as well as the authorisation and restriction schemes. Each section assesses the respective legal framework (objectives, mechanisms, uncertainties) as well as the state of the art regarding implementation and, based on lessons learned, develops policy options to enhance the framework. Tables at the end of each section summarize the options and the expected effects. Whilst an in-depth impact analysis of the presented options is beyond the scope of the study, the findings suggest the need to clarify the legal context. This is true for each of the problem areas analysed.

"In Diskussionen um die EG-Richtlinie über Elektro- und Elektronikaltgeräte (WEEERL)
wurden Bedenken wegen eines möglichen Wirkungsdefekts bei Rücknahmeverpflichtungen
geäußert. Durch grenzüberschreitenden Direktvertrieb könnten zunehmend
Produkte in die inländischen Verwertungs- und Beseitigungsströme gelangen, bei denen
es nicht gelingt, dem Hersteller oder Importeur die Produktverantwortung zuzuweisen.
Die inzwischen verabschiedete Richtlinie vom 27. Januar 2003 bezieht diese Problematik
explizit ein, lässt aber die Gestaltung noch offen. Eine nähere Untersuchung der
Wirkungsweise dieser Rücknahmeregelungen macht deutlich, dass ein derartiger Wirkungsdefekt
zu Wettbewerbsverzerrungen und negativen Konsequenzen für Genese und
Umsetzung von Innovationen zur Abfallvermeidung und Entsorgung führt, falls der
entsprechende grenzüberschreitende Handel einen wirtschaftlich relevanten Umfang
erlangt. Die empirischen Ergebnisse zeigen jedoch, dass mittelfristig die Wachstumsaussichten
des grenzüberschreitenden Distanzhandels nicht als übermäßig hoch einzuschätzen
sind. Darüber hinaus wird das Ausmaß der entstehenden Wettbewerbsverzerrung
nicht zuletzt von der europaweiten Umsetzung der EG-Richtlinie in nationales

Based on 143 case studies from Germany from 2005 to 2018, the paper presents findings from an evaluation of the Strategic Environmental Assessment's (SEA) effectiveness and efficiency in practice. The results show that SEA has a significant impact on planning. On the other hand, there are a number of deficits in its application. The study therefore develops design options for a more efficient and effective application. Most of the options can be realised through administrative-organisational measures; others require changes at the legal level. The paper is based on a research study commissioned by the German Environment Protection Agency.

Die Studie dient der wissenschaftlichen Evaluation der Praxis der Strategischen Umweltprüfung (SUP) in Deutschland. Maßstab der Evaluation sind die gesetzlichen Vorgaben des Gesetzes über die Umweltverträglichkeitsprüfung und weiterer Fachgesetze zur SUP. Neben der Untersuchung der positiven Wirksamkeit der SUP als gesetzliches Instrument der Umweltvorsorge wurden insbesondere auch Defizite ermittelt und Gestaltungsoptionen für einen effizienten und effektiven Vollzug aufgezeigt. Zur weiteren Optimierung der SUP-Praxis kommen administrativ-organisatorische Maßnahmen in Betracht, die im Bericht vorgestellt werden. Zudem werden punktuelle Änderungen auf gesetzlicher Ebene vorgeschlagen. Die Studie basiert auf der Untersuchung von 143 Fallstudien Strategischer Umweltprüfungen der Jahre 2005 bis 2018. Die Fallstudien aus den Bereichen Raumordnungsplanung, Bauleitplanung und Fachplanung repräsentieren einen breiten Querschnitt der SUP-Praxis in Deutschland.
