The EU is currently facing some fundamental challenges: the euro and refugee crises are still unresolved, the solidarity between Member States is eroding, and nationalist forces are growing as support for European integration is diminishing. The union appears too heterogeneous, and the economic and political interests of the 28 Member States too diverse, to be able to address these challenges as a whole. Does the concept of differentiated integration offer a possible solution? Can such differentiation offer the European integration project a better and more stable future? Which measures of diversity and flexibility can the "ever closer Union among the peoples of Europe" endure? Or will such differentiation ultimately damage the joint European project? This collection of leading European lawyers tackles these questions and suggests how they might be addressed. --

Spätestens seit dem massiven Anstieg der Zahl der Flüchtlinge, die in Europa ankommen, stehen die Europäische Union und ihre Mitgliedstaaten vor einer Vielzahl von rechtlichen Herausforderungen im Hinblick auf Asyl und Migration. Zudem sind dadurch Defizite im bestehenden System offenkundig geworden, sodass nach neuen und vor allem gemeinsamen Perspektiven gesucht werden muss, damit zufriedenstellende Regelungen und Lösungen für alle Seiten erreicht werden können. Mit dem ZEuS-Sonderband soll ein Beitrag zur Aufarbeitung und Weiterentwicklung des europäischen Flüchtlingsrechts geleistet werden.

"Individual rights under EU law must be effectively enforceable against EU Member States. Philipp Tamme examines the extent to which the European Court of Human Rights can contribute to this. Based on the cases so far decided in Strassburg, the causes of legal deficiencies at national and European level are analyzed and the formal and material conditions for a successful sanctioning of EU law violations under Convention law are identified. On the basis of general principles, the details of the enforcement of procedural rights, EU directives, rights of free access and political rights will be dealt with.
